Playing The "Culture Card": Trials In A Mutli-Cultural Democracy, Richard O. Lempert Apr 1997

Playing The "Culture Card": Trials In A Mutli-Cultural Democracy, Richard O. Lempert

Articles

As I write, the racial divide in America is said to be greater than at any time in the past 25 years.' Two events are blamed: the O.J. Simpson criminal trial and the Louis Farrakan led "Million Man March." That these events should exacerbate racial division is extraordinary. The Farrakan led march brought together between 400,000 and 800,000 black males to pledge that they would take the kind of responsibility for their actions and their families that white Americans have long argued they should take. The O.J. Simpson trial was more a "who done it" than a racial morality play. …

Mass Tort Litigation: Congress's Silent, But Deadly, Reform Effort, Mary J. Davis Apr 1997

Mass Tort Litigation: Congress's Silent, But Deadly, Reform Effort, Mary J. Davis

Law Faculty Scholarly Articles

This article explores the ways in which The Common Sense Product Liability and Legal

Reform Act (“Act”) treats mass tort litigation issues. The Act does so both directly and indirectly. The direct methods of reform are mostly industry-specific and, thus, almost inconsequential in contrast to the indirect treatment. The indirect, almost clandestine, methods of reform are the most insidious and provide the most cause for concern as Congress once again attempts to "reform" products liability by reintroducing the Act in 1997. Given the President's early indication that a reform measure could meet with his approval, but that this one in …

Sources Of Gain In Christian Counseling And Psychotherapy: A National Survey, Barbara M. Houston Apr 1997

Sources Of Gain In Christian Counseling And Psychotherapy: A National Survey, Barbara M. Houston

Doctor of Psychology (PsyD)

This exploratory survey is an attempt to examine assumptions that shape and direct Christian psychologists' professional thoughts and actions in order to further the research on the efficacy of Christian psychotherapy. Major assumptions about change sustaining Christian counseling have been expounded without much empirical support. The Christian Psychologist Survey, concerning the assumptions about the sources of gain in Christian counseling and psychotherapy, was completed by 164 Christian Association for Psychological Studies (CAPS) members, 112 males and 52 females. This study endeavors to discover practicing therapists' beliefs of what makes Christian therapy effective, and what aspects make counseling "Christian." Regarding critical …

Caroline Bartlett Crane And Progressive Era Reform: A Socio-Historical Analysis Of Ideology In Action, Linda J. Rynbrandt Apr 1997

Caroline Bartlett Crane And Progressive Era Reform: A Socio-Historical Analysis Of Ideology In Action, Linda J. Rynbrandt

Dissertations

This dissertation is a sociohistorical analysis of women and social reform in the Progressive Era. Until recently, the role of women has been virtually invisible in accounts of Progressive social reform. While this is no longer the case, considerable questions remain. Using the archival records of one woman, Caroline Bartlett Crane (1858-1935), which document her professional, intellectual and personal life, I describe her contribution to social reform and early sociology. I analyze how her life and work reveals a greater understanding of current feminist debates and other social, historical and political questions.

Regulatory Reform And The Chevron Doctrine: Can Congress Force Better Decisionmaking By Courts And Agencies, Mark Burge

Faculty Scholarship

This Note examines recent legislative proposals for reform of the Chevron doctrine' in federal administrative law and suggests an alternative solution that sets more definite boundaries delineating the roles of courts, agencies, and the public in questions of statutory interpretation. Part I of this Note provides background information on the problem of determining when courts should defer to government agencies on questions of statutory construction. It asserts that past legislative proposals are a valuable resource for addressing this problem. Part II uses the various opinions in Babbitt v. Sweet Home Chapter of Communities for a Great Oregon to describe …
