As the recent controversies surrounding alleged unattributed copying by historians Doris Kearns Goodwin and the late Stephen Ambrose illustrate, plagiarism is a concept that evokes both strong passions and genuine puzzlement. Because it is not, strictly speaking, a legal concept, plagiarism has mostly been ignored by legal commentators. In this article, Professor Green seeks to use criminal law concepts (such as intent, willful ignorance, consent, harm, and the distinction between mistake of law and mistake of fact) to elucidate the meaning of plagiarism; and the idea of plagiarism to explore the outer limits of theft law (particularly as it relates …

Although not the first to make the connection, Ensign Albert Niblack of the U.S. Navy wrote most succinctly in 1888: “There seems nothing unreasonable in tracing the origin of much of the dance and ceremonial paraphernalia to customs originating in war.” Since that time, numerous scholars have suggested and disputed links between Tlingit carved and painted armor and ceremonial regalia. Beaded regalia, on the other hand has been almost entirely neglected in Northwest Coast ethnographic literature due to notions of authenticity and cultural degeneration. At first sight, the question "Is Igbo an endangered language," would appear to be grossly misplaced, since the survival of the language seems to be well guaranteed by its status both as one of the three main languages of Nigeria and one of the major languages of literature, education, and commerce in Africa. Readers who encounter the Aeneid today often face an abridgement meant to fit the demands of a college literature survey: Troy, anderings, Dido, the Underworld-the exotic Odyssean Aeneid of the first six books. The poem's second half, if read at all, might offer only scenes from book 8 (etiology and shield), Nisus and Euryalus from book 9, sometimes Camilla in book 11, Turnus's death at the end of the poem. But since the first cut in such selections usually includes most of the warfare, Vergil's subtlety (and difficulty) can be misunderstood, especially if the poem's close is to be considered. …

This study of public reaction to the Battle of Gettysburg in the context of the wider experience of the American Civil War focuses on the view of Providence in history and war. To that end, this study primarily utilizes documents which were part of the public discourse during the war. This includes two major groups of writings: newspaper editorials and articles and published sermons. This allows a view of the intersecting of religion with the secular world as well as patriotism within in the religious community. Although the accident rate for military aviation has declined significantly from earlier decades, during the 1990's it reached a plateau. Human error in the cockpit still accounts for over 80% of the aircraft mishaps resulting in loss of life or over one million dollars in damage. Decision error has been a contributing factor for approximately 60% of these mishaps. The purpose of this research was to investigate aircrew process performance variables as predictors of decision-making outcomes. This thesis concerns Human Resource Management practices after the terrorist attacks on September 11th 2001. It is divided into three main sections. The first section describes expert opinions on various topics. Those topics include emergency procedures for handling Anthrax contamination and preventative mail handling procedures. Recommendations on plans of evacuation and emergency revival procedures are given along with information about implementing an effective security system. Employee Assistance Programs are discussed and harassment policies and diversity training issues are examined due to the unfortunate backlash against Muslim workers since to the attacks. A New Optimal Nonlinear Control Method And Its Application To Missile Guidance Law Design, Ming Xin, S. N. Balakrishnan

In this paper, a new nonlinear control synthesis technique (q-D approximation) is discussed. By adding perturbations to the cost function this approach achieves a suboptimal solution to the Hamilton-Jacobi- Bellman (HJB) equation. By manipulating the perturbation terms both asymptotic stability and optimality properties are obtained. An application to the design of missile guidance law is presented and is compared with a similar technique (State Dependent Riccati Equation technique) used in problems of this class. © 2002 by the author(s).

The tragic events of September 11th generated numerous proposals for greater security measures and increased police powers that might, if implemented, constrict the customary scope of free speech in the United States. Legitimate concerns for internal security have placed increased pressures on traditional constitutional protections for expressive activity. It is against this backdrop that this article presents a careful examination of the basic rationales for adopting constitutional level protections for free speech. The article analyzes the nature of, and many of the conflicts among, the traditional rationales for a constitutional right of free expression. It also suggests that much of …

Last year, the Federal Bureau of Investigation (“FBI”) acknowledged that it used an Internet electronic surveillance system called Carnivore to investigate and prosecute criminal suspects in more than two dozen cases. Carnivore is a software program developed by the FBI that can be installed on the network of an Internet Service Provider (“ISP”), such as America Online, to monitor, intercept and collect e-mail messages and other Internet activity made and received by individuals suspected of criminal activity. To date, the full capability of Carnivore remains a secret—the FBI refuses to disclose the source code (computer language) that would reveal how …

In the year 2000, the Government Advisory Committee (“GAC”) of the Internet Corporation for Assigned Names and Numbers (“ICANN”) passed a set of principles that essentially claimed national sovereignty over country code top-level domains (“ccTLD”s) such as .us, .ca, .uk and .au. Shortly thereafter, ICANN redelegated several ccTLDs in accordance with new GAC principles. Despite the outcry accompanying the passage of these principles and ICANN’s self-professed adherence thereto, the entire exercise could easily be criticized as merely symbolic because of the overriding power of ICANN in the operation of the Domain Name System (“DNS”). A new method for design and scale-up of thermocatalytic processes is disclosed. The method is based on optimizing process energetics by decoupling of the process energetics from the DRE for target contaminants. The technique is applicable to high temperature thermocatalytic reactor design and scale-up. The method is based on the implementation of polymeric and other low-pressure drop support for thermocatalytic media as well as the multifunctional catalytic media in conjunction with a novel rotating fluidized particle bed reactor.

It is well known that laser beams spread as they propagate through free space due to natural diffraction, and that there is additional spreading when optical waves propagate through atmospheric turbulence. Previous studies on Gaussian beams have mainly involved the lowest order mode (zero order). The study of higher order mode Gaussian beams has involved Hermite-Gaussian and Laguerre-Gaussian beams for rectangular and cylindrical geometry, respectively, These studies have developed expressions for the field and intensity in free space, in addition to developing new definitions of beam size in the receiver plane for the higher order modes. Multilevel converters have become increasingly popular due to high power quality, high-voltage capability, low switching losses, and low electromagnetic compatibility concerns. Considering these advantages, the multilevel converter is a suitable candidate for implementation of future naval ship propulsion systems. This paper focuses on modulation techniques for the multilevel converter. In particular, a novel voltage-source method of multilevel modulation is introduced and compared to existing methods. The proposed method is discrete in nature and can therefore be readily implemented on a digital signal processor. The method is also readily extendable to any number of voltage levels. Pursuit Evasion: The Herding Noncooperative Dynamic Game-The Stochastic Model, Pushkin Kachroo, Samy A. Shedied, H. Vanlandingham

This article proposes a solution to the herding problem, a class of pursuit evasion problem in a stochastic framework. The problem involves a "pursuer" agent trying to herd a stochastically moving "evader" agent into a pen. The problem is stated in terms of allowable sequential actions of the two agents. The solution is obtained by applying the principles of stochastic dynamic programming. Three algorithms for solution are presented with their accompanying results.
