An Evaluation Of Relationship Marketing And Customer Retention Practices In The Hotel Industry, Lisa Kenny Jan 2002

An Evaluation Of Relationship Marketing And Customer Retention Practices In The Hotel Industry, Lisa Kenny

Theses

Customer relationships have received considerable attention from both academics and practitioners. It is accepted that relationship marketing is keeping, not just getting customers, (Berry, 1983). However, it has been criticised that firms frequently focus on attracting customers (the “first act”) but then pay little attention to what they should do to keep them (the “second act”) (Berry and Parasuraman, 1991). It has been demonstrated that it is far less expensive to retain a customer than to acquire a new one. The increasing emphasis of relationship marketing is based on the assumptions that building committed customer relationships results in guest satisfaction, …

Ywca Family Literacy Program, Adam Severson Jan 2002

Ywca Family Literacy Program, Adam Severson

Graduate Research Papers

According to the federal government (2002), family literacy programs are defined as services provided to participants on a voluntary basis. The programs should be of sufficient energy in terms of hours and duration. Such programs should make lasting changes in a family that include the following activities: (a) interactive literacy activities between parents and children, (b) training for parents regarding how to teach their children and be a partner in education, (c) parent literacy training that leads to economic independence, and (d) an age-appropriate education to prepare children for success in school and life experiences.

The Family Literacy Program at …

Liberty, Equality, And Privacy: Choosing A Legal Foundation For Gay Rights, Richard A. Epstein Jan 2002

Liberty, Equality, And Privacy: Choosing A Legal Foundation For Gay Rights, Richard A. Epstein

Faculty Articles

These general ruminations play out in explicit fashion in connection with the question of whether equal protection or privacy is the appropriate framework in which to analyze the rights of gays and lesbians. Here, my first instinct is to bridle at the way the question is formulated because it seems better to ask what rights all individuals have under the Constitution just by virtue of being citizens of the United States or persons subject to its laws. I am much more comfortable with starting from general principles and reaching a specific conclusion about a given group, than I am with …

Preclusion, Due Process, And The Right To Opt Out Of Class Actions, Samuel Issacharoff Jan 2002

Preclusion, Due Process, And The Right To Opt Out Of Class Actions, Samuel Issacharoff

Faculty Articles

Among the current controversies in class action law is the question of when cases are properly classified as (b)(2) as opposed to (b)(3) class actions. Much rides on the distinction, particularly since the manageability requirement of Rule 23(b)(3) may frustrate the certifiability of claims. Even the classic forms of class actions, such as the employment discrimination disparate impact claim, may be caught up in these debates, as evident from the split between the Fifth Circuit in Allison and the Second Circuit in Robinson. This Article attempts to redirect the inquiry by focusing on the preclusive effect of class actions. The …

Classical Liberalism Meets The New Constitutional Order: A Comment On Mark Tushnet, Richard A. Epstein Jan 2002

Classical Liberalism Meets The New Constitutional Order: A Comment On Mark Tushnet, Richard A. Epstein

Faculty Articles

Mark Tushnet's provocative paper, State Action, Social Wefare Rights, and the Judicial Role: Some Comparative Observations offers a typology of judicial review that throws into high relief some of the key elements of any system of constitutional law. One key component of the mix is substantive: just what rights should, or does, a particular constitution protect? A second is structural: what payoff comes from assigning any particular level of constitutional protection to any particular right? The differences can matter. The United States Constitution simply invalidates the offending law. In contrast, the Canadian Charter of Rights and Freedoms provides that any …

Narrative Relevance, Imagined Juries, And A Supreme Court Inspired Agenda For Jury Research, Richard O. Lempert Jan 2002

Narrative Relevance, Imagined Juries, And A Supreme Court Inspired Agenda For Jury Research, Richard O. Lempert

Articles

This paper has its roots in Old Chief v. United States, a case the Supreme Court of the United States decided in 1997. I will begin by describing this case; then comment on its implications for the Supreme Court’s conception of the jury, and conclude by examining the agenda one may draw from it for empirical jury research. Old Chief arose when Johnny Lynn Old Chief was charged not only with assault with a dangerous weapon and using a firearm in the commission of a crime of violence, but also with violating a law that forbids convicted felons from possessing …

A Civil Discovery Dilemma For The Arizona Supreme Court, Carl W. Tobias Jan 2002

A Civil Discovery Dilemma For The Arizona Supreme Court, Carl W. Tobias

Law Faculty Publications

The drafters of the 1938 Federal Rules of Civil Procedure hoped to establish those rules as a model that the states could adopt, thus fostering national and intrastate procedural uniformity. This objective was not realized generally or by very many specific jurisdictions. Observers of the increasingly fractured procedural regime in the federal arena have voiced concerns about the mounting numbers of strictures, the accelerating pace of procedural change and the growing inconsistency of the requirements imposed. Illustrative are the major 1983 and 1993 federal discovery amendments, which new discovery provisions further revised in December 2000. The Civil Justice Reform Act …
