Public Fora, Neutral Governments, And The Prism Of Property, Calvin Massey Jan 1999

Public Fora, Neutral Governments, And The Prism Of Property, Calvin Massey

UC Law Journal

The validity of speech restrictions on government property effectively depends upon the property's status as a public forum or not. Professor Massey asserts that this preoccupation with the forum status of public property occludes understanding of the real factors that guide the Court's resolution of the validity of such speech restrictions. In its public forum cases the Court is committed to two propositions: (1) speech on government property can interfere with legitimate non-speech uses of the property, and (2) the government's obligation is to remain neutral in public discourse, rather than to promote as much discourse as possible. Building on …

An Individual Approach To Suburban Racial Discrimination, Paul Boudreaux Jan 1999

An Individual Approach To Suburban Racial Discrimination, Paul Boudreaux

Fordham Urban Law Journal

The traditional model explaining racial discrimination has blamed discrimination by institutional actors in the housing industry and government. The author argues that this model ignores the individual preference factors that contribute to segregation. The replication of segregation in expanding suburban jurisdictions of metropolitan areas and the traditional legal responses are examined, as well as the implications of African American suburban migration. The author questions the adequacy of the traditional model by looking at the individual preference factors of both whites and African Americans that contribute to the replication of segregation in suburbs. The author notes that there is no method …

Consumer-Directed Prescription Drug Advertising: Effects On Public Health , William E. Holtz

Journal of Law and Health

This Paper will evaluate the effectiveness of the current FDA regulatory scheme regarding consumer-directed prescription drug advertising. Part II discusses the relevant history of consumer-directed prescription drug advertising of prescription drugs which is a relatively new practice in the United States. Possible explanations are reviewed for why the change in focus from physicians to consumers as the targets of such advertising has occurred. Part III explains the major classifications of consumer-directed advertising that the FDA has categorized and examines the differences existing among them. Part IV focuses on the current FDA regulatory scheme and begins to expose some of the …

Effect Of Hypoxia On The Respiratory Burst And Associated Bactericidal Activity In The Pronephritic Cells Of The Mummichog, Fundulus Heteroclitus, Kimberly Ann Boleza Jan 1999

Effect Of Hypoxia On The Respiratory Burst And Associated Bactericidal Activity In The Pronephritic Cells Of The Mummichog, Fundulus Heteroclitus, Kimberly Ann Boleza

MUSC Theses and Dissertations

Estuaries provide habitat and spawning grounds for numerous species of plants, birds, fish and shellfish. Levels of dissolved oxygen, carbon dioxide and pH in estuarine waters vary with diurnal, tidal and seasonal cycles. Anthropogenic factors may further exacerbate these variations in water quality. The studies presented here tested the hypothesis that hypoxia, including hypercapnia and acidosis, suppresses antibacterial defenses provided by phagocytic cells. The respiratory burst of phagocytic cells was stimulated with zymosan and Vibrio parahaemolyticus to produce Reactive Oxygen Species (ROS) which are potent antibacterial agents. The respiratory burst is oxygen dependent and therefore may be inhibited by hypoxic …

Attitude Change Of College Students Toward Older Adults, Heidi L. Funk Jan 1999

Attitude Change Of College Students Toward Older Adults, Heidi L. Funk

Honors Capstones

Attitude change of approximately 200 undergraduate students' attitudes towards the elderly was assessed. To measure attitude change a modified version of the Kogan Attitudes Toward Old People Scale (1961) was administered to college students at the beginning and end of the semester. The three courses varied in content regarding older adults and the aging process. The aging and the family class focused entirely on aging and required contact with an older adult. The human development class focused on the lifespan and included a segment on aging, while the child development class acted as the control group with no course content …

Food For Sport Or Faustian Bargain: Regulating Performance Enhancing Dietary Supplements, Jennifer Kay Braman Jan 1999

Food For Sport Or Faustian Bargain: Regulating Performance Enhancing Dietary Supplements, Jennifer Kay Braman

Cleveland State Law Review

The defining line between legal and illegal substance-between dietary supplement and drug is horribly skewed. Accordingly, Part I of this Note will investigate the complexities that exist with regard to the classification and regulation of dietary supplements, looking at the history leading to the passage of the governing Dietary Health and Supplement Act of 1994. Part II will focus on supplements that consumers may use for performance enhancement purposes, and the regulation of sports products. Part III will look at the regulatory debate over dietary supplements, the andro product example and the interrelationship between drugs and sport. Part IV will …

Biased Justice: Humanrightsism And The International Criminal Tribunal For The Former Yugoslavia , Robert M. Hayden Jan 1999

Biased Justice: Humanrightsism And The International Criminal Tribunal For The Former Yugoslavia , Robert M. Hayden

Cleveland State Law Review

This article thus takes a close look at one of the most important of the elements of the new international legal order which human rights activists promote, the International Criminal Tribunal for the Former Yugoslavia (ICTY). It finds that the ICTY delivers a "justice" that is biased, with prosecutorial decisions based on the national characteristics of the accused, rather than on what available evidence indicates that he has done. Evidence of this bias is found in the failure to prosecute NATO personnel for acts that are comparable to those of Yugoslavs already indicted, and of failure to prosecute NATO personnel …

Ion Transport Processes Of Crustacean Epithelial Cells, Gregory A. Ahearn, Jeff Duerr, Zhenpeng Zhuang, Richard J. Brown, Amy Aslamkhan, Deirdre A. Killebrew Jan 1999

Ion Transport Processes Of Crustacean Epithelial Cells, Gregory A. Ahearn, Jeff Duerr, Zhenpeng Zhuang, Richard J. Brown, Amy Aslamkhan, Deirdre A. Killebrew

Faculty Publications - Department of Biological & Molecular Science

Epithelial cells of the gut, antennal glands, integument, and gills of crustaceans regulate the movements of ions into and across these structures and thereby influence the concentrations of ions in the hemolymph. Specific transport proteins serving cations and anions are found on apical and basolateral cell membranes of epithelia in these tissues. In recent years, a considerable research effort has been directed at elucidating their physiological and molecular properties and relating these characteristics to the overall biology of the organisms. Efforts to describe ion transport in crustaceans have focused on the membrane transfer properties of Na1/H1 exchange, calcium uptake as …

The Aftermath Of The Nato Bombing: Approaches For Addressing The Problem Of Serbian Conscientious Objectors, Alexandra Mcginley Jan 1999

The Aftermath Of The Nato Bombing: Approaches For Addressing The Problem Of Serbian Conscientious Objectors, Alexandra Mcginley

Fordham International Law Journal

This Note will address the plight of Serbian conscientious objectors who fled Serbia in the aftermath of NATO's involvement in Kosovo. Part I discusses refugee definitions and mechanisms for managing the refugee crises. Part I also examines the Balkan conflict, focusing on the NATO bombings, the exodus of refugees from the region and the subgroup of Serbian draft evaders to Hungary. Part II compares two legal methods for managing refugee crises. Part III argues for a hybrid solution, combining the individualized and collectivized approaches, to handle Serbian conscientious objector refugees.

Nastygram Federalism: A Look At Federal Self-Audit Policy, David N. Cassuto Jan 1999

Nastygram Federalism: A Look At Federal Self-Audit Policy, David N. Cassuto

Elisabeth Haub School of Law Faculty Publications

This Article examines the evolution of EPA's audit policy, explores the reasons for states' dissatisfaction with it, and then discusses whether the federal policy should have been issued as a rule under the Administrative Procedure Act (APA). Part I examines the evolution of the federal audit policy and then analyzes the strengths and weaknesses of the policy in its current form. Part II explores various types of evidentiary privilege and looks at the arguments for and against extending the privilege to audit reports. It then offers a similar analysis of the case for limited immunity, concluding that neither an expanded …

Toward A Formative Project Of Securing Freedom And Equality, Linda C. Mcclain Jan 1999

Toward A Formative Project Of Securing Freedom And Equality, Linda C. Mcclain

Faculty Scholarship

This Symposium offers an occasion to pursue two important tasks: (1) identifying normative and constitutional foundations for an affimnative governmental responsibility to engage in a "formative project" that would foster persons' capacities for democratic and personal self-government;' and (2) exploring the mix of normative and empirical inquiries necessary to shape the proper goals and parameters of such a project. These tasks are relevant to my larger project of attempting to develop a synthetic, or feminist and liberal, normative account of rights, responsibilities, and governmental promotion of good, self-governing lives.2 That account argues for governmental responsibility to foster the preconditions for …

An Anthropological Approach To Modern Forfeiture Law: The Symbolic Function Of Legal Actions Against Objects, Paul Schiff Berman Jan 1999

An Anthropological Approach To Modern Forfeiture Law: The Symbolic Function Of Legal Actions Against Objects, Paul Schiff Berman

GW Law Faculty Publications & Other Works

In 1996, the Supreme Court issued two opinions, Bennis v. Michigan and United States v. Ursery, emphasizing the constitutionality of civil forfeiture schemes under both the Due Process and Double Jeopardy Clauses of the Fifth Amendment. These decisions, and civil forfeiture schemes generally, have faced strong criticism from scholars and civil libertarians. Among the arguments advanced against civil forfeiture has been one based on its origins. The so-called "legal fiction" underlying forfeiture is that the government is acting against the property itself, rather than against the owner. Commentators have traced this fiction to the Middle Ages. Under the law of …

A Modest Proposal To Enhance Civil/Military Integration: Rethinking The Renegotiation Regime As A Regulatory Mechanism To Decriminalize Cost, Pricing, And Profit Policy, William E. Kovacic, Steven L. Schooner Jan 1999

A Modest Proposal To Enhance Civil/Military Integration: Rethinking The Renegotiation Regime As A Regulatory Mechanism To Decriminalize Cost, Pricing, And Profit Policy, William E. Kovacic, Steven L. Schooner

GW Law Faculty Publications & Other Works

Neither Congress, the procuring agencies, the media, nor the public will condone government contractors reaping what are perceived as excessive profits. Accordingly, the procurement process employs an unduly complex, burdensome, risk-laden, and ineffective mechanism that erects significant barriers to civil/military integration. This paper (presented at the 1999 Defense Systems Management College (DSMC) Acquisition Research Symposium) examines certain policy implications associated with the Truth In Negotiations Act (TINA), the existing audit regime, and the use of criminal and civil anti-fraud measures to scrutinize deviations from these complex cost, pricing, and profit policies and controls. It re-visits the long-extinct Renegotiation Act and …

Seepage Characteristics And Hydraulic Properties Of A Feedlot Runoff Storage Pond, David B. Parker, Dean E. Eisenhauer, Dennis D. Schulte, John A. Nienaber

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Water and chemical transport were investigated beneath a 22-year-old beef feedlot runoff storage pond. Soil and sludge samples were collected from 14 borings to 6.1-m depths in a cross-section across the pond. The soils consisted of silt loam and clay loam, and the groundwater level was about 30 m beneath the land surface. Soil samples were analyzed for pH, NO3-N, NH4-N, Cl, P, K, SO4-S, TKN, and organic matter. Physical and hydraulic properties were measured on undisturbed samples of soil and sludge to compare saturated hydraulic conductivity, moisture release characteristics, and bulk density. Saturated …

Children's Perceptions Of Older Adults : Past And Present, Mary Kathryn Hatcher Jones Jan 1999

Children's Perceptions Of Older Adults : Past And Present, Mary Kathryn Hatcher Jones

Graduate Research Papers

This study compared more recent research findings, 1990s to present, with the results of earlier research studies, 1970s and 1980s, to determine whether children's perceptions of older adults have changed. Factors that contribute to and inhibit children's positive perceptions of older adults were identified. Guidelines for facilitating children's positive perceptions of older adults were suggested, and conclusions were drawn from the literature. Recommendations were made for further study of children's perceptions of older adults.
