Observations Of Persistent Leonid Meteor Trails. 1. Advection Of The "Diamond Ring", Jack D. Drummond, Brent W. Grime, Chester S. Gardner, Alan Z. Liu, Xinzhao Chu, Timothy J. Kane

From a single image of a persistent trail left by a -1.5 magnitude Leonid meteor on November 17, 1998, the relative winds between 92.5 and 98 km altitude are derived, where the altitudes are determined by a sodium lidar. These are converted to true winds 82 sec after the appearance of the meteor by fixing the winds at 98 km to match the results of following the trail with the lidar for twelve minutes. The image and winds reveal a fine example of the effects of a gravity wave having a vertical wavelenth of 5.50 ± 0.02 km, a horizontal …

Assessing Causation In Breast Implant Litigation: The Role Of Science Panels, Laural L. Hooper, Joe S. Cecil, Thomas E. Willging

Law and Contemporary Problems

In two recent cases, federal judges appointed panels of scientific experts to help assess conflicting scientific testimony regarding causation of systemic injuries by silicone gel breast implants. This article will describe the circumstances that gave rise to the appointments, the procedures followed in making the appointments and reporting to the courts, and the reactions of the participants in the proceedings.

Too Many Probabilities: Statistical Evidence Of Tort Causation, David W. Barnes

Law and Contemporary Problems

Medical scientific testimony is often expressed in terms of two different probabilities: 1. The increased probability of harm if a person is exposed, for example, to a toxin. 2. The observed relationship is an artifact of the experimental method. This article demonstrates that neither probability, taken alone or together, measures whether the "preponderance of the evidence" test is met.

How Do Forecasts Respond To Changes In Monetary Policy?, Laurence Ball, Dean D. Croushore

Just as changes in atmospheric conditions affect weather forecasts, changes in monetary policy affect economic forecasts. When monetary policy shifts, forecasters change their predictions about growth and inflation. But does the economy change to the same extent that forecasts do? In this article, Laurence Ball and Dean Croushore examine forecasts from the Survey of Professional Forecasters to determine if forecasts and the economy respond in tandem or if there are significant differences.

The Fine Structure Of The Kasparov Groups I: Continuity Of The Kk-Pairing, Claude Schochet

Mathematics Faculty Research Publications

In this paper it is demonstrated that the Kasparov pairing is continuous with respect to the natural topology on the Kasparov groups, so that a KK-equivalence is an isomorphism of topological groups. In addition, we demonstrate that the groups have a natural pseudopolonais structure, and we prove that various KK-structural maps are continuous.

A Comment On Language And Norms In Complex Business Contracting, Claire A. Hill

Complex contracts, such as those governing loans and acquisitions, create a state of the world-parties entering into a contract thereby become bound. The contract expressly summons up legal consequences for every promise it contains. But the relationship between the promises and the law's force is attenuated. Very often contract provisions set the stage rather than provide the script: accommodation seems more the rule than the exception. Indeed, for most contracting parties, the law's specter is one of many reasons to do what they promised to do, and often, not the most important reason. Why Contracts Are Written In "Legalese", Claire A. Hill

Contracts have been reviled since before the Marx Brothers' infamous "there ain't no Sanity Clause" sketch as being replete with duplicative, cumbersome, inartful, and sometimes imprecise language. My Article seeks to understand why practice apparently hasn't made perfect—why the contract production process hasn't been honed to a point that contracts are as clear, and only as long, as would seem to be optimal. I argue that the contracting production process combines rational, and what some would consider irrational, elements to create a serviceable, but arguably second-best, product. This Article focuses on the conventional theory that a corporation is owned by its stockholders and argues that the theory retains little if any explanatory or predictive force. After a brief consideration of the need for and function of legal theories in general and the evolution of the stockholder ownership theory, the Article proceeds to describe how the takeover wars of the 1980s brought into high relief the unavoidably conflicting interests of stockholders and managers, owing primarily to the fact that investor-stockholders are free to diversify whereas managers generally are not.
