A Model Of Precipitation Rates In Kentucky, 1965-1996, Kevin Cary
A Model Of Precipitation Rates In Kentucky, 1965-1996, Kevin Cary
Masters Theses & Specialist Projects
Hourly precipitation data from thirty cooperative stations in Kentucky from 1965 to 1996 were used to determine the diurnal distribution of precipitation rates. Descriptive summaries for the diurnal distribution for each climate division in Kentucky and for Kentucky as a whole were calculated. In each case, the trends were similar. Precipitation rates increased into the afternoon and then decreased until sunrise. A stochastic model was developed to estimate mean seasonal precipitation rates in Kentucky by using regional and localized parameters. More than half of the variation (r2 = 0.57) in precipitation rates can be explained by the following variables: 1) …
Positive Possibilities For Child And Family Welfare: Options For Expanding The Anglo-American Child Protection Paradigm, Gary Cameron, Nancy Colleen Freymond, Denise Cornfield, Sally Palmer
Positive Possibilities For Child And Family Welfare: Options For Expanding The Anglo-American Child Protection Paradigm, Gary Cameron, Nancy Colleen Freymond, Denise Cornfield, Sally Palmer
Partnerships for Children and Families Project
The creation of the ‘problem of child maltreatment’ and how we deal with it are best understood as particular discourses which grow out of specific histories and social configurations. The Anglo-American child protection paradigm can be viewed as a particular configuration rooted in our vision for children, families, community, and society. However, other settings have constructed quite different responses reflecting their own priorities and desired outcomes. This paper is an effort to understand the choices made in Ontario’s child protection system by examining its history and the underlying beliefs and values which have fostered its development. In addition, the paper …

The Duty Concept In Negligence Law: A Comment, Robert L. Rabin
The Duty Concept In Negligence Law: A Comment, Robert L. Rabin
Vanderbilt Law Review
As critics John Goldberg and Benjamin Zipursky see it, the draft version of the Restatement (Third) of Torts: General Principles (Discussion Draft) ("Discussion Draft") that is the occasion for this Symposium has relegated the duty issue in negligence law to a relatively minor, nay-saying role. More particularly, duty is not directly mentioned by the Reporter in Section 3, which provides that "[a]n actor is subject to liability for negligent conduct that is a legal cause of physical harm.' And in Section 6, when the Reporter does get around to addressing the subject of duty, it is in arguably backhanded, no-duty …
Personal Does Not Always Equal "Private": The Constitutionality Of Requiring Dna Samples From Convicted Felons And Arrestees, Martha L. Lawson
Personal Does Not Always Equal "Private": The Constitutionality Of Requiring Dna Samples From Convicted Felons And Arrestees, Martha L. Lawson
William & Mary Bill of Rights Journal
In the past couple of decades, the use of DNA testing has become a major debate in criminal law. Many Americans have called for regular use of DNA testing in criminal cases, particularly in the aftermath of the O.J. Simpson murder trial. While these tests can potentially help better ensure justice conducting DNA tests raises fundamental personal privacy concerns. This Note analyzes the development of DNA testing throughout the United States, giving a historical account of how the courts and local police departments have dealt with this testing Finally, the Note argues that the government's interest in mandatory testing of …
The Repercussions In The European Union Of The Netherlands' Same-Sex Marriage Law, Nicholas J. Patterson
The Repercussions In The European Union Of The Netherlands' Same-Sex Marriage Law, Nicholas J. Patterson
Chicago Journal of International Law
On September 12, 2000, by a lopsided 190 to 33 vote in the lower house of Parliament, the Netherlands became the first country to allow same-sex couples to marry on the same terms as heterosexual couples. The measure had the support of all of the parties in the ruling coalition and even some members of the conservative opposition. On December 19, 2000, the marriage law was approved by the upper house of parliament by a vote of 49 to 26.2 After approval by the upper house, the bill was signed into law by Queen Beatrix on December 21, 2000, and …

Contract And Care, Martha Albertson Fineman
Contract And Care, Martha Albertson Fineman
Chicago-Kent Law Review
The current social contract between individuals and society is flawed. The background rules in the social contract have changed as society changes; however, the social contract has not reflected those changes. Individuals and families have no one to help them with caretaking as the existing social contract does not recognize the burdens of caretaking. Society has a responsibility to help individuals with their dependency responsibilities as part of the social contract.
Treading The Thin Blue Line: Military Special-Operations Trained Police Swat Teams And The Constitution, Karan R. Singh
Treading The Thin Blue Line: Military Special-Operations Trained Police Swat Teams And The Constitution, Karan R. Singh
William & Mary Bill of Rights Journal
The increasing use of SWAT teams and paramilitary force by local law enforcement has been the focus of a growing concern regarding the heavy-handed exercise of police power. Critics question the constitutionality of joint-training between the military and civilian police, as well as the Fourth Amendment considerations raised by SWAT tactics. This Note examines the history, mission, and continuing need for police SWAT teams, addressing the constitutional issues raised concerning training and tactics. It explains how SWAT joint-training with the military is authorized by federal law and concludes that SWAT tactics are constitutionally acceptable in a majority of situations. Though …

Court Review: Journal of the American Judges Association
There are currently as many as 13 million illegal immigrants in the United States; 5 million are illegal Mexican immigrants, with 46,000 living in my home state of Colorado. There is a push by the Mexican government at both the state and federal levels to change the legal status of those immigrants. President Vicente Fox of Mexico recently added the issue of permitting undocumented migrants to apply for a driver’s license to his agenda for a meeting with governors from the United States. On the federal level, President Bush is now weighing plans to grant legal residency to Mexican illegal …

India: Implementing Sex Equality Through Law, Martha C. Nussbaum
India: Implementing Sex Equality Through Law, Martha C. Nussbaum
Chicago Journal of International Law
This Article will use the case of sex equality in India to argue for an intermediate position. Usually, and on balance, I shall argue, the Kantian position is the wisest: norms are meaningful and stable only when they are adopted freely from within. Moreover, the nation is the largest unit we currently have that is sufficiently accountable to people's voices to be a legitimate vehicle of their most important concerns. On the other hand, there is much to be said about what nations do well and not so well in this area, and the case of India does provide occasion …
