The Transformation Of Civic Institutions And Practices In Portland, Oregon, 1960-1999, Steven Reed Johnson Jul 2002

The Transformation Of Civic Institutions And Practices In Portland, Oregon, 1960-1999, Steven Reed Johnson

Dissertations and Theses

In this dissertation I examine how the organizational framework for civic life in Portland, Oregon, changed between 1960 and 1999 and identify several key aspects of the transformation.

The most basic change has been in the type of organizations involved in civic issues. In 1960 civic life in Portland was dominated by traditional civic organizations: fraternal and benevolent organizations, women's clubs, voluntary and charitable organizations, ethnic cultural groups, and direct social service organizations. By 1999 traditional civic organizations were displaced by advocacy oriented organizations: identity interest groups, neighborhood associations, citizen interest organizations, and social service organizations that advocated for causes. …

Biological Weapons: Toward A Threat Reduction Strategy, Brad Roberts, Michael Moodie Jul 2002

Biological Weapons: Toward A Threat Reduction Strategy, Brad Roberts, Michael Moodie

Defense Horizons

A decade ago, the U.S. military and its allies had a close call with biological weapons (BW) in the war to expel Iraq from Kuwait. Iraqi BW could have inflicted horrific casualties on coalition forces, but the war stopped short of the contingency for which Iraq had prepared, predeployed, and preauthorized the use of such weapons: a march on Baghdad to remove the regime. A decade later, the United States is again poised for war against Iraq—this time for the explicit purpose of regime removal. Moreover, it is engaged in a war on terrorism against adversaries who evidently are strongly …

A State’S Gendered Response To Political Instability: Gendering Labor Policy In Semi-Authoritarian El Salvador (1944-1972), Leslie C. Gates, Kati L. Griffith Jul 2002

A State’S Gendered Response To Political Instability: Gendering Labor Policy In Semi-Authoritarian El Salvador (1944-1972), Leslie C. Gates, Kati L. Griffith

Sociology Faculty Scholarship

Unlike much of the gender and welfare literature, this study examines why a regime that constrains pressure from below would adopt gendered social policies. The Salvadoran case (1944-1972) suggests that political instability rather than societal pressures may prompt semi-authoritarian regimes to adopt gendered labor reforms. We extend the motivations for adopting gendered labor reforms to include co-opting labor by examining gendered labor reforms in the context of El Salvador’s historically contingent labor strategy. This gendered analysis helps explain how a semi-authoritarian regime secured political stability and reveals the special appeal gendered labor reforms may have to semi-authoritarian regimes.

Hostile Environment Actions, Title Vii, And The Ada: The Limits Of The Copy-And-Paste Function, Lisa Eichhorn Jul 2002

Hostile Environment Actions, Title Vii, And The Ada: The Limits Of The Copy-And-Paste Function, Lisa Eichhorn

Washington Law Review

Two federal circuits, borrowing from Title VII jurisprudence, recently recognized a cause of action for a disability-based hostile environment under the Americans with Disabilities Act (ADA). Neither opinion, however, considered how the analysis of a disability-based hostile environment claim under the ADA might differ from that of a race- or sex-based hostile environment claim under Title VII. This Article examines the differing theories of equality underlying the two statutes and argues that, because the statutes prohibit discrimination in fundamentally different ways, courts must resist the temptation to copy and paste Title VII doctrine into ADA hostile environment opinions. This Article …

Keffeler V. Department Of Social And Health Services: How The Supreme Court Of Washington Mistook Caring For Children As Robbing Them Blind, Tobias J. Kammer Jul 2002

Keffeler V. Department Of Social And Health Services: How The Supreme Court Of Washington Mistook Caring For Children As Robbing Them Blind, Tobias J. Kammer

Washington Law Review

Social Security benefits aid in the basic care of beneficiaries. Washington's Department of Social and Health Services (DSHS) used benefits toward this end until Keffeler v. Department of Social and Health Services. In Keffeler, the Supreme Court of Washington ruled that DSHS, even when acting as representative payee, could not use a foster child's Social Security benefits to pay for his or her current maintenance. The court held that DSHS's use of Social Security benefits to pay for the current maintenance of foster children violated 42 U.S.C. § 407 of the Social Security Act, which protects Social Security …

Apparent Authority And Healthcare In Illinois, Marc D. Ginsberg Jul 2002

Apparent Authority And Healthcare In Illinois, Marc D. Ginsberg

Northern Illinois University Law Review

This piece examines and dissects two Illinois Supreme Court cases which utilized apparent authority to hold hospitals and HMOs vicariously liable for non-agent or non-servant agent physician negligence. The author argues that the supreme court's effort to ground these decisions in classical agency law is misplaced. The article provides a general overview of the concept of respondeat superior and apparent authority, as well as a brief introduction to the structure of hospitals and HMOs. The author asserts that apparent authority should not be applied in the healthcare setting. Specific problems are roadblocks in the path of the Illinois Supreme Court's …

No Harm, No Foul: The Oshrc's Authority To Label An Osh Act Violation De Minimis And To Require No Abatement, Samuel D. Elswick, Richard A. Bales

Northern Illinois University Law Review

The federal circuits are split on the issue of whether the Occupational Safety and Health Review Commission (OSHRC) has the authority to label a safety and health violation de minimis and require no abatement even if the Secretary of Labor has issued a citation. This article initially examines the legislative background of the Occupational Safety and Health Act, its procedural aspects, the separate roles allocated the Secretary of Labor and the OSHRC under the Act, the three levels of violations, and the OSCHRC's authority to determine the level of severity of a violation. Next, the current split in the Federal …

Price Theory And Anti-Takeover Laws: Shareholder Protection In Illinois, Vince Goddard Jul 2002

Price Theory And Anti-Takeover Laws: Shareholder Protection In Illinois, Vince Goddard

Northern Illinois University Law Review

The article addresses the need to review the laws that govern corporate mergers and acquisitions and shareholder protections in light of the precarious nature [of] today's economy. It discusses the laws by using the tools of economic analysis, to show that states like Illinois can craft and hone their laws so as to create the ideal environment for corporations to facilitate efficiency, and to ensure the maximum amount of shareholder protection.

The Fourth Amendment And The New Face Of Terrorism: How September 11th Could Change The Way America Flies, Brett A. Skean Jul 2002

The Fourth Amendment And The New Face Of Terrorism: How September 11th Could Change The Way America Flies, Brett A. Skean

Northern Illinois University Law Review

This comment examines the possible repercussions of the September 11, 2001, attacks on airport security measures and how future judicial review might take into consideration the now compelling governmental interest in safe airways. The historical and modern exceptions to the Fourth Amendment's warrant requirement are examined with an analysis of the possible justifications and constitutionality of physical searches of potential airline travelers. In conclusion, the piece determines the obvious question of whether in today's terrorist climate, there is a reasonable expectation of privacy when a person enters an airport, and if not, whether there is any resulting Fourth Amendment protection.

What Constitutes An Invalid "Blanket Consent" Within The Purview Of Illinois' Mental Health And Developmental Disabilities Confidentiality Act?, Jana L. Fischer Jul 2002

What Constitutes An Invalid "Blanket Consent" Within The Purview Of Illinois' Mental Health And Developmental Disabilities Confidentiality Act?, Jana L. Fischer

Northern Illinois University Law Review

Illinois' Mental Health and Developmental Disabilities Confidentiality Act, 740 Ill. Comp. Stat. 110/1 (2000), prohibits "blanket consent" to the disclosure of mental health and developmental disabilities treatment records. This Comment argues that Illinois' Confidentiality Act inadequately defines "blanket consent" so as to ensure that an authorization for the disclosure of mental health records is obtained on an informed and consensual basis. This is especially so where a recipient's authorization results in the unintended release of information not thought to be contained in the records. The purpose of this Comment is to suggest that the Illinois legislature should look to the …
