What A Long Strange Trip It's Been: Court-Created Limitations On Rights Of Action For Negligently Furnishing Alcohol, Sheldon H. Jaffe Apr 1997

What A Long Strange Trip It's Been: Court-Created Limitations On Rights Of Action For Negligently Furnishing Alcohol, Sheldon H. Jaffe

Washington Law Review

Under the traditional view of the common law, drinking alcohol rather than providing alcohol acted as the proximate cause of any resulting harm, and therefore furmishers of alcohol had no duty to the people served or those injured by the persons served. The Washington Supreme Court has held that negligently furnishing alcohol can be a proximate cause in tort but has severely limited rights of action: vendors who serve minors or obviously intoxicated adults may be sued by subsequently injured innocent third parties, and all people who serve alcohol to minors may face suit if the minor is subsequently injured …

Direct And Indirect Effects Of Feminist Actions On Women's Rights In France, Kirsten Keeley '97 Apr 1997

Direct And Indirect Effects Of Feminist Actions On Women's Rights In France, Kirsten Keeley '97

Honors Projects

This study is divided into several parts, the first of which deals with the successes and weaknesses of the French women's movement. The second part will focus on the progress and shortcomings of governmental policies which concern women's rights. This will be followed by an analysis of women's participation in national government. Finally I will show that, overall, the advances in women's rights in France since the 1960s outweigh the setbacks. If we consider their achievements within their cultural context, French women have been successful in overcoming enormous social, legal and political obstacles

Ecuador : Potential Policies For The Future, Jeremy Cunningham '97

The Park Place Economist

In 1531 Spanish explorers embarked from Peru and landed in what is now modem day Ecuador. Peru was "the richest of the New World prizes won for the Spanish crown" (Ecuador, 1991), but the Spanish wanted to find more colonies to plunder. Drunk with tales ofgreat riches in Ecuador, King Charles I of Spain decided to send an explorer by the name of Francisco Pizzaro to investigate. Pizzaro and his men killed thousands of Inca tribesmen; they also looted and. pillaged everything that they could find. By the early 154Os, the whole ofwhat is now Ecuador was under Spanish control.

The United Nations Convention Of The Rights Of The Child: A Feminist Landmark, Cynthia Price Cohen Apr 1997

The United Nations Convention Of The Rights Of The Child: A Feminist Landmark, Cynthia Price Cohen

William & Mary Journal of Race, Gender, and Social Justice

The United Nations Convention on the Rights of the Child,1 adopted by the General Assembly on November 20, 1989, is a ground-breaking human rights treaty for many reasons. It had the largest number of signatories on the day that it was opened for signature.2 It went into force more quickly than any other human rights treaty;3 it reached near-universal ratification by mid-1996;4 and it protects the entire range of human rights: civilpolitical, economic-social-cultural, and humanitarian.5 In addition, the Convention's monitoring mechanism gives unique powers to its monitoring body, the Committee on the Rights of the Child.6 Unfortunately, these achievements have …

A Strategy For Ministry To Widows In The Local Church, Richard Watson Sadler Apr 1997

A Strategy For Ministry To Widows In The Local Church, Richard Watson Sadler

Doctoral Dissertations and Projects

In examining current literature, very little research has been done in the area of caring for widows in the local church. The biblical mandate, present social conditions, and the results from questionnaires sent to pastors and widows of Southern Baptist Churches of West Virginia validate the need to assist the church in developing and implementing a strategy in ministering to widows. Deacons, the servant-leaders, are the responsible agents for ministry to widows and the catalyst in getting others involved. This project is an instrument to awaken and equip God's people for the tremendous ministry privilege in serving widows.

Administrative Performance Of “No-Fault” Compensation For Medical Injury, Randall R. Bovbjerg, Frank A. Sloan, Peter J. Rankin Apr 1997

Administrative Performance Of “No-Fault” Compensation For Medical Injury, Randall R. Bovbjerg, Frank A. Sloan, Peter J. Rankin

Law and Contemporary Problems

"No-fault" is the leading alternative to traditional liability systems for resolving medically caused injuries, and policy interest in such reform reflects numerous concerns with the traditional tort system as it operates in the medical field through malpractice insurance. The administrative experience of the Florida and Virginia no-fault programs is examined.

The Jones Act: It Is Time For Reform, Richard L. Clarke Apr 1997

The Jones Act: It Is Time For Reform, Richard L. Clarke

Journal of Transportation Management

The Jones Act was passed in 1920 as an amendment to the Merchant Marine Act. Its initial purpose was to protect a rail monopoly operating between the state of Washington and the territory of Alaska. It restricted transportation between U.S. ports to U.S. built, owned, registered and crewed vessels. Over the past 77 years it has become very controversial. This paper examines its costs and benefits and concludes that the Jones Act is indeed in need of major reform.

School-Sponsored Service Programs And The Educational Development Of High School Students, Andrew Furco Apr 1997

School-Sponsored Service Programs And The Educational Development Of High School Students, Andrew Furco

Thesis, Dissertations, Student Creative Activity, and Scholarship

Currently, a growing number of our nation's school districts are encouraging students to perform community service. Vermont, Minnesota, and Pennsylvania, for example, all include community service activities as part of their K-12 education plans. Maryland requires all high school students to complete 60 hours of community service prior to graduation. And as part of California's Challenge Initiative, it is expected that by the Year 2004, every student in California will engage in at least one community service or service-learning experience prior to graduation (1996, California Department of Education).
