Critical Evaluation Of The Double Tracks Remediation Project, Craig J. Barnes Apr 1997

Critical Evaluation Of The Double Tracks Remediation Project, Craig J. Barnes

UNLV Theses, Dissertations, Professional Papers, and Capstones

The U.S. Atomic Energy Commission (AEC) (now the U.S. Department of Energy), in testing the safety of nuclear weapons under many different conditions, detonated single plutonium bearing devices in such a fashion as to simulate an unintentional detonation of the high-explosive portion of nuclear weapons. This resulted in the uncontained spread of plutonium and other radionuclides, such as americium and depleted uranium, in the environment in the vicinity of these experiments. The Double Tracks site was one of these experiments on the Tonopah Test Range (TTR) which was contaminated hi excess of 200 picocuries per gram (pCi/g). The Double Tracks …

The Military-Bureaucracy Relationship In Nigeria: A Study Of Public Policy Making And Implementation, Robert Aziakpono Dibie Apr 1997

The Military-Bureaucracy Relationship In Nigeria: A Study Of Public Policy Making And Implementation, Robert Aziakpono Dibie

Dissertations

The Federal Government of Nigeria’s Structural Adjustment/Make-or-Buy policy was introduced in July 1986 to accelerate the development of Nigerian industrial capacity by contracting government R & D out to the private sector. This study expands the empirical and theoretical analyses of development policy and its implementation that have traditionally relied on motives of "rationality" (costs/benefits) to explain bureaucratic behavior. It examines and juxtaposes the military-dominated policy making apparatus with the traditional bureaucracy, which has the responsibility for the execution of public policy. It also attempts to make some contribution to Nigerian and comparative literature in the field of industrial development …

The Eldorado Landfill: A Case Study, Heather A. Nash Apr 1997

The Eldorado Landfill: A Case Study, Heather A. Nash

UNLV Theses, Dissertations, Professional Papers, and Capstones

In 1995, Boulder City bought from the federal government 167 square miles of land in the Eldorado Valley which is located approximately seven miles west of the city. Soon afterward, the current landfill in Boulder City began accepting construction waste from Las Vegas. The large dump trucks had to travel through Boulder City on route to the landfill. In doing this they passed through three school zones and residential areas. When residents began complaining about the trucks, the Boulder City City Council began investigating various ways to solve the problem. The solution they adopted was to construct a new landfill …

Male And Female Bildung: The Mémoires De Céleste Mogador, Claire Marrone Apr 1997

Male And Female Bildung: The Mémoires De Céleste Mogador, Claire Marrone

Languages Faculty Publications

The 'Memoires de Celeste Mogador' is a Bildungsroman narrating the life a a prostitute and an actress. Censorship may have been the reason the book was not better known in its own time, and maybe even today. She eventually marries a count with whom she has an affair and follows him when he becomes French consul to Australia. The books recounts the life of an exceptional 19th century heroine, who has the strength to succeed despite a society which limits female roles and has ideas about proper marriages.

Civilians Don't Try: A Comment On Mirjan Dama~Ka's "Rational And Irrational Proof Revisited", William Twining

Cardozo Journal of International and Comparative Law

The article explores the cultural differences between common law and civil law systems, particularly in how they approach trials and evidence. It highlights that common law systems, like the American model, emphasize adversarial trials and public spectacle, while civil law systems focus on written records and bureaucratic processes. The O.J. Simpson trial serves as a prime example of these differences, showcasing the dramatic and media-driven nature of American trials compared to the more subdued European approach.

A Rose By Any Other Name: Marriage And The Danish Registered Partnership Act, Craig A. Sloane

Cardozo Journal of International and Comparative Law

The article argues that the Danish Registered Partnership Act of 1989, while a significant step toward equality, falls short of true parity with marriage due to discriminatory exceptions such as the prohibition of adoption and church weddings. The author contends that these exclusions stem from societal prejudice and that same-sex unions should be fully incorporated into the legal framework of marriage to achieve genuine equality.

Emergency Care And Managed Care—A Dangerous Combination, Diane E. Hoffman Apr 1997

Emergency Care And Managed Care—A Dangerous Combination, Diane E. Hoffman

Washington Law Review

Managed care plan subscribers in need of emergency medical treatment often face unduly restrictive plan practices. These practices may result in life-threatening injury or significant financial obligations on the part of plan subscribers. They are the result of a managed health care system that is inadequately regulated and overly concerned with cost control. Economic incentives lead plans to deny approval for emergency medical treatment or to deny retroactively coverage for such treatment. Emergency medical providers also are harmed by these practices, often forced to treat patients under federal law but denied payment for their services. This Article describes this problem …

Identifying Air Flow Failure Modes In Small Commercial Buildings: Tools And Methodologies For Building Commissioning Diagnostics, Florida Solar Energy Center, James Cummings Apr 1997

Identifying Air Flow Failure Modes In Small Commercial Buildings: Tools And Methodologies For Building Commissioning Diagnostics, Florida Solar Energy Center, James Cummings

FSEC Energy Research Center®

A recent study of small commercial buildings in central Florida found that uncontrolled air flow -- including duct leakage, return air imbalance, and exhaust air/make-up air imbalance -- is widespread. Of 70 buildings studied, only 1 was identified as having no significant uncontrolled air flow. The causes of uncontrolled air flow include failure of design, poor workmanship, O&M problems, HVAC commissioning failures, materials degradation, and building retrofits. This study also found that the consequences of uncontrolled air flow are often quite severe and varied -- including high utility bills, occupant thermal discomfort, high humidity, mold and mildew growth, moisture damage …

The Relationship Of Training Methods Between Ncaa Division I Cross-Country Runners With 10,000 Meter Performance, Max J. Kurz Apr 1997

The Relationship Of Training Methods Between Ncaa Division I Cross-Country Runners With 10,000 Meter Performance, Max J. Kurz

Student Work

The scientific relationship between 10,000 meter performance and training methods of distance runners remains incompletely understood. Researchers such as Slovic (1977) and Pollock (1978) have attempted to study the relationship between training practices of distance runners with the use of surveys. However, these studies did not analyze the significance of various types of training regimens available. The purpose of this study was to evaluate the training methods of NCAA Division I runners and 10,000 meter performance. Fourteen Division I qualifying teams of the NCAA Division I national cross-country meet and 16 randomly chosen non-qualifying teams were recruited through the mail …

Aboriginal Autonomy: The Future Of Indigenous Development In Western Australia, Matthew B. Eugster Apr 1997

Aboriginal Autonomy: The Future Of Indigenous Development In Western Australia, Matthew B. Eugster

Masters Theses

The prospects for development within the Aboriginal society of Western Australia were the focus of this study. The Primary intent of the study was to examine the causes behind an apparent lack of development within Aboriginal society. Next, the study examined possible remedies for the situation.

The study determined that the lack of development in Aboriginal society can be attributed primarily to social dysfunction ( or social dislocation). Furthermore, social dislocation could be attributed to cultural deprivation or the inability to practice one's culture. It was proposed and established that cultural and political autonomy would provide an environment more suitable …

Acid Mine Drainage And Its Effects On Salamander Assemblages In Cumberland Plateau Streams Of The North Chickamauga Creek Watershed, Tennessee, Melissa Combs Apr 1997

Acid Mine Drainage And Its Effects On Salamander Assemblages In Cumberland Plateau Streams Of The North Chickamauga Creek Watershed, Tennessee, Melissa Combs

Honors Theses

In Appalachia's coal mining regions, acid mine drainage (AMD) has contributed to the widespread degradation of stream ecosystems. Salamanders are common inhabitants of healthy headwater streams and because of their permeable skins are excellent indicators of ecosystem intergrity. Hence, we investigated the potential effects of AMD on the species richness and relative abundance of aquatic salamanders in selected stream reaches (sites) of the North Chickamauga Creek (NCC) system, Tennessee. Specimens were collected by kick-net sampling with a 500um mesh dip net and/or electroshocking at four AMD-impacted sites (pH< 5.6) and two reference sites pH> 6.2), May-July 1996. Species richness was similarly low at reference sites, 2 …

Cries And Whispers: Environmental Hazards, Model Rule 1.6, And The Attorney's Conflicting Duties To Clients And Others, Irma S. Russell Apr 1997

Cries And Whispers: Environmental Hazards, Model Rule 1.6, And The Attorney's Conflicting Duties To Clients And Others, Irma S. Russell

Faculty Works

This article examines the ethical tensions lawyers face when client confidentiality conflicts with the potential for environmental harm. This article focuses on Model Rule 1.6 of the Model Rules of Professional Conduct, arguing that its categorical approach to confidentiality often compels silence even when public safety is at stake. By exploring the role of attorneys as both client advocates and officers of the court, the article critiques the profession’s prioritization of the “attorney as champion” model. Using the hypothetical of a domestic environmental disaster akin to Bhopal, the article highlights the inadequacy of current ethical rules to address widespread …
