The purpose of this study was to investigate the effects of music paired with story book reading on young children's comprehension of narrative text. More specifically, children's abilities to verbally retell stories, answer questions regarding explicit text based story facts, and attention levels were compared when stories were orally read or presented through audio-recorded sung versions of each story. Thirty kindergarten and first grade students who exhibited a speech and/or language impairment, had a history of a speech and/or language impairment, or were at-risk for reading difficulties participated in the study. Subjects were identified through a local university speech and …

A Question Of Sanity: Women And In/Sanity In Bessie Head’S A Question Of Power And Sylvia Plath’S The Bell Jar, Amanda Lynn Graeber Jan 2003

A Question Of Sanity: Women And In/Sanity In Bessie Head’S A Question Of Power And Sylvia Plath’S The Bell Jar, Amanda Lynn Graeber

Dissertations and Theses @ UNI

The use of female mental illness in fiction has previously been characterized as a subversive act. Theorists such as Juliet Mitchell, Susan Gubar, and Sandra Gilbert have advocated the use of madness as a way of protesting patriarchal systems and language. Female madness in many cases has been viewed not only as a conscious choice, but as an option that is preferable to sanity. In their view, mental illness is an embodiment of a woman's rejection of the patriarchal order. I would suggest that mental illness is actually about powerlessness. The madwoman is placed in a space outside of normal …

Interaction Of Disparity And Accommodative Vergence, Michele Liu Kung Jan 2003

Interaction Of Disparity And Accommodative Vergence, Michele Liu Kung

Theses

To fixate on a target that moves from far to near, changes in blur and disparity activate accommodation and disparity vergence. The goal of this study was to experimentally obtain eye movement data from four subjects, and analyze this data using through a new signal processing algorithm known as independent component analysis (ICA). Preliminary data suggest that three underlying neural subcomponents are present where the two components of disparity vergence initiate the movement and the accommodative portion is activated to facilitate the steady state portion of the response.

ICA was used as a blind source separation technique to analyze experimental …

Facilitating Second Language Acquisition (Sla) Through Computer-Mediated Communication (Cmc) In An English For Civil Engineering (Ece) Environment, Masputeriah Hamzah

Theses: Doctorates and Masters

This study explores the application of computer-mediated communication (CMC) in an English for Civil Engineering (ECE) learning setting. The aim is to examine the interactional opportunities present in the computer-mediated environment for evidence of conditions deemed facilitative of second language acquisition, based on the tenets prescribed by the Interaction Hypothesis. This theory emphasizes the importance of interaction in language learning and the necessity for learners to have access to meaningful and comprehensible input. It is based on the premise that acquisition will occur through interaction where learners arc provided opportunities to negotiate meaning in order to develop mutual understanding. In …

Automatic Human Face Detection In Color Images, Son Lam Phung Jan 2003

Automatic Human Face Detection In Color Images, Son Lam Phung

Theses: Doctorates and Masters

Automatic human face detection in digital image has been an active area of research over the past decade. Among its numerous applications, face detection plays a key role in face recognition system for biometric personal identification, face tracking for intelligent human computer interface (HCI), and face segmentation for object-based video coding. Despite significant progress in the field in recent years, detecting human faces in unconstrained and complex images remains a challenging problem in computer vision. An automatic system that possesses a similar capability as the human vision system in detecting faces is still a far-reaching goal. This thesis focuses on …

Internet Pharmacies And The Need For A New Federalism: Protecting Consumers While Increasing Access To Prescription Drugs, Linda C. Fentiman Jan 2003

Internet Pharmacies And The Need For A New Federalism: Protecting Consumers While Increasing Access To Prescription Drugs, Linda C. Fentiman

Elisabeth Haub School of Law Faculty Publications

In this article I will argue that Internet pharmacies pose a significant public health problem, as they raise the classic eternal triangle of health care issues--access, quality, and financing--in a new technological context. Part II describes the phenomena of Internet pharmacies, and Part III reviews the present regulatory scheme. Part IV explains why the current legal framework is inadequate to address the public health and safety problems posed by Internet pharmacies, focusing particularly on the jurisdictional, constitutional, and practical obstacles to effective state oversight of Internet pharmacies. Part V argues that comprehensive federal oversight of Internet prescribing and dispensing is …

Enforcing Environmental Norms: Diplomatic And Judicial Approaches, Nicholas A. Robinson Jan 2003

Enforcing Environmental Norms: Diplomatic And Judicial Approaches, Nicholas A. Robinson

Elisabeth Haub School of Law Faculty Publications

Environmental norms are observed because they are norms about how people respect each other and the natural systems that sustain human communities. Environmental norms are basic to human well-being. They arise out of the human condition, not unlike human rights laws. Environmental norms emerge from the fact that humans exist within ecosystems, and human society is embedded in the natural systems in which they have evolved; environmental norms are grounded in an objective reality, and scientists can measure the consequences of observing--or failing to observe--those norms. The provisions of environmental norms, therefore, exist not merely as pronouncements of governments, applied …

Specific Relief For Ancient Deprivations Of Property, Shelby D. Green Jan 2003

Specific Relief For Ancient Deprivations Of Property, Shelby D. Green

Elisabeth Haub School of Law Faculty Publications

I consider in this paper the extent to which courts rationally and on a principled basis can deny to aboriginal claimants, despite the ancientness of their claims, the specific relief of being restored to possession of their aboriginal lands where the case for such specific relief is otherwise made. The paper begins with a brief discussion of the foundations of property in the Western conception, then goes on to discuss the Europeans' asserted title to indigenous lands and the various theories of aboriginal title that have emerged. It then explores the past and existing legal obstacles to the judicial resolution …

Dying Twice: Incarceration On Death Row, Michael B. Mushlin Jan 2003

Dying Twice: Incarceration On Death Row, Michael B. Mushlin

Elisabeth Haub School of Law Faculty Publications

Dying Twice is an important report. The work is a collaboration between the Corrections Committee of the Association of the Bar of the City of New York, which I chaired, and the Committee on Capital Punishment of the Association chaired by Norman Greene. The working group that researched and wrote the report was drawn from members of both committees. The attorneys and the physician who served on the committee are wonderful, talented, dedicated people. It was a pleasure to work with professionals of this caliber on such an important effort. Dying Twice was endorsed as the position of the Association …

Two Sides Of A "Sargasso Sea": Successive Prosecution For The "Same Offence" In The United States And The United Kingdom, Lissa Griffin Jan 2003

Two Sides Of A "Sargasso Sea": Successive Prosecution For The "Same Offence" In The United States And The United Kingdom, Lissa Griffin

Elisabeth Haub School of Law Faculty Publications

This article analyzes the U. S. constitutional law interpreting the concept of “same offence.” Included is a survey of the Supreme Court's attempts to interpret constitutional text in order to provide adequate protection for the underlying double jeopardy interest against vexatious reprosecutions, which have frequently produced inconsistent and illogical results. Part III of this article analyzes U.K. law relating to the concept of “same offence,” where the same narrow double jeopardy protection adopted by the U.S. Supreme Court is supplemented with a broad discretion to prevent unfair successive prosecution that constitutes an abuse of process. Part IV draws lessons from …

Back To The Future: Does Apprendi Bar A Legislature's Power To Shift The Burden Of Proof Away From The Prosecution By Labeling An Element Of A Traditional Crime As An Affirmative Defense?, Leslie Yalof Garfield Jan 2003

Back To The Future: Does Apprendi Bar A Legislature's Power To Shift The Burden Of Proof Away From The Prosecution By Labeling An Element Of A Traditional Crime As An Affirmative Defense?, Leslie Yalof Garfield

Elisabeth Haub School of Law Faculty Publications

This Article considers whether it would be sound to extend the Apprendi rule to affirmative defenses. Part II of this Article considers the historical foundation of the Due Process Clause and the evolution of the assignment of the burden of proof for affirmative defenses and sentencing factors. Part II also reviews Mullaney and its progeny through the most current case, Apprendi. Part III discusses the Court's model for determining which categories of statutory language constitute elements requiring proof beyond a reasonable doubt and which are "nonessential element[s] of an offense." Part IV evaluates whether it is appropriate to assign the …

Educating The Guess: Strategies, Concepts And Tools For The Fuzzy Front End Of Product Development, Antonie J. Jetter Jan 2003

Educating The Guess: Strategies, Concepts And Tools For The Fuzzy Front End Of Product Development, Antonie J. Jetter

Engineering and Technology Management Faculty Publications and Presentations

Many companies lack efficient management of the early phases of new product development (NPD) - the socalled fuzzy front end (FFE). Rather than on structured methods, decision makers rely on ?gut ?feel? or ?guessing?. In an attempt to ?educate the guess? this paper discusses the activities and challenges of the FFE, as well as strategies to manage them successfully. It then briefly presents traditional and recent approaches to front-end management support. Based on the identified strengths and weaknesses of existing front-end solutions, the framework of a new management support system for the FFE is presented. Conceptually, the system is based …

A Hydrogeological Approach To Transboundary Ground Water Resources And International Law, Gabriel Eckstein, Yoram Eckstein Jan 2003

A Hydrogeological Approach To Transboundary Ground Water Resources And International Law, Gabriel Eckstein, Yoram Eckstein

Faculty Scholarship

Ground water resources have long been the neglected stepchild of water law. While agreements focusing on transboundary rivers and lakes have been relatively common, there is a paucity of treaties and international norms squarely addressing shared ground water resources. As a result, the rules governing the use, management, and conservation of transboundary ground waters is unclear at best.

This dearth is, in large part, the result of a deficit of scientific understanding among legislators, policymakers, and the judiciary. This is evidenced in many international and domestic laws and policies that have little or no scientific underpinning. Accordingly, there is a …

More Pieces Of The Ceo Compensation Puzzle, Franklin G. Snyder Jan 2003

More Pieces Of The Ceo Compensation Puzzle, Franklin G. Snyder

Faculty Scholarship

No current issue in corporate governance is more hotly debated than the question, "Why are American CEOs paid such high salaries?" A recent and influential answer, dubbed the "managerial power" approach, has an appealing simplicity: CEOs so thoroughly control their firms' compensation-setting machinery that they simply pay themselves whatever they want, restrained only by the tenuous limits of their own avarice and the vague need to avoid public "outrage." As an explanation for a complex process, however, the simplistic managerial power approach is so flawed as to be nearly useless. The single most intriguing feature of CEO compensation for example, …

Under The Plastic: A Quantitative Look At Dvd Video Encoding And Its Impact On Video Modeling, Wu-Chi Feng, Jin Choi, Wu-Chang Feng, Jonathan Walpole

Computer Science Faculty Publications and Presentations

In this paper, we examine the DVD encoding process and the implications this process has video modeling and network traffic analysis. We have assembled a system that allows us to extract the video data from the DVDs as they were encoded for distribution. Analyzing the resulting video trace data, we describe how DVD encodings have evolved over time. In addition, our findings show that the underlying video content is fundamentally different than those produced by basic consumer video capture boards. We demonstrate how this affects current video modeling proposals and their affect on network traffic characterization. This research is based …

Reform Of Juvenile Criminal Justice: A Special Focus On The Effectiveness Of Correctional Treatment In Approved Schools, Phaik Kee Chong Jan 2003

Reform Of Juvenile Criminal Justice: A Special Focus On The Effectiveness Of Correctional Treatment In Approved Schools, Phaik Kee Chong

Student Works (2000-2009)

It is now an old adage that juvenile justice reform is no sport for the short-winded. Juvenile law reform is both an incomplete achievement and an ongoing process, where the more progressive and the regressive forces of the different professionals and citizen groups skirmish between soft-line and hard-line extremes, contesting the need for further legal checks and balances. The violence of some juvenile offenders in this country is arousmg growing concern. Concerns about the welfare of the young have too often been seen as in conflict with the aims of protecting the public, punishing offences and preventing offending. This confusion …

Un/Braiding Stories About Law, Sexuality And Morality, Margaret E. Montoya Jan 2003

Un/Braiding Stories About Law, Sexuality And Morality, Margaret E. Montoya

Faculty Scholarship

Traditional doctrine insists that we tame sexual desire by pretending that goodness and Godliness is defined by celibacy and abstinence, but the Church is simply wrong to insist that we accept a theology that negates and silences and suppresses a central part of our lives. To the extent that we believe in a life after death, many of us have won a chance at Heaven not by denying and suppressing our sexuality but by struggling to develop our capacity to experience joy through sexual desire and to honor the responsibility of not generating misery for ourselves and others through that …

The Supreme Court's Indian Law Decisions: Deviations From Constitutional Principles And The Crafting Of Judicial Smallpox Blankets, Gloria Valencia-Weber Jan 2003

The Supreme Court's Indian Law Decisions: Deviations From Constitutional Principles And The Crafting Of Judicial Smallpox Blankets, Gloria Valencia-Weber

Faculty Scholarship

The first section discusses sovereignty and the sources for foundational principles that pertain to the relationships among tribes, the states, and the federal government. The sources are the documented discourse and covenants of the constitutional evolution, the Articles of Confederation and Perpetual Union (Articles), and the Constitution of 1787 as they developed state jurisdiction related to Indian matters. Second, the paper discusses the colonial period and reality versus the fictions or myths of discovery and conquest. Third, the paper covers the conflict and unity in the pre-Revolutionary period. Fourth, the paper considers the Articles as the first U.S. model to …
