Race, Politics, And Juvenile Justice: The Warren Court And The Conservative "Backlash", Barry C. Feld Jan 2003

Race, Politics, And Juvenile Justice: The Warren Court And The Conservative "Backlash", Barry C. Feld

Articles

A century ago, the Progressive reformers who created the juvenile court embraced a particular ideological construction of childhood as one of innocence and vulnerability. They also adopted a scientific conception of social control - positive criminology - that attempted to identify the causes of criminality and purported to treat, rather than to punish, offenders. The juvenile court combined the new conception of childhood with the new strategies of positive criminology to create a judicial-welfare alternative to the adult criminal process for juveniles. The juvenile court affirmed the responsibility of families to raise their children while expanding the state's prerogative to …

Internal Protection/Relocation/Flight Alternative As An Aspect Of Refugee Status Determination, James C. Hathaway, Michelle Foster Jan 2003

Internal Protection/Relocation/Flight Alternative As An Aspect Of Refugee Status Determination, James C. Hathaway, Michelle Foster

Book Chapters

In many jurisdictions around the world, the possibility of an ‘internal flight alternative’(IFA) (often referred to as ‘internal relocation alternative’) is invoked to deny refugee status to persons at risk of being persecuted for a Convention reason in part, but not all, of their country of origin. In this, as in so many areas of refugee lawand policy, the viability of a universal commitment to protection is challenged by divergence in State practice. The goals of this paper are therefore, first, briefly to review the origins and development of the practice of considering IFA as an aspect of the refugee …

Language Basis Of Reading Disabilities And Implications For Early Identification And Remediation, Hugh W. Catts, Tiffany Hogan Jan 2003

Language Basis Of Reading Disabilities And Implications For Early Identification And Remediation, Hugh W. Catts, Tiffany Hogan

Department of Special Education and Communication Disorders: Faculty Publications

In this paper, we present a brief overview of the language basis of reading and reading disabilities. First, we describe the “Simple View of Reading,” a model of reading that comprises two primary components, word recognition and language comprehension. We then review research showing that language problems underlie most difficulties children have learning to read. Lastly, we discuss implications of these findings for early identification and remediation of reading disabilities.

Beyond Words: An Empirical Study Of Context In Contract Creation, Deborah A. Schmedemann Jan 2003

Beyond Words: An Empirical Study Of Context In Contract Creation, Deborah A. Schmedemann

Faculty Scholarship

This article reports on an empirical study into how judges interpret contracts. In general, the study demonstrates that key participants do look to context for guidance on issues of contract creation. Part II summarizes the modem legal perspective on these questions, as stated in the Restatement (Second) of Contracts, as posited in the scholarly debate about relational contracts, and as exemplified in case law regarding employment contracts. Part III describes a study designed to capture the thinking on these questions of participants in an employment contract. Part IV presents the results obtained from respondents who represented the parties to the …

Annual Anti-Trafficking Reports To Congress - 2002, U.S. Department Of Health And Human Services

Human Trafficking: Data and Documents

Trafficking in persons is modern day slavery. The trafficking of women, children, and men for sexual exploitation, sweatshop labor, involuntary domestic servitude, and migrant agricultural labor violations is estimated to affect hundreds of thousands of people worldwide annually – and tens of thousands in the United States alone. The practice of trafficking in persons is not only an affront to human dignity but also flouts the laws of legitimate commerce.

Reconciling Private Lives And Public Rhetoric: What’S At Stake?, Barbara Couture Jan 2003

Reconciling Private Lives And Public Rhetoric: What’S At Stake?, Barbara Couture

Department of English: Faculty Publications

“I tried it, but I didn’t inhale.” It is hard not to smile at the irony of former president Bill Clinton’s wan attempt to place himself on the right side of the law in public when disclosing his private use of marijuana. And the irony is doubly inflected for us, knowing—as we do now—about his duplicitous public admission that he never “had sex” with Monica Lewinsky. Perhaps there is no figure in American life for whom private life and public rhetoric are more intertwined than for our nation’s president. This consequence of public life in America’s most visible office is …

Forensic Course Development, Luther Troell, Yin Pan, Bill Stackpole Jan 2003

Forensic Course Development, Luther Troell, Yin Pan, Bill Stackpole

Presentations and other scholarship

In recent years, digital technology has experienced dramatic growth. Many of these advances have also provided malicious users with the ability to conceal their activities and destroy evidence of their actions. This has raised the need of developing specialists in computer digital forensics -- the preservation, identification, extraction and documentation of evidence stored in the form of digitally encoded information (data). In this paper, we present the procedures and rationale used in the development of forensic courses at both the undergraduate and the graduate levels. We also demonstrate our decision making process of selecting topics included in each course.

Why Are You Taking Gender And The Law?: Deconstructing The Norms That Keep Men Out Of The Law School’S “Pink Ghetto”, Corey Rayburn Jan 2003

Why Are You Taking Gender And The Law?: Deconstructing The Norms That Keep Men Out Of The Law School’S “Pink Ghetto”, Corey Rayburn

UC Law SF Journal on Gender and Justice

Disproportionately few men enroll in gender-focused law school seminars. Reasons for that reluctance may include that men fear jeopardizing their gains from the "patriarchal dividend" and that interest in gender issues violates the dominant culture's sexist and heterosexist norms regarding proper masculine roles. While there are powerful reasons for believing men should not be in these courses at all, male feminism should offer a distinct voice that does not purport to speak for womyn or allege to have suffered oppression in the manner that womyn have. Exploring a new vocabulary in gender education, encouraging awareness of feminist issues, dismantling of …

Getting Into The Game: The Trickster In American Ethnic Fiction, Helen Lock Jan 2003

Getting Into The Game: The Trickster In American Ethnic Fiction, Helen Lock

Ethnic Studies Review

Trickster novels, especially those by Gerald Vizenor and Maxine Hong Kingston, can be used to destabilize and undermine ethnic stereotypes. As many studies show, the trickster him/herself cannot be stable and thus resists the limitations of definition as the embodiment of ambiguity. Both insider and outsider, s/he plays with the whole concept of "sides" so as to erase the distinction between them. The trickster plays the game, including the game of language, in order to break and exploit its rules and thus destabilizes linguistic markers. Kingston and Vizenor use their novels to subvert the rules of the linguistic game and …

From Cousin Joe To The Comoros: Orthography And The Politics Of Choice In Africa And African America, Harriet Joseph Ottenheimer Jan 2003

From Cousin Joe To The Comoros: Orthography And The Politics Of Choice In Africa And African America, Harriet Joseph Ottenheimer

Ethnic Studies Review

This paper explores issues of orthographic representation in two different projects, in two different locations, and draws some general conclusions about the role of an outsider linguistic anthropologist in working with individuals and their data. One project involved helping Cousin Joe, a blues singer from New Orleans, to edit his autobiography for publication. The other project involved developing a bilingual, bidirectional, Shinzwani-English dictionary for the Comoro Islands. Each project required an awareness of-and sensitivity to-the cultural and political implications of orthographic decisions.

An Economic Analysis Of Domain Name Policy, Karl M. Manheim, Lawrence B. Solum Jan 2003

An Economic Analysis Of Domain Name Policy, Karl M. Manheim, Lawrence B. Solum

UC Law SF Communications and Entertainment Journal

One of the most important features of the architecture of the Internet is the Domain Name System (DNS), which is administered by the Internet Corporation for Assigned Names and Numbers (ICANN). The DNS is organized into a hierarchy of domains. The physical infrastructure of the DNS consists of name servers, which provides the information that directs name queries to the appropriate server. These facilities and devices are scarce resources in the economic sense, since they have a finite capacity and expansion is costly. The name space is scarce because each address (or set of characters) can only be allocated to …
