What Is The Rule Of Law? Perspectives From Central Europoe And The American Academy, Louis E. Wolcher May 2003

What Is The Rule Of Law? Perspectives From Central Europoe And The American Academy, Louis E. Wolcher

Washington Law Review

The title of my talk is "What is the Rule of Law?"—and its subtitle is "Perspectives from Central Europe and the American Academy." I represent the "American Academy" part, and as I will make clear in a little while, the other part comes from my sustained engagement, over the past ten years, with legal theorists and political philosophers in the Republic of Slovenia. Slovenia, by the way, is a nation that was created twelve years ago as the northernmost of those "breakaway" republics of the former Yugoslavia.

Factors That Influence The College Attendance Decisions Of Appalachian Students, Erica Chenoweth May 2003

Factors That Influence The College Attendance Decisions Of Appalachian Students, Erica Chenoweth

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The current study sought to examine the factors that influence the decisions of Appalachian high school students regarding college attendance. Using Bronfenbrenner's ecological systems theory of human development (1986) as a theoretical basis, direct and indirect influences of environmental factors upon the academic aspirations of Appalachian youth were examined using survey methodology. Results indicated that predictors of college attendance for Appalachian students are not significantly different from those of students elsewhere. Variables reflective of individual academic preparation were most salient in predicting college aspirations for both males and females. Other important predictors included parent education, parent occupation, and socioeconomic status. …

Why The Bar Needs Academics - And Vice Versa, Fred C. Zacharias May 2003

Why The Bar Needs Academics - And Vice Versa, Fred C. Zacharias

San Diego Law Review

This Article argues that practicing attorneys have a need for academics to bring the their legal approaches back to a sense of reality. The author makes this argument by giving three examples of personal experience at a recent symposium sponsored by the University of Arizona College of Law, entitled "The Future Structure and Regulation of Law Practice." The author claims that sometimes practitioners are blinded by their own traditions and refused to consider new and better approaches. Academics who have less at stake in existing traditions are more willing to consider new solutions.

Charting New Courses For Alaska Salmon Fisheries: The Legal Waters, Paula Cullenberg, Mary Killorin Apr 2003

Charting New Courses For Alaska Salmon Fisheries: The Legal Waters, Paula Cullenberg, Mary Killorin

ISER Reports

Alaska’s commercial salmon industry is in an economic crisis. Competition from farmed salmon, changes in consumer demand, and a worldwide economic slowdown—together with smaller sockeye salmon runs—are reducing the value of Alaska’s salmon harvest. This crisis has prompted discussions among fishermen, processors, fishery managers, and government officials about how to help the salmon industry. Part of the discussion has focused on options for “restructuring” the management of salmon fisheries to reduce costs, increase value, or steer more of the benefits to Alaskans and their communities. To help Alaskans better understand the legal and constitutional issues associated with restructuring the salmon …

To understand the flaws of the ABA accreditation process, this article will overview the experience of Barry University School of Law (Barry) with ABA accreditation. Section II will discuss the development and structure of the ABA. Section III will argue that the ABA’s delegation of authority to an internal advisory body to render accreditation decisions, which bind the ABA, is an ultra vires act forbidden both by the laws of its state of incorporation and by the ABA Constitution. Section IV will then discuss the ABA accreditation process as applied to Barry. In Section V, this article will address federal …
