This recent developments outline discusses, and provides context to understand the significance of, the most important judicial decisions and administrative rulings and regulations promulgated by the Internal Revenue Service and Treasury Department during 2001 - and sometimes a little farther back in time if we find the item particularly humorous or outrageous. Most Treasury Regulations, however, are so complex that they cannot be discussed in detail and, anyway, only a devout masochist would read them all the way through; just the basic topic and fundamental principles are highlighted. During the latter part of the twentieth century, progressive scholars in various fields of study have developed a large body of works analyzing identity politics. Within legal scholarship, critical race, feminist, anti-heterosexist, and other progressive theorists have demonstrated how legal doctrines and policies perpetuate social hierarchy and reinforce the domination of oppressed classes. The efforts of progressive scholars (and activists) to launch a unified critique of injustice, however, has proved difficult - due in part to the variety of theoretical and doctrinal options available to counter subordination and also to the intractable nature of institutionalized oppression. Interest in the quality and health of soil has been stimulated by recent awareness that soil is vital to both production of food and fiber and global ecosystems function. Soil health, or quality, can be broadly defined as the capacity of a living soil to function, within natural or managed ecosystem boundaries, to sustain plant and animal productivity, maintain or enhance water and air quality, and promote plant and animal health. Population growth, a widening gap between the rich and poor, environmental degradation, and a re-evaluation of energy use and alternatives will shape life in the 21st century. We will be challenged to increase food supplies for a global population one-and-a-half to two times its current size. But as agricultural systems grow to meet the demands of more people, increased pressure will be placed on our natural resources: competition for land, water and energy resources from both urban and industrial sectors becomes more acute and the available land base remains static or shrinks. Soil C sequestration can improve soil quality and reduce agriculture’s contribution to CO2 emissions. The long-term (12 yr.) effects of tillage system and N fertilization on crop residue production and soil organic C (SOC) sequestration in two dryland cropping systems in North Dakota on a loam soil were evaluated. An annual cropping (AC) rotation [spring wheat (SW) (Triticum aestivum L.)–winter wheat (WW)–sunflower (SF) (Helianthus annuus L.)] and a spring wheat-fallow (SW-F) rotation were studied. Tillage systems included conventional-till (CT), minimum-till (MT), and no-till (NT). Nitrogen rates were 34, 67, and 101 kg N ha‒1 for the AC …

The genetic similarity between Mycobacterium avium subsp. paratuberculosis and other mycobacterial species has confounded the development of M. avium subsp. paratuberculosis-specific diagnostic reagents. Random shotgun sequencing of the M. avium subsp. paratuberculosis genome in our laboratories has shown >98% sequence identity with Mycobacterium avium subsp. avium in some regions. However, an in silico comparison of the largest annotated M. avium subsp. paratuberculosis contigs, totaling 2,658,271 bp, with the unfinished M. avium subsp. avium genome has revealed 27 predicted M. avium subsp. paratuberculosis coding sequences that do not align with M. avium subsp. avium sequences. The Crisis Of Child Custody: A History Of The Birth Of Family Law In England, Danaya C. Wright

This article attempts to show that the inter-spousal custody cases of the nineteenth century created such a crisis in equity that they eventually demanded a new court structure and a new set of legal doctrines. The custody cases posed such a profound threat to the stability and authority of the Chancery courts that within fifty years an entirely new court system was required. That court system combined the tripartite jurisdictions of the law, equity, and ecclesiastical courts in matrimonial matters. While many scholars and historians have applauded that moment, I would suggest that the new court was merely a way …

In a previous article in this Journal, I wrote that many of us practicing in the field of housing and community development law had adopted a "myopic" view of the world. At that time, I urged colleagues to consider the problems of growth management facing urban centers around the globe. Balance is critical for optimal function in completion of everyday tasks. Physical therapists frequently work with people that have balance disturbances in order to help return them to optimal function. One tool used in the assessment and treatment of balance disorders is the NeuroCom® Balance Master 7.06 (NBM), a computerized forceplate system that provides objective measurements of balance performance. In order to obtain accurate measurements on the NBM, it is necessary that the tester have adequate training. Purpose: The purpose of this study was to determine the intra- and inter-tester reliability of the DualerTM Digital Inclinometer when measuring lumbar flexion and extension. Past studies examining reliability of inclinometers have reported variable results. Few studies in the literature have sought to determine the reliability of the Dualer™ Digital Inclinometer for measuring lumbar flexion and extension.

Background and Purpose
The purpose of this study is to describe lower extremity muscle activity and joint range of motion while moving both forward and backward on an elliptical trainer at minimum and maximum inclines.
Subjects
Ten healthy subjects (7 female and 3 male) gave informed consent to voluntarily participate in this study.
Methods
A single group experimental design was used. A maximum contraction was performed for comparison measure and electromyographic (EMG) data was collected while the subjects performed the stride at the specified variables.

Rheumatoid arthritis is a progressive, destructive and chronic, inflammatory disease of the joint synovium. Signs and symptoms include pain, limited range of motion, swelling, and tenderness, which may progress to deformity. These manifestations may limit dexterity, independent living, and the overall well being of an individual. Living with daily restrictions proves to be a psychologically distressing experience.

People have developed an obsession with flattening their stomachs and slimming down their waistlines. The so called "ab machines" have become the most popularly purchased home exercise tools. Although numerous electromyographic (EMG) analysis studies have been done on various forms of equipment-free abdominal exercise, little research has been done to evaluate the effectiveness of equipment-aided exercise. The purpose of this study was to analyze and evaluate any differences in EMG activity between three abdominal exercises: the traditional crunch, the crunch on a ball, and utilization of a prone rolling machine (AbSlide®).

We assume a lot about the virtues of governance "from the bottom up." We trust in it as an antidote: to oppression from the other direction; to the kind of "top-down" planning that we blame for the tragedies of urban renewal; and to the hubris of any "helping professionals" who think they have good ideas about the way in which communities ought to be helped.' This Note begins by examining the complex history behind workers' compensation subrogation rights in the state of Ohio. This historical timeline flows from the period when statutory subrogation was non-existent in Ohio, to the first version of a subrogation statute in 1993, and finally to the broadened and revised statute in 1995. A detailed examination of the Supreme Court of Ohio's decision in Holeton v.
