"We are all segregated in the prison of class," mused turn-of-the-century literature professor Vida Dutton Scudder. "More than we recognize, our inner life is shaped by the traditions of the group to which we happen to belong; and until we escape from such prison, at least through imagination, or better far through personal contacts, our culture is bound to remain tragically cramped and incomplete" (On Journey 67-68). In innovative literature courses, Scudder offered college students escapes from their class prisons through "imagination." She facilitated "personal contacts" by encouraging students to work with people of other classes and races in inner-city …

Technological advances have made endless amounts of information on nearly every subject easily accessible, while at the same time fostering an economic climate conducive to international trade and partnerships. The challenge for companies then becomes one of figuring out how best to manage and use this mass of information, a task complicated by the increasingly global nature of business that requires products to be tailored to more specialized user groups in a wider array of formats and in different languages. This Article begins by surveying the myriad ways that increasing globalization of communication, travel, and trade, and in particular the rise of the Internet, have forced judges and legal scholars to "adapt" traditional rules for legal jurisdiction to the new economic and social environment. For example, if a person posts content online that is legal where posted but illegal in some place where it is viewed, can that person be subject to suit in the far-off location? Austin Sarat's 'When the State Kills' seeks to explore the interrelationship between capital punishment and American culture. Utilizing scholarly approaches drawn from sociology, literary criticism, cultural studies, and political science, Sarat illuminates the ways in which the official legal regime of capital punishment creates, reflects, and reinforces broader cultural attitudes about crime and punishment. Moreover, he argues that the destructive long-term cultural consequences of the death penalty provide a reason for abolition over and above any criminological or doctrinal arguments against the practice.

Comparing Communication Technology On Chinese, English, And Spanish Diabetes Web Sites, Yanko F Michea, Karen Pancheri, Yang Gong, Elmer Bernstam

Technological and cultural factors influence access to health information on the web in multifarious ways. We evaluated structural differences and availability of communication services on the web in three diverse language and cultural groups: Chinese, English, and Spanish. A total of 382 web sites were analyzed: 144 were English language sites (38%), 129 were Chinese language sites (34%), and 108 were Spanish language sites (28%). We did not find technical differences in the number of outgoing links per domain or the total availability of communication services between the three groups. Both conventional price theory and standard economic accounts of tort and contract law assume fixed property rights. In fact, however, property regimes are not static but change over time. Given the assumption of fixed property that otherwise prevails in economic literature, explaining the evolution of property rights is one of the great challenges for the economic analysis of law.
The point of departure for virtually all efforts to explain changes in property rights is Harold Demsetz’s path‐breaking article, “Toward a Theory of Property Rights.” The article is still widely cited and reproduced, especially in first‐year property courses in law schools. …

The death of a child has tremendous impact on a caregiver. Even when prognosis is poor and death appears imminent, care of the dying child typically focuses on achieving cure. Consequently, caregivers are often ill prepared to cope with the grief they experience as their child is dying. Anticipatory mourning allows caregivers time to begin grief work prior to the death of a loved one. Literature suggests that those who experience anticipatory mourning have a less complicated bereavement period. Two interconnected social upheavals that occurred in the second half of the twentieth century underlie an intensifying legal debate about the conception of family. First, Western culture openly challenged a set of assumptions that supported a vision of family as hierarchical, holistic, and almost completely separate from the marketplace. Second, a group of social institutions (including schools, churches, and voluntary communal groups) that once anchored moral debate began to recede in significance. To these upheavals, American law has increasingly responded by eliding traditional legal responses to family issues and by seeking moral direction from constitutional principles. Aboriginal Australia has a unique heritage of oral literature and Aboriginal people of all ages take delight in yarning. Despite the richness and contemporary relevance of this heritage, little is known in the wider Australian society about the oral discourse skills that are taken for granted in Aboriginal communities.
Although the art of oral narrative has developed over countless generations and by medium of Indigenous languages, previous studies (Malcolm 1994a, b; Malcolm and Rochecouste 2000; Rochecouste and Malcolm 2000) have shown that it is vigorously maintained in Aboriginal English.

Infanticide is the most prevalent violent crime committed by women and has occurred throughout history for various reasons including sacrifice, birth control, eugenics, shame, and fear of punishment for adultery. Postpartum mood disorders have been recognized as a legitimate mental illness since the fourth century, and approximately fifty to eighty percent of new mothers experience some degree of depression after giving birth. Postpartum depression can progress into psychosis so quickly that new mothers may not even notice impairment of thinking skills. During the past 30 years, Americans have steadily reduced their participation in the traditional forms of community involvement, such as clubs, associations, and organizations, that bring people together to effectively pursue a shared objective. In this postmodern society, leaders of community and nonprofit organizations find they are asking themselves difficult questions about the most effective methods of fulfilling their mission and simultaneously meeting members' changing needs. Problem. The Corinthian tongues is a subject that has been extensively covered in the literature, especially in exegetical Bible commentaries, but no empirically developed curriculum for college-level instruction has been found. The purpose o f this study was to develop such a curriculum. The approach to the interpretation o f the tongues of 1 Corinthians 14 was interdisciplinary: both theological and sociological.

Greenberg has recently stated that isolating temporal ceramic indicators for the Early Bronze II-III periods is "one of the thorniest issues in the archaeology of Palestine" (2000: 183). Part of theproblem stems from the homogenous nature of ceramic assemblages from Early Bronze Age Palestine; part of it stems from a continued lack of published information. Both of these issues are addressed by this study. Excavations at Tell Ta`annek between 1963 and 1967 unearthed the remains of a multi-period site, including the residues of an Early Bronze II-III fortified settlement. Problem . In 1 Cor 8:1-10:29a, Paul has been consistently on the side of the brother in 8:11 whose conscience is weak to eat food offered to idols. But, in 10:29b-30, he seems to reverse himself, here suggesting that one should be able to eat anything, regardless of its provenance or the effect such eating may have on others. Or, what should be made of the two questions asked in the text that appear neither fitted to the context nor directly answered by what precedes and follows in the discussion of εἰδωλόθυτα in 8:1-11:17?

Lawyers And Decisions: A Model Of Practical Judgment, Alexander W. Scherr

What do lawyers do, and how do they think in practice? Certainly, lawyers analyze law, and apply it to facts: the law school answer. This article proposes a more fluid notion: that lawyering prompts a mindfulness associated with decision-making, a mindfulness that engages and integrates a number of different capacities. Lawyers engage in a complex and unique thought process that relies only partially on rigorous analysis of legal principle. Lawyers must also integrate non-legal and even non-conceptual realities in considering client decisions. This integration emerges from the lawyer-client relationship and flexes to the demands characteristic of lawyering tasks. Lawyering is …
