Rich Earth Below The Sand' And The Origins Of The Thames Embankments, Stuart Oliver

Reconstruction: Studies in Contemporary Culture

This essay explores the designing of the Thames embankments that were built between 1866 and 1874 for the Metropolitan Board of Works. In particular it concentrates on the origins of what might be called the production of the conditions of production of the embankments. By looking at the motivation of those advocating embanking as a means of exerting literal and figurative control over the river, and the ways in which society influenced such advocacy and determined its effectiveness, the essay explores modernity's construction of a regulated natural in the context of an analysis that is sensitive to the …

Reforming Men And Women: Gender In The Antebellum City, Bruce Dorsey

History Faculty Works

Before the Civil War, the public lives of American men and women intersected most frequently in the arena of religious activism. Bruce Dorsey broadens the field of gender studies, incorporating an analysis of masculinity into the history of early American religion and reform. His is a holistic account that reveals the contested meanings of manhood and womanhood among antebellum Americans, both black and white, middle class and working class. Disciplining Delegation After "Whitman V. American Trucking Ass'ns", Lisa Schultz Bressman

The Supreme Court's recent reversal of the D.C. Circuit's decision in "Whitman v. American Trucking Ass'ns" brings to center stage the critical question for disciplining delegation of lawmaking authority to administrative agencies: Should courts use constitutional law or administrative law for requiring agencies to supply the standards that guide and limit their lawmaking discretion when Congress does not? Professor Bressman argues that "Ashwander v. TVA" provides a resolution. In Ashwander, Justice Brandeis directed courts to refrain from deciding constitutional questions unless absolutely necessary to decide a particular case.
