Unbundling Marriage, James Herbie Difonzo Jan 2003

Unbundling Marriage, James Herbie Difonzo

Hofstra Law Review

Marriage is emerging as a “bundle” of legal benefits and burdens. The history of domestic relations has produced a cornucopia of family arrangements, and the yield shows no signs of diminishing. At the same time, our yearning for a halcyon past has led many to the erroneous belief that the family formation consisting of two parents and the children of their ‘til-death-do-they-part union is the only culturally authentic and “traditional” one. In fact, as Michael Grossberg has observed, our domestic past has been characterized by “the constant reality of American family diversity.” As twenty-first century families are exploring new contours, …

Billing Below Title : The Contested Autobiographies Of Frances Farmer And Louise Brooks, Karen M. Anderson Jan 2003

Billing Below Title : The Contested Autobiographies Of Frances Farmer And Louise Brooks, Karen M. Anderson

Theses, Dissertations and Capstones

Today autobiography and memoir hold great interest for the average reader as well as the literary scholar. Some argue this form has replaced the novel as the dominant modern/postmodern narrative expression. Its study crosses departmental boundaries, surfacing in disciplines such as psychology, as well as English/literature. This thesis focuses on the autobiographies of two Euro-American actresses of the early twentieth century. Intersecting the study of film, narrative, autobiography (“female” or feminist, as well as canonical or “male”) and modernism, it focuses on text and subtext, analyzing reasons for both the works’ and actress/authors’ cultural marginalization. In art as well as …

Impact Of Globalisation On Information Seeking: The Role Of Cultural Lenses And Indigenous Knowledge, Ardis Hanson Jan 2003

Impact Of Globalisation On Information Seeking: The Role Of Cultural Lenses And Indigenous Knowledge, Ardis Hanson

Dean's Office Publications

How can understanding cultural lenses help us rethink constructs that have been taken for granted and assist in identifying new problems of significance in the delivery of information and the establishment of discrete, culturally based cyber-communities? With the increased access of global information, a critical question is how does an individual (or political entity) acquire information that is bias-free as possible that can be reviewed and interpreted in the appropriate context (indigenous knowledge). This paper attempts to provide a discussion of cultural lenses and indigenous knowledge in the development of information seeking behaviours and the design of information systems.

The No-Kill Controversy: Manifest And Latent Sources Of Tension, Arnold Arluke Jan 2003

The No-Kill Controversy: Manifest And Latent Sources Of Tension, Arnold Arluke

State of the Animals 2003

Although some argue that everyone in the debate shares a passionate concern for the welfare of animals, a rift over this issue divides the shelter community. Ultimately, the best interests of animals may not be best addressed in a climate of controversy and criticism. To understand and perhaps reduce this controversy, the tensions fueling the no-kill conflict need to be identified and the breadth of the gulf separating its two camps assessed.

A Preferred Vision For Administering Elementary Schools: A Reflective Essay, Lucy M. Evans Jan 2003

A Preferred Vision For Administering Elementary Schools: A Reflective Essay, Lucy M. Evans

Graduate Research Papers

I believe that every child born into the world deserves, as their unalienable right, an equal opportunity to a quality education as promised by the United States Congress in 1981. This promise can only be accomplished by maintaining the belief that every child can and will learn if given the opportunity. I believe that within the mind of a child is a natural curiosity about this great world that can through proper nurturing continue throughout their lives.

The atmosphere in the school community should be one of caring and acceptance. Plants and animals cannot grow without proper care and nourishment …

The Failure Of The Nation State And The New International Economic Order: Multiple Converging Crises Present Opportunity To Elaborate A New Jus Gentium, Eric A. Engle Jan 2003

The Failure Of The Nation State And The New International Economic Order: Multiple Converging Crises Present Opportunity To Elaborate A New Jus Gentium, Eric A. Engle

St. Thomas Law Review

Both the New International Economic Order ("NIEO") and the New World Order (NWO) have failed to end poverty in the third world, most notably in Africa. The failure of these two theories, themselves responses to the failure of the Westphalian state system, and the material facts of globalisation present an opportunity to elaborate a new law of nations. Abandoning the Westphalian model is the best way forward, not only because of the technological revolution in the first world, but also for cultural reasons in Africa, where borders almost never correspond to nations.

Mary Barton And The Dissembled Dialogue, Roland K. Végső Jan 2003

Mary Barton And The Dissembled Dialogue, Roland K. Végső

Department of English: Faculty Publications

Analyzes the successive critiques of Mary Barton: A Tale of Manchester Life by Elizabeth Gaskell, first 1848. Uses the concept of the "dissembled dialogue" to account for both the poetics and the politics of the text. Borrows the concept of dissembling as a critical tool for a reading of Gaskell's text from Deirdre d'Albertis, who argues that Gaskell's "dissembling fictions" use several strategies to create a "poetics of narrative dissimulation."

An Integral Perspective On Depression, Dinu S. Teodorescu Jan 2003

An Integral Perspective On Depression, Dinu S. Teodorescu

International Journal of Transpersonal Studies

The integral approach to therapy proposes to accommodate all the etiological factors of

unipolar depression in its theory, as well as to make use of all existing therapies, both pharmacological

and psychological, in the treatment of unipolar depression. Integral Therapy is

compared to cognitive therapy to find evidence for its superiority over the cognitive

approach. It appears that the cognitive therapy is more cost-effective than Integral Therapy

as an individual approach in the treatment of depression, but that the integral perspective

accounts better for etiological factors.

Nafta’S Investment Chapter: Initial Thoughts About Second-Generation Rights, Charles Hendrickson Brower Ii Jan 2003

Nafta’S Investment Chapter: Initial Thoughts About Second-Generation Rights, Charles Hendrickson Brower Ii

Law Faculty Research Publications

In this Article Professor Brower argues that most observers of NAFTA's investment chapter have missed an important and surprising development: Although the treaty's text shares a philosophical affinity with civil and political rights, its application has revealed an astonishing level of support for economic and social rights (ESCRs) in North America. Professor Brower examines the practical implications of this development both for the presentation of claims in investor-state arbitration and for the better integration of ESCRs into the mainstream of international law.

The Virtual Case Study: Using Computer-Mediated Communication In Group Problem Solving, Kristen Lucas Jan 2003

The Virtual Case Study: Using Computer-Mediated Communication In Group Problem Solving, Kristen Lucas

Department of Communication Studies: Faculty Publications

In today’s technologically advanced business world, organizations are increasingly relying on computer-mediated communication (CMC) in their day-to-day operations. Employees are teleworking instead of commuting to the office, business travel is being replaced by videoconferencing, and problem-solving sessions are moving from conference rooms to computer monitors. This major shift in how business is conducted in the “real world” poses a new set of challenges for effective group communication—challenges for which communication instructors should prepare their students. This activity offers one way in which communication instructors can address the challenges of CMC and achieve the goals of CMC education identified by Witmer …

A Theology Of Ministerial Practice, Paul Kelm Jan 2003

A Theology Of Ministerial Practice, Paul Kelm

Doctor of Ministry Major Applied Project

Competing agendas and changing culture create a need for churches to consciously determine why they will do what they do the way they do.

This project develops four doctrinal bases for a theology of ministerial practice. It summarizes literature on philosophy of ministry. Research in five Lutheran churches identifies gaps in the way people view ministry. Chapter four provides a comprehensive rationale and definition for a theology of ministerial practice.

One church's experience demonstrates the value of thinking through and developing "guiding principles" that apply a church's theology to its culture in shaping ministerial practice.

Mongrel Modernism: Hayashi Fumiko's Horoki And Mass Culture, William O. Gardner Jan 2003

Mongrel Modernism: Hayashi Fumiko's Horoki And Mass Culture, William O. Gardner

Japanese Faculty Works

This article examines Hayashi Fumiko's novel "Hōrōki" (Diary of a vagabond) as a personal and historical narrative of Japanese modernity. Arguing for an acknowledgment of "Hōrōki" as a modernist work, it analyzes how Hayashi positions her work with regard to the developing idea of mass culture. Through a consideration of the early mass cultural forms recorded in Hayashi's narrative, it shows how gender and regional identity contribute to the formation of a mass subject who retains the prospect of critical agency.

The Center Will Hold: Critical Perspectives On Writing Center Scholarship, Michael A. Pemberton, Joyce Kinkead

All USU Press Publications

In The Center Will Hold, Pemberton and Kinkead have compiled a major volume of essays on the signal issues of scholarship that have established the writing center field and that the field must successfully address in the coming decade. The new century opens with new institutional, demographic, and financial challenges, and writing centers, in order to hold and extend their contribution to research, teaching, and service, must continuously engage those challenges. Appropriately, the editors offer the work of Muriel Harris as a key pivot point in the emergence of writing centers as sites of pedagogy and research. The volume develops …

The Star Quilt: A Symbol Of Lakota History And Worldviews, Bonnie Lou Mcjennett Jan 2003

The Star Quilt: A Symbol Of Lakota History And Worldviews, Bonnie Lou Mcjennett

Theses Digitization Project

When the United States government and troops attempted to destroy the Lakota culture by killing the buffalo, placing the Lakota on reservation, and forcing the Lakota to adopt European-Aemrican attitudes and behaviors, Lakota women preserved elements of their culture by symbolically sewing Lakota history and worldviews into the Star Quilt.
