Re-Imagining International Human Rights Education In Our Time: Beyond Three Constitutive Orthodoxies, Obiora Chinedu Okafor, Shedrack C. Agbakwa Jan 2001

Re-Imagining International Human Rights Education In Our Time: Beyond Three Constitutive Orthodoxies, Obiora Chinedu Okafor, Shedrack C. Agbakwa

Articles & Book Chapters

This article seeks to show that both the conceptualization and practice of international human rights education within the mainstream human rights community has been shaped and framed, with mostly negative consequences, by at least three constitutive orthodoxies: a heaven-hell binary distinction between an all but "perfect" West and an all but "hellish" Third World, a consequent unidirectional traffic of human rights teaching from the West to the rest, and a reliance on the abolitionist paradigm of human rights education. It starts by mapping these orthodoxies, and proceeds thereafter to challenge them as fundamentally problematic and as capable of frustrating the …

Middle-Class Black Suburbs And The State Of Integration: A Post-Integrationist Vision For Metropolitan America, Sheryll Cashin Jan 2001

Middle-Class Black Suburbs And The State Of Integration: A Post-Integrationist Vision For Metropolitan America, Sheryll Cashin

Georgetown Law Faculty Publications and Other Works

Despite the gradual move towards integration in the United States, segregated communities, divided along socio-economic and racial lines, continue to exist, and indeed have taken on new forms. Given the choice between racial segregation and integration as minority members of a community, some middle-class African Americans have chosen to create their own communities, thus forming the modern day middle-class black suburb. Now, majority African-American suburbs rest adjacent to majority-white suburbs, but the segregated communities share little but the town line.

In this Article, Professor Cashin addresses the timely and difficult question of whether the middle-class black suburb is a new …

The Market For Medical Ethics, Maxwell Gregg Bloche Jan 2001

The Market For Medical Ethics, Maxwell Gregg Bloche

Georgetown Law Faculty Publications and Other Works

At the core of Kenneth Arrow’s classic 1963 essay on medical uncertainty is a claim that has failed to carry the day among economists. This claim—that physician adherence to an anti-competitive ethic of fidelity to patients and suppression of pecuniary influences on clinical judgment pushes medical markets toward social optimality—has won Arrow near-iconic status among medical ethicists (and many physicians). Yet conventional wisdom among health economists, including several participants in this symposium, holds that this claim is either naïve or outdated. Health economists admire Arrow’s article for its path-breaking analysis of market failures resulting from information asymmetry, uncertainty, and moral …

Self-Defense And Subjectivity, Victoria Nourse Jan 2001

Self-Defense And Subjectivity, Victoria Nourse

Georgetown Law Faculty Publications and Other Works

The law of self-defense has rarely produced as much academic or popular heat as it has in the past two decades. Widely publicized trials, such as the Goetz and Menendez cases, have generated deep-seated fears of a law unmoored from principle. Those fears have generated a standard public critique--that the criminal law has become too soft and subjective, too wedded to syndrome science and prone to weak-kneed affection for defendants. The criminal law has lost its "objectivity," so the argument goes. The poster child, and even the alleged cause of this development, is the battered woman.

In this article, the …

Leaders Pray With The Assembly, E Louise Williams Jan 2001

Leaders Pray With The Assembly, E Louise Williams

Institute of Liturgical Studies Occasional Papers

(Excerpt)

I wonder what it was that prompted the disciples' request. Had they watched Jesus praying, as was his custom, in a place apart and then seen him come back somehow changed-more refreshed, more serene, more focused, more disturbed? Had they overheard Jesus praying-the intimate conversation, the wrestling and struggle, the thanksgiving and praise, the intercessions? Had they remembered some admonition or invitation to pray? Did their own spirits feel dry and empty? Did they know some longing deep inside for a closer communion with the one Jesus called Abba? Was there in them some joy or anguish that needed …

Internet Pharmacies: Cyberspace Versus The Regulatory State , Ty Clevenger Jan 2001

Internet Pharmacies: Cyberspace Versus The Regulatory State , Ty Clevenger

Journal of Law and Health

The unique qualities of e-commerce make it difficult to regulate under any circumstances, but the growth of online pharmacies in particular is far outpacing the ability of government officials to investigate and enforce existing drug laws. In 1999, Americans spent an estimated $44 million purchasing prescription drugs from online pharmacies, a figure that is projected to reach $1 billion per year by 2003. In December of 1999, President Clinton proposed $10 million in new funding for the FDA to regulate Internet pharmacies and hire 100 new employees, but the FDA has yet to explain whether this would be enough to …

Can Employers Put Genetic Information To Good Use, Kathleen C. Engel Jan 2001

Can Employers Put Genetic Information To Good Use, Kathleen C. Engel

Journal of Law and Health

In my talk today I am going to try to answer the question: Can employers put genetic information to good use? Preparing this talk was a challenge because it required me to switch sides of the table. Having represented plaintiffs in employment discrimination cases for ten years, my inclination is to focus on the ways that employers can use genetic information to the detriment of their workers. I chose to talk about the value of genetic information from the employers' perspective because I wanted to force myself to engage in a disciplined study of the issues, rather than simply don …

Cyprus In Europe: Seizing The Momentum Of Nice, Patrick R. Hugg Jan 2001

Cyprus In Europe: Seizing The Momentum Of Nice, Patrick R. Hugg

Vanderbilt Journal of Transnational Law

In December 2000 the European Council Summit in Nice fulfilled the promise for European Union enlargement made at the Helsinki Summit the year before. The leaders of the EU Member States reaffirmed their commitment to the accession of the applicant countries, making possible the broad re-unification of the continent under democratic rule of law and free market economies. This Article focuses specifically on the accession of the island of Cyprus, Europe's remaining divided state, poised strategically between East and West. The island's armed stand-off presents the clearest example of legal conflict between two ethnic communities in a discrete geographical territory, …

Hiding Behind Nakedness On The Nude Beach, Lelia Rosalind Green Jan 2001

Hiding Behind Nakedness On The Nude Beach, Lelia Rosalind Green

Research outputs pre 2011

This paper draws upon a series of experiences between 1980-85, when I identified as a naturist during my summer holidays in Europe, and in a visit to Wreck Beach in Vancouver (where I felt very much at home). At the time, I was aware that nude beaches were much less threatening to me as a large woman than are conventional 'textile' beaches. This paper draws upon those experiences to theorise why this might be the case, and why I have been absent from beach culture for much of the past decade.
