From the beginning of its resurgence in the 1960s, the clinical movement in American legal education has been driven by a kind of "academic" perspective. Emphasizing the necessary relationship between theory and practice, the central role of ideas in the development of behavioral competence, and the importance of the intellectual dimension of professional socialization, this perspective has shaped not only the intellectual content of most American clinical legal education, but also its programmatic structure. Demythifying Multicultural Education: Social Semiotics As A Tool Of Critical Pedagogy, Stephanie Urso Spina

Publications and Research

This article discusses the assumptions and curricular implications of a social semiotic approach to education. Semiotics refers to the meaning we make with language as well as other objects. events, and actions. Social semiotics emphasizes the social, cultural, historic, and political contexts that shape that meaning. A social semiotic approach to education can help teachers and teacher educators to deconstruct the reproduction of class, politicize the ideology of colonialism, and overcome the inequities they engender. By providing a way to challenge selectively reproduced cultural politics, social semiotics provides a way to reconstruct and democratize schools and society.

Fuzzy Thinking: A Borrowed Paradigm For Crisper Lawyering, David F. Chavkin

The answer to Ed's question is that by applying bivalent or crisp thinking Catherine has reached an apparently unresolvable paradox. By contrast, by applying fuzzy thinking, Ed has found a real-life answer to this longstanding problem. Fuzzy logic thereby has bridged a gap and permitted a waltz that would not otherwise have been possible. On that basis alone, fuzzy logic deserves a careful examination. This article analyzes whether the "fuzzy thinking" paradigm has potential benefits for our clinical teaching and for improved performance of lawyering tasks by ourselves and by our students. In the course of this conference on "new approaches to comparative law;" it has struck me as curious that so little has been said about the "old" approaches to comparative law. In such a self-conscious effort to distinguish ourselves from our predecessors, one would expect at least some articulation of distinctive criteria, if not a full-fledged manifesto of novelty. Giinter Frankenberg gave us three ideal-type identities of the comparative lawyer; David Kennedy boxed up the old approaches in his taxonomical chart. Young Children's Talk At Play: Orientation To Self And Orientation To The Joint Exigencies Of Conversation, Paige K. Parker

This study employed a conversation analytic approach to determine how children in naturally constructed play episodes use language as an object of play and how children in their naturally occurring talk display orientation to their own individual activities and others' social actions. The participants were thirty-nine kindergarten and first grade students at South Elementary School in Marshall, Illinois. The study is based upon fifteen hours of conversation collected during recess periods. Relevant segments from the corpus were transcribed according to an adapted version of Jefferson's Transcript Notation System (1984). The immigrant puts at issue assumptions of inviolability of borders, territoriality of sovereignty, and exclusivity of citizenship - fundamental characteristics of the modern state. The immigrant calls into question cultural homogeneity, linguistic commonality, shared history, and security of identity - the key ideologies of the nation. This article explores these issues by locating them in spatial and temporal sites removed from the common foci of current immigration debates. Revitalized after the passage of California's Proposition 187, the English language movement continues its national campaign for restrictive language laws at the local, state, and federal levels of government. Thus far, the English language laws and initiatives adopted or urged have addressed government speech - the language of government employees and of government communications, records, and publications. English language laws adopted by the states have not yet extended to public speech (such as newspapers and other media) or to private speech (such as language in the home).
