The First Amendment Versus The World Trade Organization: Emergency Powers And The Battle In Seattle, Aaron Perrine Apr 2001

The First Amendment Versus The World Trade Organization: Emergency Powers And The Battle In Seattle, Aaron Perrine

Washington Law Review

The 1999 World Trade Organization (WTO) ministerial meeting in Seattle was the target of highly organized, widely supported protest demonstrations. In response to the protests, city officials declared a state of emergency, ordering nighttime curfews and a daytime "no-protest zone" in downtown Seattle. They reasoned that the zone was necessary to protect the rights of WTO delegates and to restore public order. This Comment argues that mass nonviolent protests deserve more First Amendment protection than was afforded to demonstrators in Seattle. Even when violence occurs and public order is threatened, governments must narrowly tailor emergency orders to avoid trampling on …

Rethinking The Sentencing Regime For Murder, Isabel Grant Apr 2001

Rethinking The Sentencing Regime For Murder, Isabel Grant

Osgoode Hall Law Journal

This article reviews the current sentencing regime for the crime of murder in Canada with a view to identifying its shortcomings and suggesting possibilities for improvement. The article argues that the existing classification of murder into first- and second-degree, and the harsh periods of parole ineligibility attached to a murder conviction should both be abolished. The author argues for a compromise position, which would maintain the important distinction between manslaughter and murder and yet allow sufficient flexibility for trial judges to ensure that sentences for murder, as with other crimes, can be tailored to fit the crime.

Driving In Massachusetts: When To Stop And Who Should Decide?, Nina M. Silverstein, Jenai Murtha Apr 2001

Driving In Massachusetts: When To Stop And Who Should Decide?, Nina M. Silverstein, Jenai Murtha

Gerontology Institute Publications

The purpose of this exploratory research was to assess three stakeholders’ perceptions of the locus of responsibility for driving cessation and identify the criteria that should be included in that decision. The stakeholder groups studied were law enforcement officers, physicians, and the general public age 50 years and older. Defining areas of agreement and disagreement across stakeholders will be valuable for informing policy makers who may be considering statewide or national initiatives. Findings will also be useful for public information and training.

An Empirically Based Comparison Of American And European Regulatory Approaches To Police Investigation, Christopher Slobogin Apr 2001

An Empirically Based Comparison Of American And European Regulatory Approaches To Police Investigation, Christopher Slobogin

Vanderbilt Law School Faculty Publications

This article takes a comparative and empirical look at two of the most significant methods of police investigation: searches for and seizures of tangible evidence and interrogation of suspects. It first compares American doctrine regulating these investigative tools with the analogous rules predominant in Europe (specifically, England, France and Germany). It then discusses research on the American system that sheds light on the relative advantages and disadvantages of the two regulatory systems. More often than not, the existing data call into question preconceived notions of what "works." In particular, American reverence for search warrants, the exclusionary rule, and "Miranda" warnings …

Parental Responsibility For Juvenile Crime, J. Herbie Difonzo Apr 2001

Parental Responsibility For Juvenile Crime, J. Herbie Difonzo

Hofstra Law Faculty Scholarship

In Part I, this Article analyzes the "criminalization" of juvenile delinquency. The juvenile justice counter-reformation has made substantial headway in reversing the idea of special protections for children who are accused of committing serious crimes. But the debate over how to deal with violent youth has been drastically reshaped over the past century. Earlier reforms minimized punishment and emphasized therapeutic intervention in the children's lives. The current retributive juvenile justice movement, by contrast, features assertions about a dramatic increase in the present rate and malevolence of juvenile crime, demographic estimates that predict a coming flood of "super-predators,"1 and the thesis …

Disarming Canadians, And Arming Them With Tolerance: Banning Firearms And Minimum Sentences To Control Violent Crime--An Essay On An Apparent Contradiction, Helene Dumont Apr 2001

Disarming Canadians, And Arming Them With Tolerance: Banning Firearms And Minimum Sentences To Control Violent Crime--An Essay On An Apparent Contradiction, Helene Dumont

Osgoode Hall Law Journal

In an article published in French in 1997, the author offered reflections on feminism and criminal law that would allow for a better control of violent crime, without Parliament having to resort to excessively severe sentences. In this respect, she argued that there was no contradiction in supporting the radical ban of firearms in Canada, while opposing a minimum sentence of four years under the Firearms Act, which currently affects approximately ten serious Criminal Code offences. After setting out her position in favour of the "disarmament" of Canadians, the author argued that minimum sentences of four years were unconstitutional. Such …
