Perceptions Of The Quality Of Life Among Residents Of Crete, Nebraska, James Potter, Rodrigo Cantarero, X. Winston Yan, Steven Larrick, Blanca E. Ramirez, Heather Keele

Community and Regional Planning Program: Faculty Scholarly and Creative Activity

Crete, Nebraska, (population 6,028) is on the cutting edge of a global economy in which people are migrating to places that offer jobs and a better quality oflife. In the year 2001, when this study was conducted, Crete's local Farmland pork processing plant was expecting to increase its workforce from 1,200 to 1,650. In today's economy, these 450 new jobs are likely to attract workers from around the world. In recent years, for example, workers have come to Crete from Vietnam, Korea, Laos, Croatia, Serbia, Iraq, and from countries throughout Latin America.

Festo'S Effect On After-Arising Technology And The Doctrine Of Equivalents, Anthony H. Azure

In Festo Corp. v. Shoketsu Kinzoku Kogyo Kabushiki Co., the Federal Circuit adopted a strict approach to prosecution history estoppel and thereby limited the availability of the doctrine of equivalents to patentees suing for infringement by after-arising technology. The court held that when a narrowing claim amendment creates prosecution history estoppel, the amended claim element maintains no range of equivalents and therefore the patentee is completely barred from applying the doctrine of equivalents. The court rejected the flexible approach, which allows a scope of equivalents even after a narrowing claim amendment. This Note argues that the Supreme Court should …

Pursuing Environmental Justice Through The Courts: An Overview Of The Process And Why It Has Failed, Julie Lynne Hershenberg

IPED Technical Reports

This project brought together two issues that dominate policy debates in the southwestern U.S. and especially along the United States – Mexico Border; namely, environmental justice, and legal liabilities associated with adverse environmental actions. Both are major implementation problems. In the southwest the issue becomes more problematic as the two-nations meet face-to-face, and the maquiladora industry continues to expand, creating new burdens on an already stressed environment as a result of industrial practices that have not always meet U.S. environmental standards.

An Unusual Airglow Waveevent Observed At Cachoeira Paulista 23°S, A. F. Medeiros, Michael J. Taylor, H. Takahashi, P. P. Batista, D. Gobbi

An all-sky CCD airglow imager has been used to obtain a wealth of data on the MLT airglow emissions from Cachoeira Paulista, Brazil (22.7° S, 45.0° W). Measurements of the NIR OH, OI(557.7 nm), O2(0,1) and the thermospheric OI(630.0 nm) emissions have been made since October 1998. In addition, simultaneous measurements of the airglow zenith intensities and rotational temperatures, and vertical wind structure between 80 and 100 km were made using a co-located multi-channel photometer and a meteor radar. Vascular Flora Of Van Horn Woods, Plainfield Township, Will County, Il, Joseph Traina

The vascular flora at Van Horn Woods Park was surveyed during the 1998-2000 growing seasons. This park is a 30 hectare site located in Plainfield Township, Will County, Illi- nois (SE1/4 S27 T36N R9E). A total of 246 taxa, representing 160 genera and 67 fami- lies, were identified within or immediately adjacent to the park. Seventy-one percent of these taxa were native. Four taxa were collected and submitted to the Morton Arboretum as new county records for Will County. The quality of this site as a natural area was also assessed using quantitative methods based on floral composition and diversity. …

Emergency Preparedness From A Health Perspective: Preparing For Bioterrorism At The Federal, State, And Local Levels, Robin J. Strongin

National Health Policy Forum

Despite the good intentions prior to and in the aftermath of the terrorist attacks of September 11, 2001, the existence of significant gaps in the country's preparedness became increasingly clear in the weeks that followed. This background paper provides an overview of the state of bioterrorism preparedness at all levels of government, identifying both the gaps and the steps being taken to close them. A series of reference materials, including a suggested reading list and Web site addresses, are listed at the end of the paper.

Olmstead V L.C.: Federal Implementation Guidelines, And Analysis Of Recent Cases Regarding Medicaid Coverage Of Long Term Care Services For Persons With Disabilities, Sara J. Rosenbaum

Health Policy and Management Issue Briefs

This analysis reviews the key elements of the United States Supreme Court's 1999 decision in Olmstead v L.C. as well as Federal implementation guidelines issued by the United States Department and Human Services. The Olmstead decision interprets the Americans with Disabilities Act ("ADA," PL 101-336), whose requirements apply to the use of all public funds. However, Medicaid represents the single largest source of public funding for both institutional and non-institutional services for persons with disabilities. As a result, when states expend Medicaid funds on care for persons with disabilities, two independent sets of legal requirements are triggered: those contained in …

Effect Of Surface Charges On The Rates Of Intermolecular Electron-Transfer Between De Novo Designed Metalloproteins, Anna Y. Kornilova, James F. Wishart, Michael Y. Ogawa

A de novo designed coiled-coil metalloprotein was prepared that uses electrostatic interactions to control both its conformational and bimolecular electron-transfer properties. The title protein exists as a coiled-coil heterodimer of the [Ru(trpy)(bpy)-KK(37-mer)] and [Ru(NH3)(5)-EE(37-mer)] polypeptides which is formed by interhelix electrostatic attractions. Circular dichroism studies show that the electrostatic heterodimer has Kd 0.19 +/- 0.03 muM and is 96% helical at high concentrations. Intercomplex electron-transfer reactions were studied that involve the [Ru(NH3)(5)-H21](2+) electron-donor and the [Ru(trpy)(bpy)H21](3+) electron-acceptor belonging to different electrostatic dimers.
