The position argued in this Article is that women's rights are individual rights. To explain this position, the Article will progress along the following arguments: 1) The dichotomy between Western individualism and non-Western collectivism is false. 2) Much of the debate regarding the role of women and women's rights confuses interest and identity. 3) Women do not necessarily constitute a social group. 4) "Women's" rights are actually universal human rights: they pertain mostly to women, but also to men. 5) The debate about whether women are a social group is rooted in part in differing conceptions of women's embeddedness in …

Strong claims have been made as to the influence of Mande languages on the languages of the Atlantic Group. This paper analyzes Mande borrowings in one Atlantic language in order to understand the nature of that influence. The Atlantic language of focus is Kisi, a member of the Southern Branch, spoken primarily in Guinea. The Kisi people have separated from their closest relatives on the Atlantic Coast in historic times, probably due to the second Mande expansionist wave of the sixteenth century at the collapse of the Mali Empire. Battlefield Oddities: Explaining Two Minié Balls From Pea Ridge National Military Park, Don Arp Jr.

Two minié ball bullets, each with a different caliber and similar longitudinal lines were recovered at Pea Ridge National Military Park during the fieldwork conducted there in March 2001. Thefunction of these lines was unknown. Several hypotheses were advanced to explain the Irfarkings. However, through detailed mathematic and microscope analysis, it has been determined that the lines were made by the same process and machine and may have served as a point of attachment for an experimental cartridge made of either metal, cloth, or paper. The bullets may have been part of a pre-Civil War experiment and found action in …

Hunting and gathering along with horticultural societies provide a basis for understanding contemporary ideologies. Such groups are generally labeled as egalitarian societies from their status and treatment of females. A survey of traditional hunters-gatherers and horticultural societies compared their mythological charters on gender ideologies to the dally interactions of gender roles in order to determine their level of influence on the culture. Traditional societies are thought to be a basis to observe gender stratification among all known societies. Spanish officials in eastern Panama believed that Christianized Indians would serve as surrogates for Spanish settlers or troops, and their attempts to administer the region were grounded upon establishing alliances with selected Indian leaders. At the same time, pirates and other intruders also saw the need for alliances with Indian men in order for their endeavors to succeed. Through a process in which Europeans and Indians played an equal part, the early modern period saw the creation of several new indigenous leaders. Fit And Functional In Legal Ethics: Developing A Code Of Conduct For International Arbitration, Catherine A. Rogers

In this Article, the author develops a methodology for prescribing the normative content of a code of ethics for international arbitration, and in a forthcoming companion article, integrated mechanisms for making those norms both binding and enforceable are proposed. In making these proposals, the author rejects the classical conception of legal ethics as a purely deontological product derived from first principles. This Article argues, instead, that ethics derive from the inter-relational functional role of advocates in an adjudicatory system, and that ethical regulation must correlate with the structural operations of the system. Discusses the Native American view of Crater Lake, Oregon, as a place of religious significance and the misunderstandings with whites as to its importance to Oregon's Indian tribes. Created some 6,500 years ago by volcanic eruption, Crater Lake has long been seen by Indians as a sacred place. Their hunting, berry gathering, and vision quests in the lake area were tied to their religious view of the lake. Since the 1850's, whites have treated the lake with a lack of understanding of its significance to the Klamath tribes. The National Park Service restricted hunting and charged Indians fees to pass …

On November 13, 2001, President George W. Bush issued a Military Order in which he claimed power as Commander in Chief to detain indefinitely and to try, by ad hoc military commissions, persons designated by him as international terrorists. This Order represents a stunning claim to absolutist power and a rejection of any meaningful legal constraints on the treatment of the captives. The Order and the "War on Terrorism" on which it is premised challenge the most commonly accepted principles of post-Westphalian sovereignty: exclusive control over territory, noninterference, and equality among states.

This paper examines Delaware's judicial treatment of deal protection measures, particularly termination fee provisions. The paper explores the tension between the economic function of these provisions in inducing bidders and potentially compensating them for opportunity and transaction costs in the event of deal termination vs. the ability of large termination fees to constrain and coerce shareholder choice by obligating the target to pay out the fee in the event of a shareholder no vote.

When Hegel turns to a treatment of culture in Chapter VI of the Phenomenology—as anyone who has read his early writings would expect1—he begins with the ancient Greek polis. There the human spirit first fully emancipated itself from nature as it had not, in Hegel’s opinion, in Egypt; yet it was still in perfect harmony and balance with the natural. In Hegel’s view, this was an age of beaut y that produced a social community and an ethical life where citizens were free and at home. New technologies, new patterns of consumption and production, new levels of intensity, magnitude, and volatility in the movement of people, information, and capital are transforming the global political economy. Many effects of this transformation become manifest in the domain of public policy, where parties across the political spectrum have embraced the nee-liberal agenda. That agenda has been characterized, perhaps hyperbolically, as the 'hollowing out of the state': fac ilitation of transnational business activity; reduction of corporate and personal taxes and cuts in public expenditures, especially on social welfare; deregulation of domestic markets.
