‘Sworn’ Versus ‘Civilian’ Career Development Paths In The Fire Service In Nevada, Kelly Blackmon

The Clark County Fire Department has no formal career development path for fire prevention (civilian) personnel as it does for suppression (sworn) personnel. The purpose of this paper is to compare the career paths developed for suppression personnel and prevention personnel in five fire departments throughout the State of Nevada. Each department was chosen because they have over 100 total employees. Three dimensions relevant to the extent to which a career development path exists were identified and each department was assessed terms of these dimensions. Uncertain Arrivals: Immigration, Terror, And Democracy After September 11, Peter Margulies

Utah Law Review

The September 11 attacks pose a challenge for reconciling security and democracy in American immigration law. The consequences of discounting security concerns are clear in the hijackers' gaming of the immigration system. However, the elevation of security at the expense of democracy threatens both of these crucial values. This Article proposes an integrative approach to the interaction of democracy and security in immigration law. The premise of the integrative approach is that democracy and security are interdependent in the immigration arena. Recreational opportunities are a valuable source of income, tourism, and excitement in Utah. However, those who provide these activities often have difficulty securing reasonable and affordable liability insurance, and thus often require preactivity waivers of liability from their customers, both adults and children. This Note examines the Utah Supreme Court's recent decision in Hawkins v. Peart, in which the court invalidated a parent's preactivity release of liability on behalf of her child and an indemnity provision in a contract with a trail riding company. Speech Or Opinion? Two Objects Of First Amendment Immunity, Jeremy J. Ofseyer

There is a widespread sense in scholarly circles that First Amendment jurisprudence is riddled with conflict and confusion. Many observers lament that the United States Supreme Court's doctrinal framework for adjudicating free speech cases is deeply incoherent. The eminent First Amendment scholar Thomas Emerson wrote pessimistically in 1966: "No one concerned with freedom of expression in the United States today can fail to be alarmed by the unsatisfactory state of First Amendment doctrine.... [N]o really adequate or comprehensive theory of the First Amendment has been enunciated, much less agreed upon."

In a nine-part discussion, this note addresses issues concerning the health and safety risks associated with the use of cellular phones, which will also include a section that focuses on the advantages of using cellular phones. It is essential to maintain cellular phones and their utility in our lifestyle for personal safety and security. Health and safety problems with cellular phones must be addressed by the least restrictive regulation possible in order to ensure the continued use and the many benefits that the cellular phone industry presents to our society.

There are 59 Community Boards in New York City, each one representing a specific local district (or community) within one of the five boroughs of Manhattan. Each Board is comprised of up to 50 volunteer members, who serve as a local review board for proposed projects within their respective district and make recommendations on a wide range of land use, zoning, budget, and local planning issues. In addition, a Community Board monitors traffic and transportation issues, capital projects in parks, the concerns of seniors and youth, economic development, and public safety. Sustainability, while it is a global movement, is not well understood by the public. The main goals of this project were to develop a process to educate community residents in Pawtuxet Village, Rhode Island about sustainability across scales (local, state, region, nation and beyond) and to help a community to create a definition and vision of sustainability locally.
