The Wto As A Legal System, David Palmeter
The Wto As A Legal System, David Palmeter
Fordham International Law Journal
Part I describes Hart's view of the primary and secondary rules that are necessary for the existence of a modern legal system. Part II examines his view of international law, as resembling a primitive legal system. Part III evaluates the GATT legal system according to Hart's criteria for a modern legal system, while Part IV will do the same for the World Trade Organization (“WTO”). Part V will conclude with an evaluation of the WTO legal system.

Wto Blue-Green Blues: The Impact Of U.S. Domestic Politics On Trade-Labor, Trade-Environment Linkages For The Wto's Future, Gregory Schaffer
Fordham International Law Journal
Part I of this Article provides a brief overview of the dominant discourse on linkages, which focuses on whether World Trade Organization (“WTO”) rules should be modified (or interpreted) to permit trade restrictions on environmental and labor rights grounds. Those fully familiar with the competing conventional approaches to trade-environment and trade-labor debates may either skim Part I or move directly to Part II. Parts II through V examine the political economy of trade-environment and trade-labor policy, particularly in the United States. Part II addresses the politics of trade-environment agenda setting and the reasons why U.S. critics more likely direct their …

The Standing Of Citizens To Enforce Against Violations Of Environmental Statutes In The United States, Jeffrey G. Miller
The Standing Of Citizens To Enforce Against Violations Of Environmental Statutes In The United States, Jeffrey G. Miller
Elisabeth Haub School of Law Faculty Publications
Judicial actions by private citizens have played a critical role in the development and enforcement of federal environmental law in the United States over several decades. The courts' general receptivity to the standing of private environmental plaintiffs has made that role possible. A troika of Supreme Court decisions on standing in environmental cases authored by Scalia J over the last decade had eroded that general receptivity, casting doubt on the continued vitality of private actions in developing and implementing environmental law. The Court's recent decision in Friends of the Earth Inc v Laidlaw Environmental Services halts this erosion. To explain …

Tagasaste Revolutionises Production In The West Midlands, Emma Davey
Tagasaste Revolutionises Production In The West Midlands, Emma Davey
Journal of the Department of Agriculture, Western Australia, Series 4
The need to find a sustainable and profitable alternative to annual pasture systems for the poor sands of the West Midland area led to the development and adoption of tagasaste (Chamaecytisus proliferus). Today, tagasaste is seen as having an integral role in the expansion of the cattle industry in the West Midlands. Emma Davey highlights the evolution of tagasaste research from producers experimenting with growing the fodder tree, to a funded research program looking at optimising cattle production on tagasaste.

Improving Productivity With Dairy Farm Performance, David Windsor, Ken Crawford, Stuart Gallagher, Vicki Staines
Journal of the Department of Agriculture, Western Australia, Series 4
How productive can a dairy farm be? What options are available to dairy farmers to increase their productivity and profitability? How can you reduce milk production costs effectively? These are the kinds of questions that dairy farmers are, or should be, asking leading up to and immediately after deregulation. These questions, and many more, can be answered by participating in Agriculture Western Australia's (AGWEST) Dairy Farm Performance (DFP) Program. David Windsor, Ken Crawford, Stuart Gallagher and Vicki Staines report on DFP and the benefits being generated for dairy farmers in Western Australia.
Planning For Protection Of Western Australian Agricultural Industries
Planning For Protection Of Western Australian Agricultural Industries
Journal of the Department of Agriculture, Western Australia, Series 4
Recent incursions of pests, diseases and weeds into Western Australia have demonstrated the need for agricultural industries to be better prepared for the future. A protection planning program introduced by Agriculture Western Australia has provided the process through which government and industry can come together to plan for potential threats on an industry by industry basis. HortGuard™, GrainGuard™, BeeGuard™ and StockGuard™ have been introduced to assist sectors within each industry to develop protection plans. Significant progress has already been made.

Tracked Vehicle Effects On Vegetation And Soil Characteristics, Chad W. Prosser, Kevin K. Sedivec, William T. Barker
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
A 3-year experiment to evaluate tracked vehicle effects on vegetation and soil characteristics was established on the Gilbert C. Grafton South State Military Reservation (CGS) in North Dakota. Study objectives were to evaluate the effects of 3 tracked vehicle use intensity treatments on plant species cover and frequency, and soil compaction. The 3 treatments evaluated include heavy use (74 passes), moderate use (37 passes) and no use. The moderate use treatment represents a typical use of 1 battalion unit at CGS with the heavy use treatment classified as 2 battalion units. This land area comprised a 50 by 150 meter …

Bovine Blastocyst-Derived Trophectoderm And Endoderm Cell Cultures: Interferon Tau And Transferrin Expression As Respective In Vitro Markers, Neil C. Talbot, Thomas J. Caperna, J. Lannett Edwards, Wes Garrett, Kevin D. Wells, Alan D. Ealy
United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications
Continuous cultures of bovine trophectoderm (CT-1 and CT- 5) and bovine endoderm (CE-1 and CE-2) were initiated and maintained on STO feeder cells. CT-1 and CT-5 were derived from the culture of intact, 10- to 11-day in vitro-produced blastocysts. CE-1 and CE-2 were derived from the culture of immunodissected inner cell masses of 7- to 8-day in vitro-produced blastocysts. The cultures were routinely passaged by physical dissociation. Although morphologically distinct, the trophectoderm and endoderm both grew as cell sheets of polarized epithelium (dome formations) composed of approximately cuboidal cells. Both cell types, particularly the endoderm, grew on top …

Game-based learning has been recognized as an important alternative to traditional method of teaching. It can help both adults and children in learning new concepts, gaining expertise and practicing knowledge. Though game-based learning is mostly applied in children's education, it can be helpful for adult vocational and university-level learning. Digital Game-based Learning: C++, which I prefer to refer to as Digital Game-based C++ Learning System is a web-based system that promotes learning C++ through games. It is the first of its kind whereby no programming language is to be learned through games. So, basically this system's objective to provide aid …

Future Of Adr - The Earl F. Nelson Memorial Lecture, The, Frank E. A. Sander
Journal of Dispute Resolution
Because I've been fortunate to observe the ADR scene for much of its recent development, I'm often asked my views of where we stand now. My somewhat flip answer is, "On Monday, Wednesday and Friday, I think we've made amazing progress. On Tuesday, Thursday and Saturday, ADR seems more like a grain of sand on the adversary system beach." So I think we have a way to go. Let me try to elaborate a little on those thoughts

Binding Of Urate And Caffeine To Hemocyanin Of The Lobster Homarus Vulgaris (E.) As Studied By Isothermal Titration Calorimetry., Michael Menze, Nadja Hellmann, Heinz Decker, Manfred Grieshaber
Faculty and Staff Scholarship
Hemocyanin serves as an oxygen carrier in the hemolymph of the European lobster Homarus Vulgaris. The oxygen binding behavior of the pigment is modulated by metabolic effectors such as lactate and urate. Urate and caffeine binding to 12-meric hemocyanin (H. Vulgaris) was studied using isothermal titration calorimetry (ITC). Binding isotherms were determined for fully oxygenated hemocyanin between pH 7.55 and 8.15. No pH dependence of the binding parameters could be found for either effector. Since the magnitude of the Bohr effect depends on the urate concentration, the absence of any pH dependence of urate and caffeine binding to oxygenated hemocyanin …
