Media And Religion, Paul A. Soukup Jan 2002

Media And Religion, Paul A. Soukup

Communication

This survey will examine three broad strands of communication research on media and religion. First, it will review some emerging frameworks for studying media and religion and see how current scholars situate the topic. Second, it will look at how people have studied the relation of different media to religion, focusing on journalism (especially the coverage of religion), the entertainment media (both the content and the critique), and the information media (primarily the Internet). Finally, this survey will examine the Christian reflection on media, occurring in what some term Communication Theology (Plude 2001: 3).

Should Victims Of Exposure To A Toxic Substance Have An Independent Claim For Medical Monitoring?, Thomas J. Miceli, Kathleen Segerson Jan 2002

Should Victims Of Exposure To A Toxic Substance Have An Independent Claim For Medical Monitoring?, Thomas J. Miceli, Kathleen Segerson

Economics Working Papers

Traditional tort law does not allow a victim of exposure to a toxic substance to seek damages without evidence of actual loss. Given the difficulty of collecting damages after a long latency period, however, we examine the desirability of granting exposure victims an independent cause of action for medical monitoring at the time of exposure. We show that such a cause of action is not necessary to induce victims to invest in efficient monitoring. It can, however, increase incentives for injurer care, but only at the cost of greater litigation costs. The general reluctance of courts to adopt a cause …

Imperfect Liability Regimes: Individual And Corporate Issues, Richard A. Epstein Jan 2002

Imperfect Liability Regimes: Individual And Corporate Issues, Richard A. Epstein

Faculty Articles

What should be done? The short answer is very little. The initial imperfection is brought into the system by creating limited liability, a rule that improves the prospects of recovery in some, but not all, cases. The cases that crop up in litigation are those in which the assets of the predecessor are not sufficient to meet the liabilities of its activities. In general, the status quo ante is the right rule, which the Third Restatement follows, with however, the important, if mistaken, exception that exposes the assets of the successor corporation in cases of mergers and acquisitions unless some …

Liberty, Equality, And Privacy: Choosing A Legal Foundation For Gay Rights, Richard A. Epstein Jan 2002

Liberty, Equality, And Privacy: Choosing A Legal Foundation For Gay Rights, Richard A. Epstein

Faculty Articles

These general ruminations play out in explicit fashion in connection with the question of whether equal protection or privacy is the appropriate framework in which to analyze the rights of gays and lesbians. Here, my first instinct is to bridle at the way the question is formulated because it seems better to ask what rights all individuals have under the Constitution just by virtue of being citizens of the United States or persons subject to its laws. I am much more comfortable with starting from general principles and reaching a specific conclusion about a given group, than I am with …

Covering, Kenji Yoshino Jan 2002

Covering, Kenji Yoshino

Faculty Articles

This article considers how the gay civil rights movement might enrich an American civil rights discourse predicated on the paradigm classifications of race and sex. It posits that gays may be able to contribute a more robust theory of the relationship between assimilation and discrimination, a theory which takes assimilation to be an effect of discrimination as well as an evasion from it. The article maintains that gays may be more attuned to the discriminatory aspects of assimilation because they are capable of assimilating in more ways than racial minorities or women. Either in fact or in the imagination of …

The Tools Of Law And The Rule Of Law: Teaching Regulatory Takings After Palazzolo, Daniel J. Hulsebosch Jan 2002

The Tools Of Law And The Rule Of Law: Teaching Regulatory Takings After Palazzolo, Daniel J. Hulsebosch

Faculty Articles

Last term the Supreme Court returned to the field of regulatory takings and bolstered the constitutional rights of property owners whose land is subject to environmental regulation. It also handed Property teachers a gift. In Palazzolo v. Rhode Island, the Court struck down a state court’s holding that a property owner who acquired land after the enactment of a land use regulation cannot claim that the regulation effects an unconstitutional “taking” of his property. According to the Court, a state may not automatically prevent post-enactment acquirers of property from pursuing takings claims because they “purchased or took title with notice …

A Defense Of Empirical Legal Scholarship, Richard L. Revesz Jan 2002

A Defense Of Empirical Legal Scholarship, Richard L. Revesz

Faculty Articles

In the past twenty years, the legal academy has become quite interdisciplinary in its ambitions and methods. It is therefore natural that scholars in other disciplines-particularly the social scienceswould want to assess the quality of work being done by legal scholars, as Epstein and King have done. At the same time, given the extent to which joint degree holders and otherwise academically trained individuals have moved into legal teaching, it would be surprising if the quality of legal research-particularly empirical research-had not improved dramatically over time, with its tools becoming more sophisticated, the questions it addresses becoming better conceived, and …

Draft Convention On Jurisdiction And Recognition Of Judgments In Intellectual Property Matters, Rochelle C. Dreyfuss, Jane C. Ginsburg Jan 2002

Draft Convention On Jurisdiction And Recognition Of Judgments In Intellectual Property Matters, Rochelle C. Dreyfuss, Jane C. Ginsburg

Faculty Articles

This proposal is meant to spur the intellectual property bar to consider whether it would be desirable to create a regime for international enforcement of intellectual property law judgments. Such a convention could be adopted under the auspices of the World Intellectual Property Organization ("WIPO") or through the World Trade Organization ("WTO"). There are several reasons to believe that an instrument drafted specifically for intellectual property disputes would be particularly advantageous. First, for intellectual property disputes, efficiency should be a principal target. Modern distribution methods, particularly satellite and Internet transmissions, make it increasing likely that intellectual property rights will be …

The New Treaty Makers, José E. Alvarez Jan 2002

The New Treaty Makers, José E. Alvarez

Faculty Articles

The "erosion of sovereignty" that is said to characterize globalization is not generally associated with any deviation from the fundamental principle that states must freely consent before they can be said to be bound by any international agreement. With few exceptions, as with respect to Iraq in the wake of the Gulf War, states are rarely told that they must adhere to any particular treaty-despite emerging notions of "global governance." The initiation and conclusion of modern treaties is still generally seen as the affirmation of sovereignty, rather than its diminution. Modern treaties, the only source of international obligation said to …

A Point Mutation In Codon 76 Of Pfcrt Of P. Falciparum Is Positively Selected For By Chloroquine Treatment In Tanzania, A.G. Schneider, Zul Premji, I. Felger, T. Smith, S. Abdulla, H.-P. Beck, H. Mshinda

Pathology, East Africa

This study was undertaken to validate the relevance of Chloroquine (CQ) resistance markers pfert76 and pfmdrl86 in an endemic area in Tanzania. After treatment with CQ, recrudescence was distinguished from new infection by msp2 genotyping, and the number of concurrent infection was also determined. The rate of children with recrudescent parasites at day 7 and/or day 14 amounted to a parasitological failure rate of 22.4% using PCR. The mean multiplicity of infection at day 0 was 3.2 (n = 71). The allelic frequencies of the mutated pfert76 and pfmdrl86 were estimated to be 92 and 77%, respectively. Both values exceeded …

Vertical Hydraulic Gradients And The Cause Of Foliar Variation In Tall Redwood Trees (Sequoia Sempervirens), Gregory M. Jennings Jan 2002

Vertical Hydraulic Gradients And The Cause Of Foliar Variation In Tall Redwood Trees (Sequoia Sempervirens), Gregory M. Jennings

Cal Poly Humboldt theses and projects

Recent research on whole-tree water relations has revealed interesting patterns of hydraulic variation in tall conifers. This work has been accompanied by an increasing attention to foliar anatomy and the role it plays in a tree's hydraulic functioning. In spite of broad interest in this topic, redwood, one of the potentially most interesting species, has been little studied. This thesis addresses our poor understanding of redwood by examining potential causes of foliar variation, testing the ability of foliage to directly absorb water, and quantifying vertical gradients in xylem pressure potential (psi x),stable carbon isotope ratio (delta 13C),light environment, foliar morphology, …
