Newton V. Diamond: Measuring The Legitimacy Of Unauthorized Compositional Sampling— A Clue Illuminated And Obscured, Susan J. Latham

This article discusses how the district court in Newton v. Diamond could have provided the music industry with a path of reasonable determination via which the risk of infringement due to unauthorized digital sampling of a musical composition could be reasonably estimated and prudent licensing decisions made. At the very least, it illuminated a clue through its threshold determination of protectability. However, as the author explains, the court of appeals obscured that clue beneath a conundrum of de minimis use analysis, highlighting the need for courts to settle upon a clear and consistent standard for de minimis use analysis.

Let’s start with a simple analogy: if a person eats more than they need, they gain weight. That is: if our feed inputs (kilojoules in) are greater than our outputs (exercise — kilojoules out) then we will gain weight (kilojoules in storage).That’s our fat. The remodeling of connexin43-containing gap junctions (GJs), as defined by changes in size, distribution, or function, is a prominent feature of both the developing and diseased myocardium. During postnatal development of the mammalian ventricle, there is a progressive remodeling of GJs into intercalated disks. This change in GJ quantity and distribution is correlated with alterations in the velocity and anisotropy of impulse spread within differentiating myocardium. Orderly distribution of GJs is perturbed in many cardiac diseases, and reemergence of immature patterns of myocyte coupling may be a factor in the arrhythmogenic potential attending such pathologies. Feminist video does collectivity exceedingly well. Certainly other politicized cultural movements and individuals work through this method, and, of course, feminists also produce work in collaboration in film and other media (as Julia Lesage testifies above). However, I assert that there is a profound natural mechanics to women's work in video that makes the medium's method, theory, and theme the interactive and politicized subjectification of the female sex. Film and patriarchy share the project of women's objectification-they make victims. Video and feminism see women as complex, worthy selves-they produce subjects. Human breast cancer cell lines DC4, DB46, MCF-7, MDA-MD-435 were incubated with cytochrome c at 5 x 10-7M, 5 x 10 -6M and 5 x 10-5M. Human colon cancer cell line, RKO, and normal human lung fibroblast cell line, HFL1, were incubated with cytochrome c at 5.6 x 10-8M, 5.6 x 10-7M and 5.6 x 10-6M. Cytochrome c exposure showed a dose response including cell death in breast cancer cell lines. RKO showed no sensitivity to cytochrome c exposure at any of the concentrations and HFL1 showed sensitivity only at the highest concentration. FAD, NADH, Q10 and ATP were incubated …

The seven mammalian isotypes of beta tubulin are strikingly similar in amino acid sequence. The differences in isotypic sequence, although small, are nonetheless conserved in evolution, which suggests that they may confer distinct functional roles. If so, such roles should be reflected in the selective expression of isotypes by cell type, or even in the sorting of isotypes to within-cell pools. Hair cells of the vestibular sensory epithelia each possess a kinocilium, a microtubule-based organelle that could represent a distinct microtubule compartment, separate from the extensive microtubule network in the soma. There are seven isotypic forms of the microtubule protein beta tubulin in mammals, but not all isotypes are synthesized in every cell type. In the adult organ of Corti, each of the five major cell types synthesizes a different subset of isotypes. Inner hair cells synthesize only betaI and betaII tubulin, while outer hair cells make betaI and betaIV tubulin. Only betaII and betaIV tubulin are found in inner and outer pillar cells, while betaI, betaII, and betaIV tubulin are present in Deiters cells, and betaI, betaII and betaIII tubulin are found in organ of Corti dendrites. Withania somnifera (Ashwagandha) is a plant used in medicine from the time of Ayurveda, the ancient system of Indian medicine. The dried roots of the plant are used in the treatment of nervous and sexual disorders. From chemistry point of view, the drug contains group of biologically active constituents known as withanolides. The chemical structures of withanolides have been studied and they are widely distributed in family Solanacae. Withaferin- A is therapeutically active withanolide reported to be present in leaves. The present study was carried out to assess and document ethnobotanical knowledge of shrubs and trees of District Buner as the area has diverse flora and high ethnobotanical potential. It was found that 94 different plant species are used for medicinal, timber, fuel wood, fodder, ornamental, agricultural tools, Thatching, fencing, naming (folk lore) and fruit yielding purposes.
Bulk of plant species show multiple uses like Juglans regia wood is used for making furniture, gun woody parts, carving and as fuel. Root bark (Dandasa) is used for cleaning and sparkling teeth. Leaves are used by womenfolk for coloring lips (make-up). Nuts …

BACKGROUND: Platelets are thought to play a role in a variety of inflammatory conditions in the lung, some of which may lead to fibrosis. In the current study we tested the hypothesis that whole platelets and platelet lysate can mediate remodelling of extracellular matrix in vitro by affecting fibroblast-mediated contraction of a collagen gel. We also sought to determine to what extent platelet-derived growth factor (PDGF) and transforming growth factor-beta (TGF-beta) contribute to this effect.
METHODS: Washed platelets, isolated from healthy blood donors, and platelet lysate (freezing and thawing), were cast together with human lung fibroblasts in three-dimensional collagen gels. …

Senate Bill 297, which was enacted by the Kansas legislature in 2002 and which became effective on January 1, 2003, is a substantial adoption of the Uniform Trust Code (2000) (“UTC”). The Kansas UTC is codified in a new chapter, Kansas Statutes Annotated chapter 58a. The UTC is the Uniform Law Commissioners' first effort to provide the states with a comprehensive model for codifying their law on trusts.

Habitat standardization for billfish CPUE offers a potentially useful alternative to the statistical procedures used in the past. However, most of the assumptions of the current habitatstandardization methodology remain untested and some are not consistent with current knowledge about the behavior of billfish. This paper outlines research required to ensure the methods for habitat standardization produce robust estimates of CPUE.

The Japanese pelagic longline fishery, which has a broad temporal and spatial coverage in the Atlantic Ocean, provides an important time series used in assessments of istiophorid billfishes. Past assessments of Atlantic blue marlin and white marlin by the ICCAT SCRS indicate a pronounced decrease in stock abundance of both species over the past fifty years. The current biomass of the white marlin is estimated to be 15% of that necessary for maximum sustainable yield (BMSY), while blue marlin are estimated to be at 0.4 BMSY. A benthic assessment of the isolated Cayman Islands was completed at 42 sites. Major changes in the reef community structure were documented by comparison with earlier studies. Acropora palmata and A. cervicornis, once abundant as shallow framework builders, were uncommon. Diseased stony corals were seen in >90% of the study sites, with the highest averages in Little Cayman, especially at Bloody Bay which is one of the most highly regulated marine parks in the Cayman Islands. The Montastraea annularis species complex accounted for two-thirds of the diseased corals which, along with other massive species, were affected largely by white-plague …

Nancy C. Unger and J. Michael Butler take up the question of the targeting of Jews for elimination in the Holocaust. Was this emphasis a special case or part of a broader spectrum of elimination policies designed to rid Germany of all groups designated as undesirable by Nazi ideology— including homosexuals, Gypsies, and the mentally ill?
Unger argues for the specificity of the targeting of the Jewish population for extermination by comparing it to the case of homosexuals. Homosexual men were incarcerated in the death camps, and many were killed in the course of the Holocaust, but, Unger argues, their …

Long-Term Observations Of A Harbor Seal Haul-Out Site In A Protected Cove In Casco Bay, Gulf Of Maine, David Harris Phd, Barbarai Lelli, Sat Gupta

We counted the numbers of seals hauled out at low tide on two near-shore ledges in a protected cove in Casco Bay, Gulf of Maine a minimum of 12 times per month, for four years starting in August 1997. The highest mean monthly counts were in August (molting season) and the lowest in either January or February. Counts during pupping season (May and June) were lower than during April or July. As no mother-pup pairs were observed, these ledges are molting but not pupping ledges. Time-series analysis revealed no overall trend in the number of seals present. but did show …
