The Revival Of "Privileges Or Immunities" And The Controversy Over State Bar Admission Requirements: The Makings Of A Future Constitutional Dilemma?, Wilson Pasley Apr 2003

The Revival Of "Privileges Or Immunities" And The Controversy Over State Bar Admission Requirements: The Makings Of A Future Constitutional Dilemma?, Wilson Pasley

William & Mary Bill of Rights Journal

The Supreme Court's 1999 decision in Saenz v. Roe relied upon the long ignored Privileges or Immunities Clause of the Fourteenth Amendment, which had laid dormant since the Slaughter-House Cases of more than a century ago. The Saenz decision sparked considerable debate as to the meaning of the Privileges or Immunities Clause and caused speculation as to the statutes vulnerable to a constitutional challenge under the Clause. This Note examines the potential impact of the Privileges or Immunities Clause on state bar admission requirements and other restrictions on the practice of law. It concludes that the Clause does not create …

Restitution's Outlaws, Andrew Kull Apr 2003

Restitution's Outlaws, Andrew Kull

Chicago-Kent Law Review

The usual assertion that "restitution is not punitive" is true in the important sense that liability in restitution does not exceed the defendant's enrichment: enhanced or exemplary liability is foreign to this area of the law. On the other hand, restitution incorporates an unmistakably punitive aspect that is given effect in a different fashion: not by enhancing the liability of a disfavored defendant, but by denying relief to a disfavored claimant. The traditional explanation of such outcomes (by recitation of English and Latin maxims) has tended to obscure the extent and the consistency of the law's punitive response.

First Options, Consent To Arbitration, And The Demise Of Separability: Restoring Access To Justice For Contracts With Arbitration Provisions, Richard C. Reuben Apr 2003

First Options, Consent To Arbitration, And The Demise Of Separability: Restoring Access To Justice For Contracts With Arbitration Provisions, Richard C. Reuben

Faculty Publications

This article describes the context and current state of the law in this area under the Federal Arbitration Act (FAA), urges the Court to continue its path toward actual consent to arbitration, and suggests an approach for finally reconciling the tension between Prima Paint and First Options. Part II describes the nature and historical context of the arbitrability problem. Part III focuses specifically on the doctrine of separability, which is the most critical (and most complex) of these exceptions. Part IV discusses the impact on separability of recent U.S. Supreme Court case law, especially the 1995 decision in First Options …

Cobweb Adjustment And The Market For New Lawyers, Patrick W. Spangler '03 Apr 2003

Cobweb Adjustment And The Market For New Lawyers, Patrick W. Spangler '03

The Park Place Economist

This paper will investigate whether or not the law school enrollment trends reflect economically responsive supply behavior according to factors such as salary and other market indicators. Specifically, this paper will determine whether or not the supply trends of law students reflect “cobweb-like” labor market adjustments due to the time lag associated with entering the labor market. The second section will review the relevant literature and provide a theoretical framework in which to analyze enrollment trends. In the third section, the empirical model will be discussed and an explanation of the data will be given. The fourth section will provide …

What Gets Judges In Trouble, Richard H. Underwood Apr 2003

What Gets Judges In Trouble, Richard H. Underwood

Law Faculty Scholarly Articles

I wrote this article to collect some cautionary material about “what gets judges in trouble.” I wanted something I could offer to our state judges, practitioners, and my legal ethics students. While I have never been a judge, and while I have never worked for a judicial conduct organization, I have been a law professor for almost twenty-five years and the chairman of a state bar association ethics committee for fourteen. I am not the kind of person who would refrain from holding forth just because I may not know what I am talking about.

When I started out, I …
