Encircling Linearity In Carlos Saura's Peppermint Frappé, Linda M. Willem Jan 1999

Encircling Linearity In Carlos Saura's Peppermint Frappé, Linda M. Willem

Scholarship and Professional Work - LAS

Spanish director Carlos Saura is internationally famous for creating films where the past, the present, and the future are fused together and intermixed with reality, fantasy, and dreams. Although this practice is generally recognized by critics as one of Saura's strategies for circumventing the repressive censorship operating during the Franco era, María Delgado points out that Saura's continued reliance on non-linear narratives in his post-Franco work "indicates that his style was determined as much by a desire to interrogate the possibilities of the medium as by censorship" (375). Indeed, in an interview with Antonio Castro, Saura has been quoted as …

Globalization, Migration And Class Struggles: Ngo Mobilization For Filipino Domestic Workers, Lisa Law, Kathy Nadeau Jan 1999

Globalization, Migration And Class Struggles: Ngo Mobilization For Filipino Domestic Workers, Lisa Law, Kathy Nadeau

Anthropology Faculty Publications

This paper contributes to post-Marxist discussions on the relevance of class as a social category in a postmodern world. Rather than marginalize this issue of social positioning, the authors explore the relevance of an Althusserian perspective which acknowledges the importance of class as it articulates with other social/identity issues such as gender and ethnicity. The substantive context for this discussion is gendered labor migration from the Philippines, and the advocacy work conducted by Filipino non-government organizations (NGOs) working with migrants in Pacific Rim countries. It focuses on NGOs in Hong Kong and Vancouver, and their efforts to contest the gendered …

Music Included On Software Downloaded From The Internet: Public Performance Or Private Use, Christopher Paul Moore Jan 1999

Music Included On Software Downloaded From The Internet: Public Performance Or Private Use, Christopher Paul Moore

UC Law SF Communications and Entertainment Journal

This note addresses the applicability of the public performance right when software creators license copyrighted music to include on software that is sold and delivered directly over the Internet. This note contends that when software is bought from a site on the Internet, and then digitally downloaded to a consumer, a public performance has occurred under section 106(4) of the Copyright Act.

Preparing Your Music Client For Web Distribution, Stephanie Brauner Jan 1999

Preparing Your Music Client For Web Distribution, Stephanie Brauner

UC Law SF Communications and Entertainment Journal

Digital transmission of recordings is becoming an extremely important method of distribution. As this method of distribution becomes increasingly common, attorneys practicing in this industry will be compelled to advise their clients of the choices available in releasing their musical expressions on the Internet. This article provides a basic overview of the digital transmission process, discusses the current state of copyright protections for musicians and the failings in those protections, and will present other viable options that allow for the protection of a client's interests.

Multivalued Mappings, Fixed-Point Theorems And Disjunctive Databases, Pascal Hitzler, Anthony K. Seda Jan 1999

Multivalued Mappings, Fixed-Point Theorems And Disjunctive Databases, Pascal Hitzler, Anthony K. Seda

Computer Science and Engineering Faculty Publications

In this paper, we discuss the semantics of disjunctive programs and databases and show how multivalued mappings and their fixed points arise naturally within this context. A number of fixed-point theorems for multivalued mappings are considered, some of which are already known and some of which are new. The notion of a normal derivative of a disjunctive program is introduced. Normal derivatives are normal logic programs which are determined by the disjunctive program. Thus, the well-known single-step operator associated with a normal derivative is single-valued, and its fixed points can be found by well-established means. It is shown how fixed …

Digital Recording Of Real Estate Conveyances, Dale A. Whitman

Faculty Publications

The purpose of this article is to describe how such a revolutionary change in the recording system can take place, and to identify and discuss the major policy issues that must be resolved in order to accomplish it. This change ought to happen. Failure to update the system will result in the continued imposition of unnecessary costs and delays on those who buy, sell, or mortgage real estate in America.

Welfare Devolution And State Constitutions, Helen Hershkoff Jan 1999

Welfare Devolution And State Constitutions, Helen Hershkoff

Faculty Articles

Using state constitutional welfare rights as an example, this Essay argues for an independent state constitutional discourse that resists simply mapping state judicial practice onto federal doctrine. I have explored some of these issues elsewhere. My methodology here consists of a case study of Article XVII of the New York Constitution, a Depression-era provision that guarantees the "aid, care and support of the needy."' The New York Court of Appeals has interpreted Article XVII to impose "a positive duty upon the State," but to grant the legislature almost unreviewable "discretion in determining the means by which this objective is to …
