The Rule Of Law And The Legitimacy Of Constitutional Democracy, Michel Rosenfeld Jul 2001

The Rule Of Law And The Legitimacy Of Constitutional Democracy, Michel Rosenfeld

Articles

The rule of law is a foundational principle of constitutional democracy, requiring the state to govern through publicly promulgated laws, separate legislative and adjudicative functions, and ensure accountability for all. While the rule of law is essential for legitimate governance, its meaning and implementation remain contested, varying significantly across legal traditions such as the Anglo-American rule of law, German Rechtsstaat, and French état de droit. The article argues that while the rule of law in its narrow sense—emphasizing legal predictability and procedural fairness—is insufficient for legitimate constitutional democracy, it must also incorporate democratic accountability and substantive rights protection to address …

A Study On The Learning Styles Of Limited English Proficiency Students, Linda J. Clay Jul 2001

A Study On The Learning Styles Of Limited English Proficiency Students, Linda J. Clay

Masters Theses

Limited English Proficiency (LEP) students are not attaining academic success in public schools. Enrollment of Hspanic students is increasing, but at the same time assessment of their work shows little achievement. A crucial issue in the education of language minority students is how they learn. This thesis examines their learning style preferences through data gathered from student and teacher surveys and then correlates it to existing research. The conclusion drawn is that Hispanic LEP students are not being taught in their preferred learning styles and that the primary manner of verbal/linguistic instruction used in schools is a deterrent to successful …

Minimum Mean Square Error Spectral Peak Envelope Estimation For Automatic Vowel Classification, Jaishree Venugopal Jul 2001

Minimum Mean Square Error Spectral Peak Envelope Estimation For Automatic Vowel Classification, Jaishree Venugopal

Electrical & Computer Engineering Theses & Dissertations

Spectral feature computations continue to be a very difficult problem for accurate machine recognition of speech. In this work, which focuses on vowels, a new spectral peak envelope method for vowel classification is developed, based on a missing frequency components model of speech recognition. According to the missing frequency components model, vowel recognition depends only on the spectral (harmonic) peaks. Smoothing and interpolation of the spectra, performed in the standard cepstral analysis method commonly used in automatic speech recognition, actually loses valuable information and results in reduced recognition accuracy. The new method for feature extraction presented in this thesis is …

Is The Overrepresentation Of Minorities In Special Education An Undesirable Consequence Of The 1975 Education For Aii Handicapped Children Act (P.L. # 94-142) And Its Amendments?, Eve M. Toomey

Theses and Graduate Projects

Research studies have shown that there is a disproportionate number of minority students being identified as needing special education services. This research study examined special education policy as it has evolved overtime, beginning with the 1975 Education for All Handicapped Children Act through the 1997 amendments to this Act to determine if special education law has contributed to the over representation of minorities in special education.

This historical policy analysis was performed by utilizing congressional logs between 1974 and 1997 as well as examining copies of the pertinent policies themselves. The study has found that special education policies have adequate …

Each group was administered a pretest and a posttest to determine if changes took place. …

The Impact Extended Day Instruction Has On The Academic Achievement Of At-Risk Low Socioeconomic Students, Diane L. Worthy Jun 2001

The Impact Extended Day Instruction Has On The Academic Achievement Of At-Risk Low Socioeconomic Students, Diane L. Worthy

Theses and Dissertations

This study determines whether students from low socio-economic backgrounds, who function poorly on tests and report cards, improved academically after increasing time for instruction, and time for working on school related tasks. Research indicates that there is a relationship between time and learning. When distinctions have been made with time allocated for instruction, time engaged in instructional activities and time spent successfully completing instructional activities, the latter of these has been found to have a direct correlation with achievement. Participants worked after school on homework with certified teachers. Factors affecting student achievement in language arts have been identified. The academic …

Findings suggest that several barriers exist to the recruitment and retention of people of color in the social work field such as racism, lack of support, and lack of understanding of cultural differences. The findings illustrate that …

The Design Of Fuzzy Collision-Avoidance Expert System Implemented By H∞ - Autopilot, Cheng-Neng Hwang, Joe-Ming Yang, Chung-Yen Chiang Jun 2001

The Design Of Fuzzy Collision-Avoidance Expert System Implemented By H∞ - Autopilot, Cheng-Neng Hwang, Joe-Ming Yang, Chung-Yen Chiang

Journal of Marine Science and Technology–Taiwan

Collision avoidance is one of the urgent topics on ship voyage at sea. Experts’ experience is still essential when a ship is in the danger of colliding with the others nowadays although a lot of electronic voyage supported apparatuses have been equipped on ships. To include these experts’ experiences to resolve the problems of collision, we design a fuzzy collision-avoidance expert system that includes a knowledge base to store facts and rules, an inference engine to simulate experts’ decision and a fuzzy interface device. Either a quartermaster or an autopilot system can then implement the avoidance action proposed in the …

One theme - healing - was traced throughout the participants' narratives and was verified through excerpts from the texts of their interviews. Discussion of related literature expanded the interpretations presented. Implications for social work practice and policy …
