Virtually all the legislation dealing with families that include children begins with a "best interests of the child" premise.' Most, if not all, of the litigated results at least seem to maximize the outcomes for adults. This discrepancy should not be surprising, for both substantive and procedural reasons.

The substantive reason, as even the Supreme Court has noted, is that most of the time, what is good for parents will also be good for children. Lawyers, Non-Lawyers And Mediation: Rethinking The Professional Monopoly From A Problem-Solving Perspective , Jacqueline Nolan-Haley

Mediation is a big business today that is practiced by lawyers and non-lawyers, and is closely related to the business of law. Lawyers have a long-standing monopoly on the law business and do not look favorably on sharing their power with nonlawyers. This phenomenon is odd because it occurs at the same time that the legal profession is beginning to embrace a new ethic of problem-solving that honors the values of collaboration and power-sharing among professionals in multiple disciplines. When a marital partner moves to a nursing home, how do community-dwelling spouses, labeled “married widows,” adapt and cope with changes in the relationship and their own marital roles? The first goal of this study was to explore the role additions and deletions for community-based wives whose husbands moved to a nursing home. The second goal was to examine how these women discursively represent their own self-identity and the relationship they have with their husband who is living in a nursing home. Data were drawn from in-depth, face-to-face interviews with 21 wives whose husbands resided in a nursing home. A …

The October 2001 issue of the American Journal of International Law contained several editorials on the international law implications of the hijackings of September 11, 2001, and their aftermath. In one respect these editorials resemble other writings on these events in academic and popular media: questions of sex and gender are largely overlooked.' In our view, however, concepts of sex and gender provide a valuable perspective on these devastating actions.' We use the term "sex" here to refer to issues about women as distinct biological beings from men, and the term "gender" to encompass social understandings of femininity and masculinity. …

The purpose of this dissertation is to examine the federal government's program designed to address child poverty after the commitment made by the Canadian parliament, in 1989, to eradicate child poverty by the year 2000. Specifically, the Child Tax Benefit (CT-13), the targeted children's poverty program introduced by the federal government in 1993, is analysed in relation to whether it reduced, made no difference, or increased the level and depth of child poverty in Canada. This is a study of personal decision-making dynamics at multiple levels in an Ontario Home for the Aged, including managers, staff leaders, direct care workers, non-direct care workers and residents. Personnel dyadic units of differential decision-making power were postulated: managers/staff leaders, staff leaders/direct care workers and direct care workers/residents. Weber's bureaucracy, other organizational power literature and chaos theory provide the theoretical frame. Staff completed a self administered questionnaire package which included variants of the Staff Involvement in Decision Making scale (Kruzich, 1989), open-ended and demographic questions. This research aims both to investigate the gender role identity characteristics of young Taiwanese women who grew up in the post-Martial Law era and to develop a gender role identity model of young Taiwanese women. A grounded theory approach and in-depth interviews were employed. Open sampling, variational sampling, and discriminate sampling, along with open coding, axial coding, and selective coding were employed. Twenty-three young Taiwanese undergraduate women, aged nineteen to twenty one, were interviewed. Self-in-relation theory, female moral reasoning, women's ways of knowing, characteristics of collectivist cultures, Chinese/Taiwanese cultural assumptions about women, and the impact of Taiwanese women's participation in …

Dancing Towards Wholeness: An Examination Of Empathy And Cohesion In Social Work Treatment Groups, William James Pelech

The purpose of this dissertation was to examine the relationship between empathy and cohesion in a social work treatment group. The findings reported below were derived from video recording and analysis of 12 one-hour sessions from one closed residential treatment group. Both group cohesion and empathy were measured with validated rating scales involving observer ratings and self-reports by group members. In addition, a new construct was introduced to the study of group behavior. Interpersonal coordination was imported to this inquiry as a means of examining changing patterns of nonverbal behavior in the treatment group under study. Interpersonal coordination was defined …

The United Nations documentation on internal displacement provided the conceptual framework for this study. The study explored whether or not homeless people in Toronto face similar experiences to other internally displaced persons throughout the world, if they fit the description of internally displaced persons developed by the UN and, if so, what are the implications of these findings. This inquiry examines teacher's pastoral care roles in a government secondary school. Its purpose is to determine firstly what pastoral care is for teachers within these positions and secondly to articulate why pastoral care is needed in schools, and to discover how teachers and social workers can work together in school to find a common ground within pastoral care. The study explores both the individual experiences of the teachers as they enact this role within the school, but also examines the broader structural factors that are related to pastoral care in schools. Physician-Related Determinants Of Cervical Cancer Screening Among Caribbean Women In Toronto, Ilene Hyman, Punam Mony Singh, Marta Meana, Usha George, Lilian M. Wells, Donna E. Stewart

BACKGROUND: Minority women in Canada are less likely to be screened for cervical cancer than their counterparts in the general population, despite the fact that the proportion of these women who consult a general practitioner about their health each year is similar to minority women. This study examined the physician and practice characteristics associated with Pap testing and perceived barriers to Pap testing of family physicians serving the Caribbean community of Toronto.

METHODS: A mail-back questionnaire was sent to Toronto family physicians practicing in neighborhoods with a high proportion of Caribbean Canadians.

The authors’ hypothesis was to determine whether comparable variation coexisted among the individual learning styles of health professional students and the general population. Our purpose was to demonstrate learning style variability, as well as justification for the utilization of different teaching modalities throughout education. We administered David Kolb’s Learning Style Inventory IIa to sample populations of Emergency Medical Technician/Paramedic students (n = 53), third and fourth year Medical students (n = 28), undergraduate Nursing students (n = 65), second and third year Physician Assistant students (n = 49), and a General student population (n = 70). Attention Deficit Disorder (ADD) is an inherited neuropsychological disorder affecting 3% to 5% of the school-aged population of the United States and having no identified single cause. The primary treatment recommended for those suffering from attentional deficits is multimodal, which includes psychostimulant medication in the form of methylphenidate (Ritalin) and behavioral/educational interventions. The movement against domestic violence began as a grassroots effort to eliminate and to prevent the abuse of women. In the beginning, workers in the movement placed great emphasis on societal causes and solutions to the problem and great strides have been taken toward this end. Contracting With Limited Commitment: Evidence From Employment-Based Health Insurance Contracts, Keith J. Crocker, John R. Moran

When an individual's health status is observable, but evolving over time, the key to maintaining a successful health insurance arrangement is to have the healthier members of the group cross-subsidize those who experience adverse health outcomes. We argue that impediments to worker mobility may serve to mitigate the attrition of healthy individuals from employer-sponsored insurance pools, thereby creating a de facto commitment mechanism that allows for more complete insurance of health risks than would be possible in the absence of such frictions. Using data on health insurance contracts obtained from the 1987 National Medical Expenditure Survey, we find that the …

In these comments I suggest that in our current world, both international and domestic, practicing "in the interests of justice" includes-indeed, should give great priority to-the "peace-seeking" and "problem solving" aspects of lawyering. I continue to see this as counter-cultural to the more common practices of lawyers who are argumentative, persuasive and articulate debaters, who believe fervently and vigorously that seeking justice, on behalf of a client or cause, means advocating for and "winning" a legal claim. To the contrary, seeking peace for parties (and, indeed, nation-states) in conflict, searching for consensus solutions to seemingly intractable public policy and legal …
