Against Principled Antitrust, Edward T. Swaine Jan 2003

Against Principled Antitrust, Edward T. Swaine

GW Law Faculty Publications & Other Works

Competition policy is on the WTO agenda for the Doha Round, but it is unlikely that it will result in any substantive international standards; the goal, instead, seems to be to agree on core principles to guide the development of national law, including transparency, non-discrimination, and procedural fairness, perhaps extending to special and differential treatment for developing countries. While there is much to commend these principles, this paper takes a deliberately contrarian view, arguing that core principles are not at all where WTO competition policy should begin. It further disputes the appropriateness of applying an emerging meta-principle of the WTO …

Model For Clinical Education In Athletic Training, Jeff G. Seegmiller Jan 2003

Model For Clinical Education In Athletic Training, Jeff G. Seegmiller

Internet Journal of Allied Health Sciences and Practice

Clinical education is an intrinsic part of most allied health educational programs. However, conceptual models differ as to what constitutes quality for clinical experiences. As a relatively new allied health care field, athletic training education is adapting in order to meet the needs of a changing health care environment. Recent initiatives for clinical education mark the change from a quantitative (hours of exposure) approach, to one emphasizing quality (mastery over time). However, in this transition from field-based to curriculum emphasis, the coherence between different aspects of the educational process have weakened. This paper presents a background of clinical education in …

Thinking Race, Making Nation (Reviewing Glenn C. Loury, The Anatomy Of Racial Inequality), Christopher A. Bracey Jan 2003

Thinking Race, Making Nation (Reviewing Glenn C. Loury, The Anatomy Of Racial Inequality), Christopher A. Bracey

GW Law Faculty Publications & Other Works

We live in a race-conscious culture. As Americans, we are a nation of people who self-consciously chose to adopt a vision of society that embraced lofty ideals of individual freedom and democracy for all along with powerful mechanisms for devastating racial oppression. Our history is replete with instances of differential treatment on account of race - slavery being only the most egregious example - that achieved the desired effect of generating remarkable disparities in socioeconomic well-being among individuals and between different racial groups. Such disparities are not simply historical artifacts. They are facts of the contemporary American racial landscape as …

More Statistics, Less Persuasion: A Cultural Theory Of Gun-Risk Perceptions, Donald Braman, Dan M. Kahan Jan 2003

More Statistics, Less Persuasion: A Cultural Theory Of Gun-Risk Perceptions, Donald Braman, Dan M. Kahan

GW Law Faculty Publications & Other Works

What motivates individuals to support or oppose the legal regulation of guns? What sorts of evidence or arguments are likely to promote a resolution of the gun control debate? Using the survey methods associated with the cultural theory of risk, we demonstrate that individuals' positions on gun control derive from their cultural world views: individuals of an egalitarian or solidaristic orientation tend to support gun control, those of a hierarchical or individualist orientation to oppose it. Indeed, cultural orientations so defined are stronger predictors of individuals' positions than is any other fact about them, including whether they are male or …

Three Generations Of Participation Rights Before The European Commission, Francesca Bignami Jan 2003

Three Generations Of Participation Rights Before The European Commission, Francesca Bignami

GW Law Faculty Publications & Other Works

This article offers a conceptual framework for analyzing the development of participation rights before the executive branch of the European Community - the European Commission. Process rights before the Commission can be divided into three categories, each of which is associated with a distinct phase in Community history and a particular set of institutional actors. The first set of rights, the right to be heard when the Commission inflicts sanctions or other forms of hardship in individual proceedings, emerged in the 1970s in competition law. This phase was driven by the Court f Justice, influenced by the English administrative law …

Chronic Ethanol Consumption Inhibits Multiple Apoptotic Pathways In The Rat Pancreatic Acinar Cell, Franco Fortunato Jan 2003

Chronic Ethanol Consumption Inhibits Multiple Apoptotic Pathways In The Rat Pancreatic Acinar Cell, Franco Fortunato

University of Kentucky Doctoral Dissertations

Multiple lines of experimental evidence demonstrate that chronic alcoholconsumption causes mitochondrial injury, as well as acinar cell oxidative and metabolicstress. Alcoholics are more susceptible to acute and chronic pancreatitis. Despite alcoholrelatedacinar cell injury, apoptosis, or programmed cell death, appears to be reduced inacinar cells rather than increased, as is seen in the liver. This work describes the possible mechanisms through which alcohol affects theacinar cell apoptosis pathways in the rat pancreas. Two apoptotic pathways wereinvestigated: (1) receptor-mediated apoptosis via Fas/FasL and caspase-8, and (2)mitochondrial-mediated apoptosis via Bcl-2/Bax and caspase-9. Both pathways canactivate the final apoptosis executer caspase-3. Using the Lieber-DeCarli alcohol/controldiet, …

Ecological Implications Of Bovine Tuberculosis In African Buffalo Herds, A. Caron, P. C. Cross, Johan T. Du Toit

Wildland Resources Faculty Publications

Following the recent invasion of bovine tuberculosis (BTB) into the Kruger National Park, South Africa, we conducted a study on the maintenance host, African buffalo, to investigate associations between BTB prevalence and calf:cow ratio, age structure, body condition, and endoparasite load. Statistical analyses compared herds of zero, medium (1–40%), and high (>40%) BTB prevalence. To control for ecological variation across the park we collected data in northern, central, and southern regions and restricted some analyses to particular regions of the park. Body condition declined over the course of the 2001 dry season, and buffaloes in the southern region of …

Recognizing Toxic Species In Aquatic Habitats: A Potential Concern In Lake Management, Mikolaj Kokocinski, Harold G. Marshall Jan 2003

Recognizing Toxic Species In Aquatic Habitats: A Potential Concern In Lake Management, Mikolaj Kokocinski, Harold G. Marshall

Biological Sciences Faculty Publications

The importance of distinguishing toxic and non-toxic algal species is becoming a more common problem for management decisions associated with various freshwater and estuarine habitats. An example is given where two dinoflagellates, originally unidentified as closely resembling the toxin producing Pfiesteria spp., have been compared to these species. In order to clarify any relationship to Pfiesteria spp., scanning electron microscopy was used to determine the plate tabulation patterns of these dinoflagellates and make comparisons to the tabulation present in Pfiesteria spp. The results indicated significant differences in the plate tabulations of these taxa to distinguish them from Pfiesteria …

Coping And Social Support For Parents Of Children With Autism, Edith H. Luther Jan 2003

Coping And Social Support For Parents Of Children With Autism, Edith H. Luther

Master's Projects

The increased incidence of autism in children impacts families, educators, and health professionals. A descriptive survey design was used to obtain responses from parents of autistic children in public schools. Data collection instruments included The Social Support Index, SSI (McCubbin, Patterson, and Glynn, 1982), and The Family Crisis Oriented Personal Evaluation Scale, F-COPES (McCubbin, Olson, and Larsen, 1981 ). The majority of parents of autistic children perceived that they had support within their families and communities. One half of the families identified serious stressors in addition to autism. Acquiring social support and reframing were the coping strategies used most frequently. …

Transracial Adoption: Families Identify Issues And Needed Support Services, Shirley Simon, Maria Vidal De Haymes

Social Work: School of Social Work Faculty Publications and Other Works

The gap between the number of children of color in care and the recruitment of minority foster and adoptive homes has triggered growing support for transracial adoption, culminating in the Multi-Ethnic Placement Act (MEPA) and the Interethnic Adoption Provisions (IEP) legislation. Although MEPA and IEP focus on eliminating barriers to transracial placements, tbey do not address support for families that cboose to adopt transracially Alack of professional literature exists in this area. This study explores a number of trans-racial placements and adoptions, with the goal of identifying, from the perspective of the families interviewed, potential services that would enhance such …

The Internet and digital technology create new possibilities for the development of cultures, communities and knowledge. Over the last twenty years there has been a great increase in interest inindigenous knowledge from a variety of groups, including academia, development agencies and thecorporate world. Within this diverse range of interests, there have been initiatives to facilitate a globalnetwork to exchange indigenous knowledge by development agencies such as the World Bank's'Indigneous Knowledge for Development Program' and UNESCO's 'Best Practices of IndigenousKnowledge' database. The development agencies appear to be mainly concerned with systematizingindigenous knowledge and looking at the notion of indigenous knowledge as forming …

Spousal Abuse: Vietnamese Children’S Reports Of Parental Violence, Yoko Baba, Susan B. Murray

Faculty Publications, Sociology

This exploratory study used mailed questionnaires completed by 131 Vietnamese students to examine domestic violence patterns in parents' marital relationships. Research objectives included: (1) gaining an understanding of spousal abuse among Vietnamese couples; and (2) assessing which variables (demographic characteristics, decision-making power, and cultural adaptation, beliefs in traditional gender roles, and conflicts in the family) are correlated with spousal abuse. Findings suggest that although both parents used reasoning, mental abuse and physical abuse in their marital relationships, Vietnamese fathers were more likely to be physically abusive than mothers. Additional variables associated with family conflicts are also examined. Research implications and …

New methodologies have been developed for the determination of arsenic and selenium species in a variety of environmentally important matrices. A simple liquid chromatographic separation technique based upon mini-column technology was developed to obtain a simultaneous, fast, efficient and reliable separation of relatively toxic from relatively non-toxic arsenic and selenium species. The relatively toxic arsenic and selenium species studied were inorganic Asv, AsIII, SeVI and SeIV. The relatively non-toxic species of arsenic and selenium studied were AsBet, DMA and Se Met. Optimum conditions were found to be the use of a Hamilton PRP X100 12-20 µm anion-exchange resin with column …

Characterisation Of Nitric Oxide Synthase Activity In The Sea Anemone Aiptasia Pallida And An Evaluation Of Responses To Environmental Stress, Clare Emma Morrall Jan 2003

Characterisation Of Nitric Oxide Synthase Activity In The Sea Anemone Aiptasia Pallida And An Evaluation Of Responses To Environmental Stress, Clare Emma Morrall

School of Geography, Earth and Environmental Sciences Theses

Studies were undertaken to investigate the presence of nitric oxide synthase (NOS; E.C. 1.14.13.39) activity in number of cnidarian species from shallow marine subtropical environments. Enzyme activity was assayed by measuring the conversion of 3H L-arginine to 3H L-citrulline (the citrulline assay). This assay was shown to be sufficiently sensitive for studies of this nature but was not optimised for use with cnidarian preparations. As a result, confidence in the accuracy of the generated assay results is limited. NOS activity was nevertheless demonstrated in the sea anemone A. pallida, in the zooxanthellae associated with A. pallida, Symbiodinium spp. and in …

Implementing A Fundamental Movement Skill Program In An Early Childhood Setting: The Teachers’ Perspectives, Marie Martin, Beth P. Hands

Health Sciences Papers and Journal Articles

The place of explicit movement skill development programs in early childhood settings is contentious. However given the growing understanding that movement competence is important for maintaining an active and healthy lifestyle (Hands, Parker, & Larkin, 2001), well planned and effective programs specifically designed for young children are important.

In this paper, the influence of a new teaching resource designed to support teachers in implementing a fundamental movement skill program is presented using a case study approach. The case studies were constructed with teachers working in a range of early childhood settings. The impact of the program on teachers’ level of …

Accountability In The Aftermath Of Rwanda's Genocide, Jason Strain, Elizabeth Keyes Jan 2003

Accountability In The Aftermath Of Rwanda's Genocide, Jason Strain, Elizabeth Keyes

All Faculty Scholarship

Over the span of 100 days in 1994, almost one million Rwandans died in a genocide that left Rwandan society traumatized and its institutions in disarray. The genocide implicated not only the actual instigators and killers, who came from all levels of Rwandan society, but also the culture of impunity that had thrived in Rwanda for decades. This culture of impunity and inaction in the face of atrocities eerily mirrored the international community's failure to intervene to prevent or respond to the genocide. The genocide provoked a process of reflection within Rwanda and the broader international community about how the …

Engaging With The State: The Growing Reliance On Lawyers And Judges To Protect Battered Women, Jane C. Murphy Jan 2003

Engaging With The State: The Growing Reliance On Lawyers And Judges To Protect Battered Women, Jane C. Murphy

All Faculty Scholarship

The passage of the federal Violence Against Women Act of 2000 (“VAWA II”) marked an important milestone in the evolution of the domestic violence movement. VAWA II created, among other things, a complex system for state and federal funding in all fifty states to provide civil legal assistance to battered women. Its passage completed a process that began in the early 1980s when domestic violence advocates shifted their focus from grass roots efforts to help battered women and their children leave abusive partners to building alliances with government and advocating for legal remedies to assist battered women. This paper looks …
