Don’T Fence Me In -- Appllication Of The Unlawful Inclosures Of Public Lands Act To Benefit Wildlife, Chandra Rosenthal, Kara Gillon

The Bureau of Land Management and the Forest Service manage millions of acres of public land across the United States. Most of this land seres more than one purpose-grazing, mining, recreation, timber, wildlife-and thus must remain available for these uses. Historically, the Unlaujul Inclosures Act (UIA) preserved access for ranchers and homesteaders. More recently, the UIA has also protected access for wildlife whose movements are impeded by fences or other illegal obstructions. This article argues that such protection should be extended to the Sonoran pronghorn antelope in the southnwestern United States.

State Animal Anti-Cruelty Statutes: An Overview, Pamela D. Frasch, Stephan K. Otto, Kristen M. Olsen, Paul A. Ernest
Animal Law Review
This article provides an introduction to the current status of state animal anti-cruelty laws throughout the United States. Extensive exploration of the similarities and differences between these statutes, combined with detailed statutory citations, enables this article to serve as a useful resource for research and statistical purposes. Additionally, the article offers an opportunity to review many of the provisions contained within these anti-cruelty statutes and to identify those in need of improvement.

In this comment, the author explores the development of open range laws in Oregon and other western states and argues such laws should be abolished or drastically amended. Common law requires ranchers to fence livestock in or face liability for damages caused by strays. Hvever, historical customs and practices of Western states were shaped by vast open lands and sparce populations, leading to open range customs which required a landowner to fence "out" livestock to protect their property. This comment focuses on the case of Dr. Patrick Shipsey, an Oregon landowner convicted of shooting cattle that wandered onto his land. …

Child Abuse : Creating The Public In The Public Service Advertisement, Mark Brennan

This thesis seeks to examine the discursive construction of the public. Unlike studies before it, it explores a site that has yet to be analysed in depth- the public service advertisement. While the characteristics of this genre are understood in cultural common sense, what has been neglected is a consideration of how these advertisements can be understood to address an entity that is amorphous and unknowable. This study argues that such an address is only possible in this genre through the discourse of childhood. The great historian of republicanism, J. G. A. Pocock, noted that "[f]rom Jefferson to Frederick Jackson Turner and beyond, it was commonplace that sooner or later the frontier would be closed, the land filled, and the corruptions of history-urbanization, finance capital, 'the cross of gold,' 'the military-industrial complex' -would overtake America. Here are the origins of American historical pessimism." The American frontier has long since closed, the agrarian order has long-since passed away, and the pessimism has mushroomed into a "palpable despair and cynicism and violence," "dark signs of the times," according to the philosopher Jean Bethke Elshtain. For those unfamiliar with the White Buffalo and its relationship with Native American spirituality, this is the book to read. The author, curator of anthropology for the Denver Museum of Natural History, has written an accessible, informative guide that surveys the popular response to Miracle, the female white buffalo calf born in 1994. Pickering covers four areas: first, the personal perspectives of Dave and Val Heider, the Janesville, Minnesota, couple who run a small buffalo herd in which Miracle was born; then the "historical-cultural perspectives of American Indians"; the "spiritual perspectives" of Native and non-Native peoples toward Miracle; and the …

Linking her own experiences with those of the fictional and historical Laura Ingalls Wilders, Ann Romines advances several issues she considers central to a fuller understanding of Wilder's well-known "Little House" books. With My Own Eyes represents an historic event for this reviewer, who grew up on Standing Rock reservation in South Dakota where the name Josephine Waggoner was known and remembered. In my view, she represented a local Native intellectual who had a great interest in the history of the reservation. It was known by my father's generation that she had interviewed local headmen (itancan or "chiefs"). She also represents the companionship of Lakota women as they aged. Her literary partnership with Susan Bordeaux Bettelyoun was a fortuitous and productive bonding.
It is amazing that this history is finally published. …

It is hard to review Gerald Vizenor, especially when writing something of your own, because he zooms into the creative imagination and his words transpot whatever it is you're writing.
In other words, his words have a fracturing factor which makes a magic of language. Vizenor is generative. He forms and splices, even in the critical essays of Fugitive Poses.

In the past twenty-five years, historical studies on Indian boarding schools have proliferated, ranging from analyses of federal policies regarding Indian education (Adams, Coleman, Prucha) to particular institutional histories such as They Called It Prairie Light, The Phoenix Indian School, Cultivating the Rosebuds, To Change Them Forever, and Out of the Depths. While the specifics of instititional practices may differ, for the most part scholars of American Indian education agree that the boarding school experience was and continues to be a seminal moment for generations of Indian families. This Note analyzes the primary conflicts among the order of the District Court for the District of Nebraska and the vacated majority and dissenting opinions of the Eighth Circuit Court of Appeals Panel in United States v. Weaselhead. The Note highlights the tension in logic with which modern Supreme Court analyses of tribal sovereignty has presented courts, Congress, and tribal governments. The Note also discusses the potential implications of giving constitutional weight to Supreme Court decisions that purportedly diminished tribal sovereignty. This Comment examines research on the human genome and explores the existence of a duty to disclose genetic test results in clinical and research settings. Part II begins with a hypothetical describing how such a duty to disclose can arise. Part III (A-C) describes advances in the sequencing of the human genome, the development of reliable tests for genetic disorders, and issues regarding access and control of genetic test samples and results. Copepod Grazing Selection And Particle Discrimination On The Basis Of Psp Toxin Content, Gregory J. Teegarden

Omnivorous copepods are capable of discriminatory feeding using mechano- and chemosensory mechanisms. The presence of phycotoxins in phytoplankton often results in reduced consumption of such potential prey by copepods, though it has not been clear if this is the result of discriminatory feeding by either tactile (mechanosensory) or chemosensory recognition of toxic prey, or perhaps a physiological response to ingested neurotoxic compounds. In this study, experiments were performed to determine whether 3 species of marine copepods (Acartia tonsa, Centropages hamatus, and Eurytemora herdmani) that commonly co-occur with toxic Alexandrium spp. dinoflagellates were capable of discriminating between cultured Alexandrium spp. strains …

"Veritas vos liberabit," chanted the scholastics of yesteryear. The "truth will set you free," echo their latter-day counterparts in the academy, intoning the mantra reverentially but with increasingly more hope than confidence, more faith than conviction.... The real world of the academy, of course, is not quite that wonderful, nor nearly as bad as many would suggest. The ironies become palpable, however, when those self-same institutions, which almost universally view themselves as bastions of free speech, instead stifle debate that is perceived as politically incorrect or otherwise embarrassing. The idea that there is a connection between the way individuals treat animals and human beings has a long history in Western popular culture, but a shorter history as the subject of scientific research. Recently, a growing body of evidence has confirmed an association between repeated, intentional abuse of animals and a variety of violent antisocial behaviors including child abuse, domestic violence, and violent criminal activities. The public made this connection before most law-enforcement or menial health officials.
