This is a story with at least two parts. In the first part, Sam Wineburg, a Professor of Educational Psychology at the University of Washington, tells his story, the story of instruction in the United States, beginning with one revolution, the scientific revolution, and ending with another, the cognitive revolution. In the second part, Laurel Oates, the Director of Legal Writing at Seattle University School of Law, tells our story, the story of legal education and, in particular, legal writing, and how both have been affected by these revolutions.

Beating The Odds: Reading Strategies Of Law Students Admitted Through Alternative Admissions Programs, Laurel Oates

When they enter law school, the odds are against them. Almost always persons of color and often from disadvantaged backgrounds, their LSAT scores are substantially lower than those of their classmates. As a result, these students, law students admitted through alternative admissions programs, have a by far less chance of success than their regularly admitted classmates. Some of these students do, however, beat the odds. While most students who are admitted to law school under an alternative admissions program perform as their LSAT scores predict-in the bottom quartile of their class-a small number perform substantially better. The authors discuss the use of a novel, Waterlily, by Ella Cara Deloria, for courses in communication studies. As a representation of the life and culture of Teton Dakotas in the time before substantial contact with European Americans, the novel reveals a distinctive outlook and system of practices with regard to communication. Thus it provides a striking counterpoint to assumptions commonly presented in courses in communication studies. An interpretive framework for examining such a novel, with particular reference to its portrayal of culturally distinctive ways of communicating, is presented and applied to Waterlily. The Linguistic Invention Of "Sophistic Rhetoric", Omar Swartz

This paper reviews modern scholarship on the Older Sophists that began in the early nineteenth-century. At this time, philosophers and philologists took important steps to salvage the Sophists from the obscurity of history. However, these scholars did so in a way that continued to confuse sophistic fragments and contributions. The tendency of these scholars to view the Sophists from the vantage point of disciplinary perspectives has colored subsequent scholarship, as evidenced in the concept of "sophistic rhetoric."

This essay, extending from the work of Edward Schiappa (1991a, 1991b), reviews (and critiques) the modern scholarship which constructs theories of "sophistic rhetoric." …

In the Talmudic story of the Oven of Akhnai, Rabbi Eliezer - symbol of unchanging law and original intent - decides a disputed issue of law, supporting his claim with all the arguments in the world and then with miracles including a voice from the Author proclaiming his interpretation correct. Nonetheless, his interpretation is rejected.

The Akhnai story is a complicated commentary on the problems of democracy and justice, with insights into the majoritarian (and counter-majoritarian) difficulties, the status of ancient law, and the meaning of originalist interpretation. I draw out lessons for those who seek to create a single …

The identification and placement of managers who can meet the business challenges at both local and international level is critical to the success of a company's overseas operations. North American and British research shows that, while organisations may be prepared to promote women into their domestic managerial hierarchy, few women currently have access to international careers through expatriate management appointments. This report describes an investigation of the selection, placement and management development by Australian organisations of women for international managerial assignments. Since Freud's article "On Narcissism," behavioral psychologists have predominantly viewed this phenomenon as a personality disorder. This dissertation, in contrast, provides a psychoanalytic, i.e., Lacanian reading of the myth of Narcissus as it is recorded in classical literature, and brings about an understanding of the myth's underlying structure. The four fundamental exigencies of the myth's structure include the incest prohibition which symbolically castrates the human subject, the incestuous desire as a result of this prohibition, the displacement of this desire for another imaginary object, and the obsessive quest of that image as the symptom. The Compliance-Seeking Process From The Perspective Of The Respondent: The Role Of Goals In Responses To Requests., Barbara L. Woods

This study examined compliance seeking from the perspective of recipients of direct requests with respect to types of responses, goals, liking, and locus of control. A total of 211 employed adults completed a survey that included responses to hypothetical request scenarios involving liked and disliked co-workers, measures of goals factors, and a measure of locus of control. Six types of responses were identified: simple agreement, elaborated agreement, simple refusal, refusal with reasons, request more information, and postpone decision. Participants reported a tendency to agree with requests, regardless of liking. Factor analyses revealed three-factor models for the liked and disliked conditions. …

Present day America is perceived as immersed in a moral crisis due to certain cultural conditions; that national identity has fractured, resulting in a pervading sense of uncertainty and anxiety about the future; that public schools, as institutions charged with preserving the symbols of national identity and a morality that is the concrete expression of those symbols, have failed and must be reformed; and finally, that only through "schooling" can America be saved from this current cultural crisis. The central focus of this paper is the mechanisms that ordinary people use in their everyday lives to manage relations that have included trust violations. Trust violations provide the impetus for strong emotional experiences. Many relationships recuperate from significant violations of trust, although in a changed form. Our data, gathered from ten in-depth interviews, indicated that on those occasions where individuals deemed the relationship worth salvaging, our respondents and their violators participated in a negotiation process that included the following components: the passing of time, an assessment of the seriousness of the violation and the intent of the other, the …

Comparative taxation is a fascinating and frustrating subject. It is fascinating because, through the lens of tax law, one can observe how countries with very different historical and cultural traditions have grappled with similar problems and have reached solutions that have both common and disparate elements. For example, countries that start off with a schedular system for taxing different categories of income end up with near global coverage (e.g., through a "miscellaneous" schedule), and countries that adopt a global system introduce schedular elements (such as the U.S. treatment of capital gains and losses). The study queried whether his depiction of that role in revelation is harmonious or consistent with the one given in inspiration. The aim and purpose of this dissertation is to investigate both the microstructure and macrostructure of Leviticus on the basis of terminological patterns.

The first chapter deals with the method of analysis and the scope of the study. Aiming at detecting thestructural outline, it is concerned only with terminology and not with the theology of Leviticus. The methodology employed is one aspect of rhetorical criticism.

The purpose of this dissertation is to carry outa linguistic, structural, and exegetical investigation of the term ἐξουσία as it occurs in the Greek text of the Apocalypse.

Chapter 1 provides an overview of the pertinent literature dealing with ἐξουσία. The review follows a chronological order to demonstrate a trend in the development of ἐξουσία studies. Earlier works put more emphasis on the meaning of power or authority, whereas recent studies point to liberty and right as the primary meaning of ἐξουσία. The current tendency emphasizes philosophical and socio-ethical aspects without due consideration of the etymology of the term.

Compared with the effort to interpret other parts of the book of Hosea, especially the first three chapters, the final chapter has been rather neglected. Additionally, the variety of explanations offered for certain biblical images in Hos 14 indicates a necessity to clarify the methods of interpretation of biblical metaphorical language.

Chapter 1 clarifies the theory of metaphors on which the study is based.

For one drawn to copyright both for its intellectual fascination and its inspiring goals of fostering creativity and protecting authorship, I am distressed to learn that I am among the defenders of a fallen faith, that authors' rights are misguided (if not pernicious) impediments to technological progress, and, worst of all, that copyright blocks freedom of thought and speech in cyberspace.
