Protection Against A Bovine Viral Diarrhea Virus (Bvdv) Type 1 Challenge In Calves Vaccinated With A Bovine Herpesvirus-1 (Bhv-1)-Bvdv Recombinant, Heather J. Swan, Lyle J. Braun, Leonard J. Bello, William C. Lawrence, Reg D. Neiger, Christopher C.L. Chase

South Dakota Beef Report, 2003

A recently developed recombinant bovine herpesvirus 1 (BHV-1) virus containing the envelope protein gp53 of bovine viral diarrhea virus (BVDV) type 1, BHV-1 (v1V31), was assessed for its ability to protect against BVDV in calves. Four calves were vaccinated intranasally with the recombinant BHV-1-BVDV vaccine and did not exhibit any clinical signs following vaccination. The vaccine virus was recovered from all vaccinated calves on days 8 through 10 and the replication appeared to be restricted to nasal passages. Twenty-eight days after vaccination, the four vaccinated and four control calves were challenged with the type 1 BVDV, strain NY-1. All calves …

Legal Movements In Intellectual Property: Trips, Unilateral Action, Bilateral Agreements, And Hiv/Aids, Margo A. Bagley

Faculty Articles

This Article begins with an overview of the relationship between the Agreement on Trade-Related Aspects of Intellectual Property Rights (the "TRIPS Agreement") and the HIV/AIDS pandemic which created the need for the Doha Declaration. It then discusses two trade-related movements, unilateral action and TRIPS-plus bilateral agreements, that call into question the long-term effectiveness of the TRIPS Agreement process, generally, and the benefits of the Doha Declaration, in particular, in addressing multiple facets of the access to essential medicines problem. This Article concludes that a consideration of these issues should be included in the development of any further TRIPS-related solutions to …

Patently Unconstitutional: The Geographical Limitation On Prior Art In A Small World, Margo A. Bagley Jan 2003

Patently Unconstitutional: The Geographical Limitation On Prior Art In A Small World, Margo A. Bagley

Faculty Articles

Part I of this Article provides an overview of § 102 of the Patent Act, the role of prior art in the patentability analysis, and the origin of the limitation on relevant non-patent, nonpublished art to that existing "in this country." Part II then analyzes the constitutional deficiency of the limitation in light of the express and implied purposes of the Intellectual Property Clause as informed by judicial decisions, technological changes, global contraction, and expanded notions of inventive research sources. Policy concerns are the focus of Part III, which discusses how § 102's geographical limitation facilitates forms of "biopiracy," conflicts …

Remarks On Regulating Genetically Modified Foods In The United States, L. Val Giddings

Richmond Journal of Law & Technology

Thank you. I’m glad to be here today. Before I launch into my prepared remarks, I do want to correct a couple of things that Greg has just told you. Just for full disclosure, Greg and I shared an office about eighteen years ago when we both worked for the Congressional Office of Technology Assessment. When I arrived in Washington, I spent five years working as an analyst on these sorts of issues. So as I’m about to pound on Greg for knowing a number of things that don’t happen to be true, please be aware that I’m not really …

Sixth Circuit Federal Judicial Selection, Carl W. Tobias Jan 2003

Sixth Circuit Federal Judicial Selection, Carl W. Tobias

Law Faculty Publications

Many of the 179 active federal appeals court judgeships authorized by Congress have remained vacant for protracted times. Over the last dozen years, the appellate system has experienced numerous openings, which have generally comprised ten percent of those seats. Particular tribunals' situations have been worse. At various times since 1996, the United States Courts of Appeals for the Second, Fourth, and Ninth Circuits operated without a third of their judges. However, the most egregious and recent illustration is the United States Court of Appeals for the Sixth Circuit. Almost half of that court's positions are now empty, while a number …

Beware Of The Ides Of March: The Demise Of Hih Insurance, Bonnie Buchanan, Tom Arnold, Lance Nail Jan 2003

Beware Of The Ides Of March: The Demise Of Hih Insurance, Bonnie Buchanan, Tom Arnold, Lance Nail

Finance Faculty Publications

Despite differences in corporate governance systems in the United States and Australia, the corporate governance failures that led to each country’s largest bankruptcy are strikingly similar. WorldCom in the United States and HIH Insurance in Australia were both created by a rapid series of major acquisitions, failed after their last major acquisitions, and attempted to hide their declining performance with aggressive and/or fraudulent accounting practices. In this paper we present a clinical examination of the corporate governance failures that led to the demise of HIH Insurance and show that corporate governance failures are not endemic to the existing corporate governance …

The Functions Of Justice And Anti-Justice In The Peace-Building Process, Paul Williams, Michael Scharff Jan 2003

The Functions Of Justice And Anti-Justice In The Peace-Building Process, Paul Williams, Michael Scharff

Scholarly Articles in Law Reviews & Journals

Recently, there has been increasing use of the tool of justice/accountability in the peace-building process. Yet, the norms of justice, while increasingly invoked, is seldom defined in the context of peace-building. To understand the role that justice has played and has the potential of playing in the peace-building process, it is important first to define the norm as well as articulate its functions. This article therefore serves as an introduction to The Case Western Reserve Journal of International Law’s “Role of Justice in Building Peace” Symposium Issue by providing a detailed definitional description of the justice norm. In addition, it …

Socialization Of Boys And Girls In Natural Contexts, Carolyn P. Edwards, Lisa Knoche, Asiye Kumru Jan 2003

Socialization Of Boys And Girls In Natural Contexts, Carolyn P. Edwards, Lisa Knoche, Asiye Kumru

Department of Psychology: Faculty Publications

Socialization is the general process by which the members of a cultural community or society pass on their language, rules, roles, and customary ways of thinking and behaving to the next generation. Sex role socialization is one important aspect of this general process. The goals of earlier work were to understand how, why, and at what age girls and boys begin to vary behaviorally along such dimensions as "nurturance," "aggression," and "dependency," including determination of how sex-typical dispositions are influenced by cultural factors. This chapter presents a new approach seeking to answer such questions as the following. How are different …

Dictionary Of Contemporary Religion In The Western World: Exploring Living Faiths In Postmodern Contexts (Review), James F. Lewis

Biblical and Theological Studies Faculty Works

When Samuel Clemens heard that a journalist had reported his passing, he quipped: “Rumors of my death, have been greatly exaggerated.” In a similar vein, the Dictionary serves to lay to rest the antiquated but oft-believed claim of secular elites concerning the imminent demise of religion. In 100 articles, written by 61 gifted contributors (18 of whom are from North America) the reader is informed of the staggering breadth, growing profusion and zealous tenacity of religion in modern human culture and its ability to ever morph into new and creative expressions. The authors are committed to the Christian tradition but …

Are The U.S. Patent Priority Rules Really Necessary?, Colleen Chien, Mark Lemley Jan 2003

Are The U.S. Patent Priority Rules Really Necessary?, Colleen Chien, Mark Lemley

Faculty Publications

In this Article, we study U.S. Patent and Trademark Office (“PTO”) interference proceedings and court cases in which the parties dispute who is first to invent. We find that the first person to file is usually, but by no means always, also the first to invent. In over 40% of the cases, the first to invent is last to file. We also find that the long-standing rule that discriminated against foreign inventors by requiring proof of inventive activity in the U.S. had surprisingly little effect on outcomes; that a large number of priority disputes involve near-simultaneous invention; and that the …

1984 And Beyond: Two Decades Of Copyright Law, Tyler T. Ochoa

Faculty Publications

During the past two decades, engineers, authors, publishers, consumers, lawyers and academics have witnessed extraordinary developments in the technological landscape, often leading to equally dramatic developments in the law of copyright. Many of these developments have been chronicled (or foreshadowed) in the pages of the Santa Clara Computer and High Technology Law Journal. To celebrate the Journal's 20th Anniversary, this essay will place a number of articles which have appeared in the Journal in their historical context by taking a look back on how the law of copyright has changed during the past twenty years.

Unfilled Promise: The Human Rights Class Action, Beth Van Schaack Jan 2003

Unfilled Promise: The Human Rights Class Action, Beth Van Schaack

Faculty Publications

Historically, international law consisted primarily of substantive norms, leaving it to individual nation states to determine how to implement and enforce those norms. Human rights class actions in U.S. courts represent one such fusion of international legal rights with domestic judicial remedies. Since the late 1980s, victims of human rights violations have increasingly utilized Federal Rule of Civil Procedure 23 (“Rule 23”), which governs the certification and conduct of the class action in federal court. In certain respects, the rule embodies a unique feature of United States procedural law. The United States Supreme Court has recognized that class relief is …

Mothers Who Kill: Cross-Cultural Patterns In And Perspectives On Contemporary Maternal Filicide, Michelle Oberman Jan 2003

Mothers Who Kill: Cross-Cultural Patterns In And Perspectives On Contemporary Maternal Filicide, Michelle Oberman

Faculty Publications

This article presents a brief cross-cultural review of maternal filicide, focusing specifically on the varying circumstances that surround the mothers who commit this crime. My goal is not to provide a comprehensive map of contemporary maternal filicide, but rather, to illustrate the manner in which a society’s structure of motherhood and women’s status contributes to maternal filicide. Special attention will be paid to the unwritten norms that govern women and motherhood, as well as to the manner in which distinct societies understand, rationalize, and punish maternal filicide. The article begins with a review of the patterned nature of maternal filicide …

Morroco In Transition: Overcoming The Democratic And Human Rights Legacy Of King Hassan Ii, Patricia J. Campbell

Benerd College Faculty Articles

Morocco’s King Hassan II died on 23 July 1999 and was succeeded by his son Muhammad VI. Much of the media coverage of Hassan II following his death portrayed him as a champion of democracy and human rights in the region. Was this really the case? Was Morocco under Hassan II becoming a more democratic and open society? This paper critically examines King Hassan’s legacy, challenges and opportunities it poses for his heir Muhammad VI. The paper also discusses Morocco’s prospects for democratic deepening under the new leader.

Automobile's Hydraulic System Controlled By A Programmable Logic Controller, Alfonso Patlan Jan 2003

Automobile's Hydraulic System Controlled By A Programmable Logic Controller, Alfonso Patlan

Honors Capstones

The purpose of our design is to control the fluctuation of an automobile's hydraulic system using a Programmable Logic Controller (PLC). An Automation Direct PLC is programmed with DirectSoft 32 Relay Ladder Logic Stage Programming software. In addition, an Autoloc remote is used to activate the PLC; magnetic positioning sensors, the PLCs ladder logic program and the hydraulic system-consisting of solenoids/pumps and dumps-are the main components for our design. We intend to use the same ideas and design methods as in industry applications to control the hydraulics of a Lowrider vehicle. The overall process will be the same; PLC will …
