Regulatory Protectionism And The Law Of International Trade, Alan O. Sykes

A wide array of policy instruments can protect domestic firms against foreign competition. Regulatory measures that raise the costs of foreign firms relative to domestic firms are exceptionally wasteful protectionist devices, however, with deadweight costs that can greatly exceed those of traditional protectionist instruments such as tariffs and quotas. This Article develops the welfare economics of regulatory protectionism and a related political economy analysis of the national and international legal systems that must confront it, including the WTO, the NAFTA, the European Union, and the United States federal system. The WTO has become the chosen forum for various trade-related additional policies and provisions such as Trade Related Environmental Measures (‘TREMS‘), TRIMS, TRIPS, and possibly in the future, competition and investment rules. The TRIPS, as is well known, owes its existence to trade-offs with DCs, which have still not been fully implemented. Future additional policies, if controversial, would need to be justified separately on economic grounds, or risk failure. Detailed multilateral competition rules will undoubtedly be adopted one day. Constitutional Comparisons And Converging Histories: Historical Developments In Equal Educational Opportunity Under The Fourteenth Amendment Of The United States Constitution And The New South African Constitution, Alfreda A. Sellers Diamond

UC Law Constitutional Quarterly

The black populations in both the United States and South Africa continue to suffer under the legacy of past discrimination and unequal educational opportunity. In both countries, the constitutional revisions eliminating state-sanctioned racial discrimination failed to alleviate the disadvantages experienced by blacks in terms of socioeconomic status, educational opportunity and political power.

America's post-emancipation history, including the Plessy v. Ferguson and Brown v. Board of Education Supreme Court jurisprudence, shows that the removal of de jure racial discrimination and constitutionally countenanced unequal treatment is not enough to repair the damage and lingering effects caused by former discrimination. RAPID developments in the software industry underlie both the Gov ernment's antitrust proceedings against the Microsoft Corporation 1 and the lawsuit brought by Sun Microsystems, Inc. Information Ecology (hereafter IE) is a field of inquiry being developed, in part, by members of the Department of Anthropology, University of Georgia (Appendix A). The following prospectus represents a work in progress and is the latest incarnation in a series of revisions since the first IE prospectus was developed in 1990 (Appendix B). The purpose of the prospectus is not to bound what is, admittedly, an eclectic mode of investigation, but rather to outline a field of inquiry that is inherently multidisciplinary and seeks theoretical complementarity both among disparate fields and levels of analysis. Development And Evaluation Of Transit Signal Priority Strategies, Michael Garrow, Randy Machemehl

Journal of Public Transportation

Research describing the effectiveness of providing signal priority to transit vehicles is presented. Results from previous studies indicate that the effectiveness of transit signal priority depends on a number of factors, including the type of transit route, the transit usage level, and the time of day. This research describes and evaluates several transit signal priority provision methods during both peak and off-peak times. Results indicate that providing signal priority during off-peak times is often justified, due to excess capacity available within the transportation network. However, during peak times, transit signal priority use is justified only when the transit usage level …
