Long On Substance, Short On Process: An Appeal For Process Long Overdue In Eyewitness Lineup Procedures, Michael R. Headley

Eyewitness identifications play an important role in the criminal justice system. However, the procedures surrounding these identifications are fraught with potential for error, and the Supreme Court has recognized the "vagaries of eyewitness identification." Over the past thirty years, researchers have established a considerable body of evidence demonstrating that simultaneous lineup procedures result in greater error than sequential lineups. Nevertheless, most law enforcement agencies persist in utilizing the simultaneous lineup procedure. The Selective Deportation Of Same-Gender Partners: In Search Of The "Rara Avis", Victor C. Romero

This article seeks to explore the possibility that a selective deportation of a same-gender partner who has overstayed her visa constitutes an outrageous case under the AADC test. Its modest goal is to discourage the INS from ever pursuing such a strategy, knowing that there are probably many who believe that same-gender overstays, even if civilly united in Vermont, are not the ideal candidates for "suspect class" status under U.S. constitutional law. That notwithstanding, common sense and sound doctrine suggest that, despite the many anti-gay and anti-immigrant decisions handed down over the last twenty years, the Court will not hesitate …

This paper provides a critical assessment of some current issues about access to justice in Canada, with a special focus on criminal justice. The paper identifies recent trends in the literature about criminal justice in Canada and in related common law jurisdictions, including the United States, the United Kingdom, Australia and New Zealand; and the development of restorative justice processes to augment or replace traditional approaches to criminal justice. In this essay I would like to address briefly four issues of importance to local governments raised by the September 11 attack and its aftermath. These issues are the role of local governments in addressing questions of public safety and preparedness; the relations among local governments within a region in responding to terrorism; the role of the federal government in the local response to terrorism; and the implications of September 11 for the structures and functions of local government. This Article argues that California should devise an incentive plan to attract film production projects rather than take a defensive posture to deter film flight. The objective of the incentive plan is to consolidate government funding while capitalizing on California's film marketing and distribution expertise, as well as the growing demand for digital post-production services. In an increasingly global film industry, this incentive plan would lower the bottom-line of international productions. The prospect of earning increased profits through international production efforts should attract more business to the California film industry. The following research goals were established to guide the research and answer the problem: 1. Does intensive supervision provided by Day Reporting Centers reduce the likelihood of probationers violating their conditions of probation? 2. Is intensive supervision provided by Day Reporting Centers more effective in ensuring public safety then regular supervision? 3. Do violations of probation initiated by Day Reporting Centers result in more sentence revocations than violations of offenders on regular supervision? 4. Do special programs such as life skills and substance abuse counseling provided by Day Reporting Centers reduce recidivism?
