A Theory Of The Laws Of War, Eric A. Posner

The laws of war govern the weapons and tactics that belligerents may use against each other. This paper uses a model of conflict to explain and evaluate the laws of war. In the model a nation’s propensity to engage in conflict is a positive function of the effectiveness of military technology, and a negative function of the destructiveness of technology. Accordingly, in theory nations would want to agree to laws of war that permit destructive weapons and tactics but limit their effectiveness. However, nations with different endowments and resources will enjoy differential advantages, and this makes agreement on specific laws …

Implications Of Democratic Republic Of The Congo V. Belgium On The Pinochet Precedent: A Setback For International Human Rights Litigation?, Sarah C. Rispin

Chicago Journal of International Law

This development will consider the impact of the Congo v. Belgium decision on the Pinochet precedent and the law on official immunity for serious international crimes. Part I will briefly review the legal bases for the Pinochet decision. Part II will lay out the legal bases of the majority opinion in Congo v. Belgium, and examine what of Pinochet survives that opinion. Part III will examine the main Congo v. Belgium concurrence and highlight its attempt to salvage the Pinochet precedent-an attempt which throws into relief the fact that Pinochet has, in fact, been undercut.

The signing in 1998 of the Noumea Agreement on the political future of New Caledonia was of great significance in conferring a limited form of nationhood on New Caledonia prior to a vote on independence in fifteen to twenty years' time. The agreement itself argues that the emergence of a " new sovereignty" requires affirmation of the formative place of Kanak identity and culture in the society. This requirement is particularly apparent within the European community, which has based its opposition to independence on a denigration of Kanak claims to an affirmative identity and peoplehood. As American operations against terrorism spread around the globe to places like Afghanistan and the Philippines, an increasing tendency has been for commentators to draw parallels with past experience in Vietnam. Even soldiers on the ground have begun to speak in such terms. The author analyzes the Army's response to that defeat in Southeast Asia and its long-term impact. Contrary to the accepted wisdom that nations which lose wars tend to learn best how to correct their mistakes, he argues that Americans tried to forget the unhappy experience with counterinsurgency by refocusing on conventional wars. The author cuts through the myriad interpretations surrounding the concept and gets back to the original idea as conceived by its author, the Prussian military theorist, Carl von Clausewitz. In going back to the original concept, Lieutenant Colonel Echevarria reveals that Clausewitz intended the center of gravity to function much as its counterpart in the mechanical sciences does, that is, as a focal point.
