Least Restrictive Environments: Assessing Classroom Placement Of Students With Disabilities Under The Idea, Sarah E. Farley Jul 2002

Least Restrictive Environments: Assessing Classroom Placement Of Students With Disabilities Under The Idea, Sarah E. Farley

Washington Law Review

The Individuals with Disabilities Education Act (IDEA) requires school districts to educate all students receiving special education in the "least restrictive environment" appropriate for each student's needs. This provision reflects Congress' preference that children with disabilities be educated alongside their non-disabled peers to the maximum extent possible. The U.S. Supreme Court has never determined how to test whether a school district has complied with this provision, so the federal circuits have developed several different tests. However, these circuit tests all arose prior to the most recent 1997 Amendments to the IDEA. This Comment explores the development and subsequent application of …

Racketeering, Rico And The Revenue Rule In Attorney General Of Canada V. R.J. Reynolds: Civil Rico Claims For Foreign Tax Law Violations, Elizabeth J. Farnam

Washington Law Review

When Congress passed the Racketeer Influenced Corrupt Organizations Act (RICO), it created a civil cause of action for any entity, including a foreign government, to recover for injury caused by a defendant's pattern of racketeering activity. However, Congress did not expressly indicate how the revenue rule, a conflict of laws doctrine that allows a court to decline to enforce a foreign government's tax claim or judgment, would relate to civil RICO claims. In Attorney General of Canada v. R.J. Reynolds Tobacco Holdings, Inc., the United States Court of Appeals for the Second Circuit held that the revenue rule barred …

Treaties In Collision: The Biosafety Protocol And The World Trade Organization Agreements, Sabrina Safrin Jul 2002

Treaties In Collision: The Biosafety Protocol And The World Trade Organization Agreements, Sabrina Safrin

Rutgers Law School (Newark) Faculty Papers

In the event of a conflict between the requirements of the Biosafety Protocol, a multilateral agreement governing the trade in genetically modified organisms, and the requirements of the General Agreement on Tariffs and Trade and associated agreements (collectively WTO Agreements), which treaty's requirements prevail? This question lies as the legal heart of the perceived conflict between trade globalization and environmental protection. This issue is particularly timely given the present trade dispute between the United States and European Union over the European Union’s restrictions on the importation of genetically modified agricultural commodities.

In this piece, I analyze the relationship between these …

Case Studies On The Implementation Of The Workforce Investment Act: Spotlight On Kentucky, Allison Cohen Hall, Jaimie Ciulla Timmons, Sheila Fesko

Case Studies Series, Institute for Community Inclusion

The implementation of the Workforce Investment Act (WIA) requires major organizational change for employment and training agencies. The initiative emphasizes coordination, collaboration and communication among organizations for better service delivery. At this time, states are developing systems that will enable them to address the needs of all customers seeking employment. The Institute for Community Inclusaion (ICI) has conducted state case studies for two purposes: (1) to identify how states have begun the process of collaboration under the new mandates of WIA; and (2) to understand the impact on customers with disabilities. This is the first in a series of publications …

Economic Currents: The State Of The State Economy, Alan Clayton-Matthews

Public Policy and Public Affairs Faculty Publication Series

While no longer contracting, the Massachusetts economy has not yet turned the corner, either. Delays in the recovery of the technology sector, along with state government fiscal problems, have offset modest expansion in health, education, and residential real estate. But consumer confidence and spending, buoyed by low interest rates and rising home equity, have been making up for weak business capital spending. Could slow growth be just ahead?

The Personality Profile Of Al-Qaida Leader Osama Bin Laden, Aubrey Immelman Jul 2002

The Personality Profile Of Al-Qaida Leader Osama Bin Laden, Aubrey Immelman

Psychology Faculty Publications

This paper presents the results of an indirect assessment of the personality of Osama bin Laden, founder and leader of the al-Qaida terrorist network responsible for the September 11, 2001 terrorist attack on the United States.

Bin Laden’s primary personality patterns were found to be Ambitious/exploitative and Dauntless/dissenting, with a secondary Distrusting/suspicious orientation, and subsidiary Dominant/controlling and Conscientious/dutiful features.

Ambitious individuals are bold, competitive, and self-assured; they easily assume leadership roles, expect others to recognize their special qualities, and often act as though entitled. Dauntless individuals are bold, courageous, and tough; minimally constrained by the norms of society; routinely engage …

Beyond Observable Prejudice-Moving From Recognition Of Differences To Feasible Solutions: A Critique Of Ian Ayres' Pervasive Prejudice?, Mary Margaret Penrose

Faculty Scholarship

As a female professor working within the academic ranks of a law school, I did not have to read Ian Ayres' work, Pervasive Prejudice? Unconventional Evidence of Race and Gender Discrimination, to know that the odds remain quite high that blacks and women will be subjected to greater instances of discrimination in the marketplace, in medical facilities, and in judicial proceedings than their white male counterparts. Although I would not suggest that such conclusion is axiomatic, it certainly is observable on an experiential level by those falling within the two categories (race and gender) discussed in Professor Ayres' book. …

Diane Pretty was an Englishwoman in her early 40s who had been married nearly a quarter of a century. In November 1999, she learned she had amyotrophic lateral sclerosis-in Britain, motor neurone disease. Her condition deteriorated rapidly, and soon she was "essentially paralysed from the neck downwards." She had "virtually no decipherable speech" and was fed by a tube. She was expected to live only a few months or even weeks. AB a court later explained, however, "her intellect and capacity to make decisions are unimpaired. The final stages of the disease are exceedingly distressing and undignified. AB she is …

Reducing Childhood Pedestrian Injuries: Individual Risk Factors (Chapter 3), Katherine Kaufer Christoffel, Lizette Peterson, David Dilillo Jul 2002

Reducing Childhood Pedestrian Injuries: Individual Risk Factors (Chapter 3), Katherine Kaufer Christoffel, Lizette Peterson, David Dilillo

Department of Psychology: Faculty Publications

Most factors influencing the risk of pedestrian injury for children are based on family considerations or community norms, not on individuals. Nevertheless, individual risk factors should be considered when planning prevention programs (Christoffel, Donovan et al. 1996). The potential importance of individual traits has been extensively studied in the hope of finding a factor that could be modified. Considerations of the individual are important because they largely define the child’s risk of injury, even while walking with others. The causal sequence of a child walking to a particular site at a particular time where he or she is injured is …

Synthetic Studies Directed Toward The Phorboxazoles: Preparation Of The C3–C15 Bisoxane Segment And Two Stereoisomers, Patrick Bernard Greer, William A. Donaldson

Chemistry Faculty Research and Publications

A synthetic approach to the C3–C15 segment of the cytotoxic marine metabolite phorboxazoles is described. This segment consists of a methylene linked bisoxane structure. The first pyran ring was constructed by a Lewis acid catalyzed diene–aldehyde cyclocondensation. The β-C-glucoside substitution pattern of this ring was established by a stereoselective allylation. Ozonolysis of vinyl group and enantioselective allylation of the racemic aldehyde generated two separable homoallylic alcohols (−)-22 and (+)-23. The Mosher's esters of each alcohol were determined to be >90% de. Reaction of (−)-22 with acryloyl chloride, followed by ring closing metathesis gave the …

Mine An Anthology Of Women's Choices, Meredith Stern

This is a collection of 22 stories about abortion and menstrual extraction. There are stories from a woman having an abortion pre-Roe v Wade, and stories of people having multiple abortions in safe and legal methods. This zine was published in 2002 and was distributed across North America, mostly in zine and book stores, and in online zine catalogs. At the time, abortion was stigmatized- many people did not talk openly about their experiences for fear of being judged. At the time, although 1 in 3 women had an abortion in their lifetime, it was considered shameful by a majority …
