The tort of invasion of privacy has had a short but tortuous development made even more tortuous by a number of recent rulings by the United States Court of Appeals for the Ninth Circuit. This common law tort does not begin with the normal judicial iterations that created and sculpted other torts. Rather, it began life as a law review article prompted by personal pique.

It may be that there is no literate person alive in the Western world who has not heard of Count Lyof Nikolaevich Tolstoi (Tolstoy), author of what some have called the quintessential novel among all recorded literature: War and Peace. It may also be that most literate persons are aware that Tolstoy was a moralist of some renown-of great renown in his day-whose pacifist thought presaged and influenced Mohandas K. The maxim,' Innocent until proven guilty', has had a good run in the twentieth century. The United Nations incorporated the principle in its Declaration of Human Rights in 1948 under article eleven, section one. The maxim also found a place in the European Convention for the Protection of Human Rights in 1953 [as article 6, section 2] and was incorporated into the United Nations International Covenant on Civil and Political Rights [as article 14, section 2]. This was a satisfying development for Americans because there are few maxims that have a greater resonance in Anglo-American, common law jurisprudence. The Anglo-American …

How Great Are "Great Books For Girls?" : An Examination Of Gender Messages In Recommended Literature For Adolescent Girls, Sandi Caldrone

A number of booklists recommending novels that can help children expand their ideas of gender roles have been recently published, in part because of the recent attention paid to the drops in self-esteem and academic performance adolescent girls experience related to gender roles. I examined several of these booklists and a small sample of the novels they recommend. Although many of the recommended novels offered readers examples of nontraditional heroines, they also perpetuated gender bias to some degree. This article examines shifts in international law regarding the use of force -- the jus ad bellum -- that emerged in the wake of the September 11, 2001, terrorist attacks and subsequently were invoked in part by the United States and United Kingdom to justify military intervention in Iraq. These shifts import some elasticity -- in time, space, and place -- into the preexisting legal understanding of self-defense. To be sure, the general consensus that supported the use of force in Afghanistan as a legitimate exercise of self-defense has diluted as the use of that force expanded into other theaters …

The purpose of this paper is to refute Ms. Sarah Lively's article, the ABCs and NTBS of GMOs, detailing the reasons why the E.U. legislation is not in harmony with the WTO agreements. This paper will argue that if a WTO dispute settlement body were to decide upon the validity of the current European GMO regime, it would strike down the regulation as contrary to the WTO agreements signed by the European Union and the United States. The Protection Of Test And Other Data Required By Article 39.3 Of The Trips Agreement, G. Lee Skillington, Eric M. Solovy

This article provides a comprehensive analysis of the origins, purpose and scope of protection for test and other data required by TRIPS Article 39.3. Through this analysis, which looks to the ordinary meaning of the provision in proper context in the same manner as would a WTO dispute settlement panel or the WTO Appellate Body, we conclude that Article 39.3 provides protection against the unjust or unfair application or conversion of certain test and other data to make a profit or to obtain a benefit. Such protection must be provided long enough to allow the originator to at least recoup …

Enforcement Of Foreign Judgements, The First Amendment, And Internet Speech: Notes For The Next Yahoo! V. Licra, Molly S. Van Houweling

The Article begins with a review of the relevant rules governing enforcement of foreign judgments in the United States. Part II explains how courts have unpersuasively applied these rules when refusing to enforce foreign libel judgments. Part III then explains how the Yahoo! court adopted much of this faulty reasoning. Finally, Part IV explains the considerations that better justify judicial refusal to enforce speech-restrictive foreign judgments, especially those triggered by Internet speech. Credited with transforming North Korea into a green and livable people's land due to his environmental vision, Kim Il Sung often pointed out serious environmental degradation, such as air pollution in industrial cities, water pollution, and deforestation. Eventually, the leadership turned to laws for better implementation of environmental protection. Part I of this Note explores the history of LGB rights in Northern Ireland, focusing on the development of domestic equality legislation stemming from the recent peace process. Part II examines the statutory framework of this legislation, concentrating on what protections and rights it provides for sexual minorities in Northern Ireland. Part II also looks at a recent European Directive prohibiting discrimination against LGB persons in employment. Part III argues that for truly effective change to occur, LGB individuals need both policy-based and rights-based legislation encompassing the human rights principles of equality and non-discrimination. Growth rates of yellow-bellied marmot (Marmota flaviventris) populations over a 32-year period (1965 -1996) varied Significantly with sex, age, location, and year. Overall, males had higher growth rates than females and young and yearlings generally had higher growth rates compared to adults at all locations. The locations varied with respect to elevation and the relationship between elevation and growth rate was complex and likely weather dependent. Low rainfall in late summer was often associated with low growth rates at high elevations where the active season is constrained and delayed by late spring snowmelt compared to low elevations. Seasonal Body Temperature Fluctuations And Energetic Strategies In Free-Ranging Eastern Woodchucks, Carmen M. Salsbury

During a 2-year period, radiotelemetry was used to continuously monitor body temperature ( T b) of free-ranging woodchucks (Marmota monax) in southeastern Pennsylvania. Hibernation was preceded by daily T b fluctuations ("test drops") of 2-4°C. During hibernation, woodchucks exhibited the characteristic pattern of torpor bouts. Time of arousals occurred randomly, but onset of torpor occurred predominantly between 1800 and 0000 h. Males had shorter hibernation periods (mean of 104.8 days) than did females (121.8 days). Males had shorter torpor bouts, but euthermic bouts were the same length as in females. Males also maintained higher T b during torpor. Overall, the …

Examining The Evidence: Post-Verdict Interviews And The Jury System, Nicole B. Casarez

Although jury deliberations are kept secret, jurors sometimes speak out to the press after the conclusion of a trial about the rationale for their verdict, what pieces of evidence were important to their decision, and similar issues. Some argue that post-verdict juror interviews are harmful to the very foundation of the jury system, because they endanger defendants' fair trial rights, invade jurors' privacy, and distort public perception of jury verdicts. However, others, such as the author, consider these post-verdict interviews important, because they permit the public to gain a better understanding of the verdicts as well as the nature of …
