How Theology Might Learn From Law (Symposium: The Theology Of The Practice Of Law), James Boyd White Jan 2002

How Theology Might Learn From Law (Symposium: The Theology Of The Practice Of Law), James Boyd White

Articles

I want to start today with an account of the way lawyers think and speak, and then ask whether it might be useful for the theologically minded to take these practices and procedures seriously as a ground of comparison from which to look at their own. In doing this I shall look at the practice of law with an emphasis not on its social effects or ethical difficulties but on the nature of the activity itself, viewed from the inside, asking in particular what kind of knowledge it requires and creates in its practitioner. What does the lawyer learn from …

Applying The Constructivist Framework To Elementary School Social Studies: Benefits For Young Learners And Preservice Teachers, Nancy P. Gallavan

Northwest Journal of Teacher Education

The constructivist framework provides elementary school teachers with pedagogical guidance and professional support particularly effective for teaching and learning social studies benefiting both their young learners and their preservice teachers. Research conducted with approximately 100 elementary school teachers produced three key conditions for applying the constructivist framework competently to social studies education. Findings from this research revealed that elementary school teachers believe that foremost they must he cognizant of and proficient in their: (1) knowledge, skills, and attitudes of social studies content and purposes, (2) understanding for developing social studies curriculum and methods for communicating the social studies effectively both …

Cuba's Tourist Industry: Parallel Economies And Social Stratification, Marie Nathan Hummel Jan 2002

Cuba's Tourist Industry: Parallel Economies And Social Stratification, Marie Nathan Hummel

UNLV Retrospective Theses & Dissertations

International tourism has played an important role in unintended social changes in socialist countries. These social and cultural changes affect not only the economic, political and cultural genre of the government, but also of its citizens; This thesis asks the question, "Has the re-introduction of international tourism in Cuba diluted and compromised the egalitarian goals of the revolution"? I intend to show that the consequences of Cuba's emerging tourist industry has not only compromised the ideology of the revolution, but has in fact seen a return of a pre-revolution stratified society and parallel economies, one based on the peso and …

Exploring The Shivwits Production Zone, Eva Albrecht Jensen Jan 2002

Exploring The Shivwits Production Zone, Eva Albrecht Jensen

UNLV Retrospective Theses & Dissertations

The Shivwits Plateau is situated on the Arizona Strip in the northwest corner of Arizona. It is a relatively unexplored area rich in archaeological resources. This study provides three areas of exploration of the prehistoric Virgin Anasazi Pueblo period. Three research questions are posed. Are there substantial Virgin Puebloan sites on the Shivwits Plateau? Through compiled site data and analysis of settlement models the information supports the conclusion that there was a substantial prehistoric use of the Shivwits Plateau; A specific question about pottery production guides the second part of the research. Was the sherd-tempered Shivwits Plain and Shivwits Corrugated …

Variation In Decorated Tusayan Gray Ware Pottery At The Yamashita-3 Site, Kristen D Martine Jan 2002

Variation In Decorated Tusayan Gray Ware Pottery At The Yamashita-3 Site, Kristen D Martine

UNLV Retrospective Theses & Dissertations

This thesis characterizes variability in sand-tempered decorated Tusayan Gray Ware pottery at the Yamashita-3 site in the lower Moapa Valley. Attributes included in this analysis reflect geologic source materials used to make pottery, and stylistic variables that mirror decisions made by individual potters. Evaluation of these characteristics will aid future researchers in identifying the degree to which manufacture of decorated Tusayan Gray Ware pottery was standardized in the Virgin region. The results of this analysis indicate that most characteristics of decorated Tusayan Gray Ware pottery display little variation, indicating that the manufacture of this pottery was standardized. Two aspects of …

Two Non-Specific Indicators Of Stress: Enamel Hypoplasia And Harris Lines, Marta Pilar Alfonso Durruty

UNLV Retrospective Theses & Dissertations

Harris lines (HL) and enamel hypoplasia (EH) are two non-specific indicators of stress, commonly used in the reconstruction of the health status in past and present populations. The aim of this study was to determine if there is a correlation between these two markers. To achieve this aim, a sample of 136 individuals from two archaeological sites (Az-71 and Az-l40) from northern Chile was analyzed. HL and EH showed no correlation in terms of presence absence at the individual level. In addition, HL and EH, by age of the individual at the time of the defect formation, showed a completely …

Steward's Southern Great Basin Research Validated Through Obsidian Artifact Sources, Lynn Ellen Haarklau Jan 2002

Steward's Southern Great Basin Research Validated Through Obsidian Artifact Sources, Lynn Ellen Haarklau

UNLV Retrospective Theses & Dissertations

Energy Dispersive X-Ray Fluorescence (EDXRF) analysis of obsidian artifacts collected from ethnohistoric sites in southern Nevada revealed patterns consistent with Julian Steward's documentation of Western Shoshone socioeconomics. Specific obsidian sources were predicted to be present in artifact samples collected from six sites in the study area. Predictions were based on Steward's documentation of Lida Vicinity, Kawich Mountains, and Beatty/Belted Mountains Shoshone subsistence travels and inter-district festival relationships. Using Steward's data, criteria were established for field identification of Shoshone winter camps. Data review and field reconnaissance resulted in identifying six camps. Samples of obsidian tool manufacturing/maintenance debris collected from the sites …

Evidence For Virgin Anasazi Presence In The Las Vegas Valley And Adjacent Areas, Susanne Janine Rowe Jan 2002

Evidence For Virgin Anasazi Presence In The Las Vegas Valley And Adjacent Areas, Susanne Janine Rowe

UNLV Retrospective Theses & Dissertations

Olivine-tempered ceramics are a characteristic artifact of Virgin Anasazi culture. The ceramics are found in the Las Vegas area, more than 70 km west of permanent Anasazi settlements in the Moapa Valley. Little is known regarding Anasazi utilization of this area, since most investigators have focused on the permanent settlements. I examined 25 ceramic assemblages from the Las Vegas vicinity, calculated the frequencies of olivine-tempered sherds in each, and noted the geographical distribution of the wares. The evidence does not support down-the-line exchange, but shows concentrations of olivine-tempered wares in the north Las Vegas Valley, Paradise Valley, and further west …

Maternal And Child Health Services Utilization By Hispanics In Alabama, Fausto Guillermo Patino

All ETDs from UAB

The Hispanic population in Alabama has rapidly increased in recent years, raising public health officials' concern about their health status and use of health care services. This study examined health services' utilization by first-generation Hispanic mothers and children in greater Birmingham. Constructs from the Health Belief Model and the Behavioral Model of Health Services Utilization were integrated to form the study's theoretical framework. The cross-sectional study included a questionnaire orally administered to 227 Hispanic mothers recruited via location and snowball sampling; questions focused on mothers and their youngest child between the ages of 6 months and 5 years (an index …

Economics, Public Choice, And The Perennial Conflict Of Laws, Erin O'Connor Jan 2002

Economics, Public Choice, And The Perennial Conflict Of Laws, Erin O'Connor

Vanderbilt Law School Faculty Publications

This piece is a response to an article by Andrew Guzman, which proffers an efficiency framework for choice-of-law problems in interjurisdictional conflicts. The response incorporates insights from public choice theory into choice of law to draw two conclusions. First, public choice theory confounds our attempts to draw normative conclusions about efficient choice-of-law policies. Second, assuming that we can overcome these difficulties to ascertain the content of efficient choice-of-law policies, public choice theory exposes the practical difficulties of moving courts toward more efficient choice-of-law decisions. In short, the problem is both more difficult and more elusive than others, including Guzman, have …

On Apology And Consilience, Erin O'Connor Jan 2002

On Apology And Consilience, Erin O'Connor

Vanderbilt Law School Faculty Publications

This article chimes in on the current debate about the proper relationship between apology and the law. Several states are considering legislation designed to shield apologies from the courtroom, and mediators are increasing their focus on the importance of apologies. The article develops an evolutionary economic analysis of apology that combines the tools of economics, game theory and biology to more fully understand its role in dispute resolution. When the analysis is applied to the uses of apology before and at trial, a more sophisticated understanding of the relationship between apology and the law emerges.

An Introduction To The Kirtland Flats Ashery, Benjamin C. Pykles Jan 2002

An Introduction To The Kirtland Flats Ashery, Benjamin C. Pykles

BYU Studies

Reflecting a recent resurgence of interest in one of its most important historic spaces, The Church of Jesus Christ of Latter-day Saints is currently restoring a number of historic structures in Kirtland, Ohio, including buildings in the lowland area known as Kirtland Flats (fig. 1). These buildings are part of a major restoration plan designed to significantly increase the quantity and quality of historical interpretation at the site by introducing visitors to the major doctrinal and historical developments of the Church during the seven years its followers resided in Kirtland (1831-1838).

Breaching Moral Rights: Is There A Legal Remedy?, Rebekah Powell Jan 2002

Breaching Moral Rights: Is There A Legal Remedy?, Rebekah Powell

Dalhousie Journal of Legal Studies

Throughout the history of the theatre there have been various interpretations of dramatic work that, arguably, have not followed the original vision of the playwright. Do modem Canadian playwrights have a better chance of controlling the production of their plays? The original copyright for a play belongs to the playwright who may sell or assign it. In addition, the playwright has moral rights to the play, which are inalienable but may be waived. The essence of these rights is the ability to protect one's work from being altered, distorted or presented as the work of another. Here, the various legal …

Application Of A Rational Model In Gis For Flood Risk Assessment In Accra, Ghana Jan 2002

Application Of A Rational Model In Gis For Flood Risk Assessment In Accra, Ghana

Journal of Spatial Hydrology

Accra has been experiencing periodic flooding that affect properties and lives. The government seeing the dangers involved has commissioned institutions such as Ministry of Works and Housing, Town and Country Planning and City Engineers to identify flood risk zones and adapt measures that will help reduce flood damages. These institutions identify flood risk zones using conventional methods such as watermarks on buildings and reported cases in the news media. Works carried out by these agencies were not able to give details about potential areas that are likely to experience this extreme event. Hence there was the need to find a …
