Antebellum Perspectives On Free Speech, Mark A. Graber
Antebellum Perspectives On Free Speech, Mark A. Graber
William & Mary Bill of Rights Journal
In his book, Free Speech, "The People's Darling Privilege": Struggles for Freedom of Expression in American History, Professor Michael Kent Curtis documents the political struggles over free speech rights that took place between the ratification of the Bill of Rights in 1791 and the adoption of the Fourteenth Amendment in 1868. Professor Curtis looks to these early free speech fights to help define the contours of contemporary speech rights. In this review, Professor Mark A. Graber discusses Professor Curtis's contribution to constitutional history, and the implications of The People's Darling Privilege for constitutional theorists

An Analysis Of Remote Communication Processes Involved In Video- Mediated And Text-Based Computer-Mediated Communication During Collaborative Problem Solving, Maria Victoria Ramos
Master's Theses - Daytona Beach
The purpose of this study was to explore the impact of current available communication mediums on the process of collaborative problem solving tasks in today's modern society. Seven male-only dyads were asked to complete two tasks, both with a finite and definable solution, by communicating through one of three possible ways: face-to- face (FTF), a synchronous text-based computer system (CMC), and a video-mediated system (VMC). The effectiveness of the medium was evaluated based on time to solution, number of turns and words in relation to a visual search task and a spatial task. Results showed a significant difference in time …

Culture And Ecology Of Latinos On The Great Plains: An Introduction, Gustavo Carlo, Miguel A. Carranza, Byron Zamboanga
Culture And Ecology Of Latinos On The Great Plains: An Introduction, Gustavo Carlo, Miguel A. Carranza, Byron Zamboanga
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
The topic of culture is relevant when focusing on Latinos on the Great Plains. It is evident that Latinos, both as individuals and as group members, exhibit various dimensions of culture in their day-to-day lives. What becomes problematic is how culture is defined and/or operationalized in assessing the Latino experience.
Several definitions of culture serve to demonstrate that culture is one of the most difficult terms to describe. One of the earliest definitions comes from E. B. Tylor who perceived culture as "that complex whole which includes knowledge, belief, art, morals, laws, customs, and any other capabilities and habits acquired …

Journal of the National Collegiate Honors Council Online Archive
The Celts of western and central Europe1 flourished during the height of Greek and Roman civilization, and yet there is a methodological schism between the study of the Mediterranean world and that of the “peripheral” Europeans. Our appreciation of classical society stems primarily from the plentiful written texts – texts that provide us with minute details of society, religion, and politics from the words of the people who actively participated in that culture. The study of the Celts, on the other hand, is more oblique: our primary source is archaeology, and what little textual evidence we do have derives from …

Court Review: Volume 39, Issue 1 - A Crack At Federal Drafting, Joseph Kimble
Court Review: Journal of the American Judges Association
This will not be the first or last article that criticizes the style of drafting in federal statutes. But it will, I believe, be different in at least one respect: it will scrutinize the style in just one small slice of federal drafting in a way that should edify drafters of any legal document. In fact, this inspection should open the eyes of all legal writers—for I’ll identify some of the persistent, inexcusable failings that pervade all legal writing. I did this kind of thing once before in Court Review, using the final orders from the Clinton impeachment trial. If …

Should apologies be admissible into evidence as proof of fault in civil cases? While this question is a simple one, its potential ramifications are great, and legislative and scholarly interest in the admissibility of apologies has exploded. Shortly after the idea of excluding apologies from admissibility into evidence was raised in academic circles three years ago, it rapidly spread to the policy arena. For example, California and Florida enacted laws in 2000 and 2001 respectively excluding from admissibility apologetic expressions of sympathy ("I'm sorry that you are hurt") but not fault-admitting apologies ("I'm sorrythat I injured you") after accidents. Eight …

The Child As Other: Race And Differential Treatment In The Juvenile Justice System, Kenneth B. Nunn
UF Law Faculty Publications
In this Article, I will focus on the treatment of African American children as the "other" in the juvenile justice system. As previously stated, African American children are not the only ones who may be treated as the "other." Latino, Native American, Asian, and even white children may be "othered" in the appropriate social context. My concern here, however, is with African American children. I focus on their condition because I believe it is exemplary of how all children who are perceived as children of the "other" are treated and because, in some ways, the treatment of African American children, …

English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sanford '02
English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sanford '02
Honors Projects
Since 1965, the US has seen increasingly large numbers of immigrants crossing its borders. Indeed, more immigrants are arriving now than at any point in the past; the 1990's saw a higher number of immigrants enter the US than any previous decade (INS 1999). A disturbing corollary to the recent explosion in immigration is the corresponding decline of immigrant earnings relative to the earnings of natives. A cursory glance at the literature strongly suggests the changing national origin of immigrants as the main cause of this relative earnings decline. As a prime example, Mexican immigrants now outnumber any other national …

English Language Proficiency And The Earnings Of Mexican Immigrants, Jeremy Sandford '02
The Park Place Economist
This paper studies the effect of English language deficiency on the wage rates of Mexican immigrants. Using a sample of 81,059 labor market male Mexican immigrants taken from Census PUMS data, I find that the direct effect of English language deficiency on earnings is virtually nonexistent for immigrants with low education and experience levels. These results show that only immigrants with at least a high school education or some US labor market experience will make less than their immigrant counterparts who speak English very well.

Telling Miller’S Tale: A Reply To David Yassky, Brannon P. Denning, Glenn H. Reynolds
Law and Contemporary Problems
A recent article by Professor David Yassky suggests that there is a segment of legal academia that dissents from the Standard model and has started to generate alternatives to the Standard Model. Denning and Reynolds critique that part of Yassky's theory dismissing "United States v. Miller" as providing the basis for an individual rights interpretation of the Second Amendment.

Spectral Riders: Multiple Heritage And The (De-)Construction Of History In Ken Kesey's Last Go Round, Alexandra Ganser
Reconstruction: Studies in Contemporary Culture
[First paragraph]
Ken Kesey's novel Last Go Round (1994) expands on the tradition of the tall-tale; the protagonist and first-person narrator Johnathan E. Lee Spain looks back on his life at the sickbed of a comatose black rodeo champion, re-membering his days of glory (as the winner of the first Pendleton Round-Up) and his manifold experiences during this weekend.

The Impact Of A Congenitally Blind Child Upon Family Functioning And Interaction, Pamela S. Berryman
The Impact Of A Congenitally Blind Child Upon Family Functioning And Interaction, Pamela S. Berryman
Dissertations
The purpose of this study was to determine whether there was an impact of congenital blindness upon family functioning and interaction. This research investigated the level of blindness upon family adaptability, cohesion, satisfaction, and social family climate from a family systems perspective. The study analyzed data from a sample of 56 participants who were parents/care-givers of children age 0-12 years with either no vision, partial vision, or full vision. Chi-squares were computed to determine if any of the demographic variables differed among the three groups. Respondents’ gender, relationship to child, age, child’s level of blindness, number of siblings, and household …
Knowledge-Economy Ilites, The International Law Of Intellectual Property And Trade, And Economic Development, Michael P. Ryan
Knowledge-Economy Ilites, The International Law Of Intellectual Property And Trade, And Economic Development, Michael P. Ryan
Cardozo Journal of International and Comparative Law
The article challenges the simplistic view of the TRIPS Agreement as a tool solely for corporate power, emphasizing instead the agency and strategic choices of developing countries in shaping intellectual property (IP) policies to their economic benefit. It highlights the complexity of IP laws, including trademarks, patents, and copyrights, and their varying acceptance and impact in developing nations. The analysis underscores the importance of understanding sector-specific dynamics and the role of international organizations in promoting IP standards, ultimately advocating for a nuanced approach to IP policies that align with local development goals and global economic integration.

Use "The Filter You Were Born With": The Unconstitutionality Of Mandatory Internet Filtering For The Adult Patrons Of Public Libraries, Richard J. Peltz
Washington Law Review
The only federal court (at the time of this writing) to consider the question ruled unconstitutional the mandatory filtering of Internet access for the adult patrons of public libraries. That 1998 decision helped the American Library Association and other free speech advocates fend off mandatory filtering for two years at the state and federal level, against the vigorous efforts of filtering proponents. Then, in 2000, the U.S. Congress conditioned federal funding of libraries on filter use, forcing the question into the courts as the latest colossal struggle over Internet regulation. This Article contends that the federal court in 1998 was …

An Examination Of The Effects Of Fluency Training On Retention, Distractibility, And Generativity, Victoria Mary Pellettiere
Dissertations
The Precision Teaching movement grew out of a commitment to use frequency as a universal measure of behavior, as well as the desire to employ research methods derived from the experimental analysis of behavior in education (Lindsley, 1991). One component of instruction employing the precision teaching model is fluency training that typically involves exposing learners to the training materials until they have met criteria for both accuracy and speed. Proponents of fluency training ascribe a number of specific benefits to this instructional tool. Lindsley (1992, 1995) and others (Binder, 1993, 1996; Haughton, 1981b) suggested that fluency training enhances retention, endurance, …
