The Cave Exploration Group Of East Africa And Volcanic Caves In Kenya, Michael Declan Kennedy Jan 1998

The Cave Exploration Group Of East Africa And Volcanic Caves In Kenya, Michael Declan Kennedy

International Journal of Speleology

This paper looks at the history of the Cave Exploration Group of East Africa with special reference to the exploration of volcanic caves. It demonstrates that the group has concentrated on two main areas, the Chyulu HiIls and Mt. Suswa, although other areas have also been studied. The Cave Exploration Group of East Africa has had to cope with various problems. The most important of which are related to the socio-economic conditions of a developing country. These problems have not prevented the group from making a valuable contribution to vulcanospeleology.

Effects Of Prenatal Drug Exposure On Neurobehavioral Functioning In Young Infants, Yvette Blanchard, Patricia E. Suess, Marjorie Beeghly Jan 1998

Effects Of Prenatal Drug Exposure On Neurobehavioral Functioning In Young Infants, Yvette Blanchard, Patricia E. Suess, Marjorie Beeghly

All PTHMS Faculty Publications

In the newborn period, infants prenatally exposed to cocaine and other drugs show low scores on the Neonatal Behavioral Assessment Scale. Beyond that period, research is limited on the effects of prenatal drug exposure on neurobehavioral functioning. In this study we compared infants exposed to cocaine and other drugs and control infants from low socioeconomic backgrounds on measures of neurobehavioral functioning during neuromotor assessment at 1, 4 and 7 months of life. None of the measures of neurobehavioral functioning showed any significant group differences. This study did not support the hypothesis of disrupted neurobehavioral functioning beyond the neonatal period in …

Mandatory Indeterminate Sentences Under Dangerous Offender Legislation, Jennifer J. Soward Jan 1998

Mandatory Indeterminate Sentences Under Dangerous Offender Legislation, Jennifer J. Soward

Dalhousie Journal of Legal Studies

On September 17, 1996, Allan Rock, Minister of Justice and Attorney General of Canada, and Herb Grey, Solicitor General of Canada, announced "tough new measures" to deal with dangerous offenders. These measures were introduced in Bill C-55, which received Royal Assent on April 15, 1997. The following comment focuses on only one significant change to the dangerous offender legislation. As part of these measures, the new section 753(4) of the Criminal Code removes a judge's discretion to award a determinate sentence once an accused is found to be a dangerous offender. This discretionary power is which existed in the former …

Implementation Of The 1996 Hazardous And Noxious Substances Convention: A Few Short Steps To Canadian Law, John Macdonald Jan 1998

Implementation Of The 1996 Hazardous And Noxious Substances Convention: A Few Short Steps To Canadian Law, John Macdonald

Dalhousie Journal of Legal Studies

Far more destructive than oil spills are spills of other hazardous and noxious substances (collectively "hazardous substances"). This is a comment on the International Convention on Liability and Compensation for Damage in Connection with the Carriage o f Hazardous and Noxious Substances by Sea, 1996. It is an international convention to apportion liability and facilitate compensation for victims of hazardous substances which was passed by the International Maritime Organization on May 1996. Canada became a signatory to the Convention on September 9, 1997. This comment will examine the history of the development of the HNS Convention, including the difficulties encountered …

Understanding Casablanca: A Values-Based Approach To Legal Negotiations, Roy Stuckey Jan 1998

Understanding Casablanca: A Values-Based Approach To Legal Negotiations, Roy Stuckey

Clinical Law Review

The central thesis of this Article is that each party's desire to attain personal happiness underlies all decisions in negotiations. While this paradigm does not resolve all of the uncertainties about negotiations, it does provide a simple reference point that can help us understand what the parties to a negotiation want, expect, and are willing to accept. It can also help us develop and employ effective strategies and tactics. The objective of all negotiators is to obtain satisfactory outcomes. As lawyers, we have a professional responsibility to try to maximize our clients' satisfaction with the results of negotiations. This requires …

Coherence And Incoherence In Values-Talk, Paul R. Tremblay Jan 1998

Coherence And Incoherence In Values-Talk, Paul R. Tremblay

Clinical Law Review

The theme of the 1998 Conference of the Clinical Section of the Association of American Law Schools, held in Portland, Oregon, was "values"- what values law professors hold, how they might differ from those of their students, whether it is appropriate to "teach" about values, whether it is even possible not to teach about them, how to discuss values in a non-threatening fashion, whether some values might simply be wrong, and so forth. Important questions, generating productive conversation and debate, to the deep satisfaction, from all signs, of the participants, who are not known to be uncritical of such conferences …

Living In The Palaces Of Love: Love And The Soul In A Vision Of St. Aldegund Of Maubeuge (Ca. 635–684), Isabel Moreira

Quidditas

Abbess Aldegund of Maubeuge, in dictating her visions to the cleric Subnius in her later years, recalled a vision she had experienced in her youth. She saw herself entering a heavenly mansion, richly bejeweled and "steeped" with Christ's "sweet odor." The vision had made a great impression on her. She accredited it with having matured her spiritual understanding, for having first misunderstood the vision's meaning, she now understood it, "the scales having fallen from her eyes." Yet as historians we are not as fortunate as Aldegund claimed to be. Many centuries removed from the events of the seventh century, the …

Preparing Students For The Profession: Clinical Education, Collaborative Pedagogy, And The Realities Of Practice For The New Lawyer, Catherine Gage O'Grady Jan 1998

Preparing Students For The Profession: Clinical Education, Collaborative Pedagogy, And The Realities Of Practice For The New Lawyer, Catherine Gage O'Grady

Clinical Law Review

Legal education is currently taking tentative steps beyond teaching lawyering skills toward a focus on professional collaborative relationships and human interactions. To this end, many legal educators have embraced a pedagogy that values student collaboration. Clinical education in particular has been praised for providing students with numerous opportunities to work collaboratively, and clinical educators have generally recognized the benefits of collaborative pedagogy to prepare students for the practice of law. Few educators, however, have asked whether collaborative pedagogy in a law school clinic adequately prepares students to face the power differentials and conformance pressures that do not exist in most …

Notice And Notification Under The Revised Uniform Partnership Act: Some Suggested Changes, J. Dennis Hynes Jan 1998

Notice And Notification Under The Revised Uniform Partnership Act: Some Suggested Changes, J. Dennis Hynes

Publications

This Article addresses the decision by the drafters of the revised Uniform Partnership Act (1996) (RUPA) to reduce the traditional defenses available to partnerships in apparent authority cases. RUPA eliminated the requirement that apparent authority claims against a partnership be based on the claimant's reasonable expectations. Under RUPA a partnership is liable for a partner's unauthorized act even when the claimant had reason to know the act was unauthorized. A defense based on the claimant's knowledge is effective only when the claimant actually knows--is cognitively aware--that the act was unauthorized. This Article argues that this places an unfair burden on …

Deconstructing The Distinction Between Bias And Merit, Daria Roithmayr Jan 1998

Deconstructing The Distinction Between Bias And Merit, Daria Roithmayr

Publications

In this article Professor Roithmayr attempts to develop in the context of law school admissions a theoretical argument from deconstruction to support the radical critique of merit. The radical critique, espoused primarily by Critical Race Theorists and radical feminists, argues that merit standards disproportionately exclude white women and people of color because merit standards were developed by dominant social groups, in ways that have disproportionately benefited their descendants. Using a critical history of law school admission standards, as well as a deconstructive reading of a defense of merit offered by Professors Daniel Farber and Suzanna Sherry, Professor Roithmayr deconstructs the …

Agricultural Water Quality Index Field Handout, Jeffrey Cooper, Richard Rediske, Melvin Northup, Mark Thogerson, Jonathan Van Denend Jan 1998

Agricultural Water Quality Index Field Handout, Jeffrey Cooper, Richard Rediske, Melvin Northup, Mark Thogerson, Jonathan Van Denend

Scientific Technical Reports

The Agricultural Water Quality Index (AWQI) is an assessment tool designed for use in agroecosystems. Most existing environmental indices and assessment tools focus on the stream channel and/or riparian zone (the area between the channel and active land use). In contrast, the AWQI places an emphasis on land use and soil types that play a significant role in hydrologic cycles and water quality characteristics within the watershed.

The AWQI is designed to be used by agricultural technicians with limited experience in aquatic ecology; however, it does assume a reasonable background in soil characteristics. This index is intended for use during …

Service-Learning In The Community - Are We Ready For The Journey?, William Finger Jan 1998

Service-Learning In The Community - Are We Ready For The Journey?, William Finger

Partnerships/Community

It's late Sunday afternoon in downtown Raleigh, NC, in a low concrete building next to the railroad tracks. We are working in a small room where the 40 residents will eat supper in about an hour, when a church group serves the only full meal of the day for many of the residents. We have folded the tables and pushed them against the wall. Most of the residents are watching television in the only other common room in the building or lying on their bunks in the men's or women's dorm, each a single large room. A few are in …

A Study Of Heat-Seal Strength In The Presence Of Edible Oil Surface Contamination Of Ethylene-Methacrylic Acid Copolymer Films, David Britt Jan 1998

A Study Of Heat-Seal Strength In The Presence Of Edible Oil Surface Contamination Of Ethylene-Methacrylic Acid Copolymer Films, David Britt

Theses

Packages made from flexible film often use a heat-sealing process to ensure closure. The process involves joining two surfaces of film with heat and pressure across a period of time. Heat-seal problems arise when another substance partially obstructs the film-to-film contact. This substance acts as a surface contaminant. In packaging operations, the product being packaged is often the source of contamination in the sealing process. Testing heat-seal strength is a primary method for evaluating seal performance of flexible film. Test procedures require contaminant-free film samples to maintain accuracy and precision in results. This study altered the test method to explore …

"The World Adrift In Emptiness": Crossing The Abyss Of Transition In Four Tragedies By Wole Soyinka, Michael H. Lake Jan 1998

"The World Adrift In Emptiness": Crossing The Abyss Of Transition In Four Tragedies By Wole Soyinka, Michael H. Lake

Masters Theses

1986 Nobel Laureate, Wole Soyinka, Nigerian dramatist, poet, essayist and novelist, names the Yoruba god, Ogun, as his tragic muse for ritual theatre in "The Fourth Stage," his early artistic manifesto. In this essay Soyinka maintains that in contrast to Dionysus, Nietzsche's hero in The Birth of Tragedy from the Spirit of Music, Ogun balances within himself elements that could be described as Dionysian, Apollonian, and Promethean. Archetypally, Ogun thus constitutes a destructive-creative unity which overcomes the dyad of good-versus-evil of Europe's Christian civilization.

For this reason, Soyinka upholds Ogun not only as a natural patron of tragedy …

A Comparison Of Predation Rates On Real And Artificial Nests Of Grassland Birds, William B. Davison Jan 1998

A Comparison Of Predation Rates On Real And Artificial Nests Of Grassland Birds, William B. Davison

Masters Theses

I compared rates of predation between real and artificial nests of grassland birds in order to test the impact of nest type, nest position, and egg size on predation rates. I distributed wicker avicultural baskets and realistic grass nests baited with a clay egg and either northern bobwhite (Colinus virginianus) or house sparrow (Passer domesticus) eggs in four Conservation Reserve Program (CRP) grasslands in east-central Illinois. Nest success averaged 86.5% for 12 days of exposure for artificial nests. For real nests, nest success was markedly lower; averaging 39% over the entire nesting cycle and 59% during approximately 12 days of …

Heartworm And Lungworms In Illinois' Canids And Their Possible Effect On Coyote Condition And Reproduction, David G. Gregory Jan 1998

Heartworm And Lungworms In Illinois' Canids And Their Possible Effect On Coyote Condition And Reproduction, David G. Gregory

Masters Theses

This study focuses on the prevalence of heartworm and lungworms in Illinois' canid species, and the effect that they may have on condition (body weight, kidney fat, marrow fat) and reproduction (placental scars) on coyote populations. A total of 1,150 coyotes (Canis latrans), 2,269 domestic dogs, 47 red foxes (Vulpes vulpes), and 2 gray foxes (Urocyon cinereoargenteus) were examined. Prevalence of heartworms (Dirofilaria immitis) averaged 17.8% in coyotes, 3.0% in domestic dogs, 2.0% in red foxes, and 0% in gray foxes. Domestic dogs not receiving any type of prophylactic treatment had a higher prevalence (12.5%) of heartworms than dogs on …

Behavioral Economics Analysis Of Redistributive Legal Rules, Christine Jolls Jan 1998

Behavioral Economics Analysis Of Redistributive Legal Rules, Christine Jolls

Vanderbilt Law Review

This Essay offers a behavioral economic analysis of redistributive legal rules. Redistributive legal rules are rules chosen for their effects in shifting wealth from high-income to low-income individuals(progressive redistribution). The desirability of such rules has been the subject of intense debate within the legal community. Many law and economics scholars have urged that legal rules be chosen solely with an eye towards Kaldor-Hicks efficiency (which I will call simply "efficiency" for the remainder of this Essay); these scholars often urge that distributional considerations be addressed (if they are to be addressed at all) exclusively through the tax and welfare systems. …
