The Quality Of First Amendment Speech, Randall P. Bezanson Jan 1997

The Quality Of First Amendment Speech, Randall P. Bezanson

UC Law SF Communications and Entertainment Journal

One of the core axioms of First Amendment jurisprudence is that the quality of speech-its goodness or badness from a literary, artistic, or aesthetic perspective, or its effectiveness in communicating to an audienceshould bear no relationship to its protection under the First Amendment. This Article analyzes the Supreme Court's First Amendment doctrine across a wide range of fields: political speech, obscenity, commercial advertising, misrepresentation, entertainment, literature and the arts, and humor. The author demonstrates that the Court regularly, although implicitly and perhaps unconsciously, employs various qualitative criteria in determining whether and to what extent speech is protected under the First …

Educational Excellence For Administrating Schools : A Reflective Essay, Cynthia J. Lapel

Graduate Research Papers

A visionary leader must look at what the organization should be like to achieve educational excellence, and then be willing to undertake the necessary steps to achieve the vision. Educational excellence will take a strong-hold only when it evolves from a community commitment for excellence. This community consisting of students and teachers, as well as parents and the public, led by a visionary administrator, will develop a commonly held vision to achieve educational excellence for their school district.

An Assessment Of Community-Based Family Planning Programs In Kenya, Jane Chege, Ian Askew Jan 1997

An Assessment Of Community-Based Family Planning Programs In Kenya, Jane Chege, Ian Askew

Reproductive Health

Kenya has a long history of using community-based distribution (CBD) as an integral part of its family planning (FP) program. The purpose of this study was to assess the role of CBD programs in terms of providing information and services, to learn more about the determinants of program effectiveness, and to attempt to compare the programs’ cost-effectiveness. Fieldwork was undertaken in mid-1995 when data were collected from seven of the major CBD programs in Kenya. Four rural and three urban programs were included, as were programs that remunerated their agents and those that did not, and programs that had full-time …

Counseling The Husbands Of Postabortion Patients In Egypt: Effects On Husband Involvement, Patient Recovery And Contraceptive Use, Nahla G. Abdel-Tawab, Dale Huntington, Ezzeldin Osman Hassan, Hala Youssef, Laila Nawar Jan 1997

Counseling The Husbands Of Postabortion Patients In Egypt: Effects On Husband Involvement, Patient Recovery And Contraceptive Use, Nahla G. Abdel-Tawab, Dale Huntington, Ezzeldin Osman Hassan, Hala Youssef, Laila Nawar

Reproductive Health

An ANE OR/TA Project qualitative study conducted in 1995 probed into women’s perceptions of abortion in Egypt, and the stress that postabortion patients experience during recovery. That study drew attention to the important role husbands can play in their wives’ recovery and subsequent use of contraception. This study was designed to test the effects of involving husbands in the postabortion medical-care process. Overall, the study indicates that providing counseling to husbands of postabortion patients is feasible, as the majority of husbands either accompanied their wife on admission or at discharge from the hospital. However, administrative changes are needed to enhance …

Supreme Court Voting Behavior: 1996 Term, Richard G. Wilkins, Scott L. Worthington, David Buchanan Jan 1997

Supreme Court Voting Behavior: 1996 Term, Richard G. Wilkins, Scott L. Worthington, David Buchanan

UC Law Constitutional Quarterly

This Article, the twelfth in a series, attempts through statistical analysis to determine whether individual Supreme Court Justices and the Court as a whole voted more "conservatively," more "liberally," or about the same in the 1996 Term as compared with past terms. Overall, the 1996 Term reflects consolidation rather than expansion of the current Court's conservatism. Although the marked increase in the Court's rejection of First Amendment claims this Term is atypically conservative, this movement may well be due to cross-cutting ideological issues in the cases decided, not substantive rejection of liberal free speech norms. Moreover, the most politically liberal …

American Innocence, Robert N. Strassfeld Jan 1997

American Innocence, Robert N. Strassfeld

Faculty Publications

The sad fact is that our relationship to torture and other atrocities is more complicated and less innocent than we or President Bush would like to believe. This article examines that relationship and the ways in which we try to distance ourselves from torture and atrocity. Part II briefly explores our notions of exceptionalism and innocence. Part III then turns to our efforts to evade responsibility for torture and atrocity. First, it briefly discusses ways in which we try to deny our own acts of torture and abuse through rhetorical misdirection and by relegating torture to the shadows. Part III's …

Terry V. Ohio At Thirty: A Revisionist View, Lewis R. Katz Jan 1997

Terry V. Ohio At Thirty: A Revisionist View, Lewis R. Katz

Faculty Publications

In this Article, I suggest that, while the Warren Court provided a needed tool to police, it failed to achieve its stated purpose of tying the practice to the Fourth Amendment reasonableness standard. First, the Court failed to adequately define an "investigatory stop," leading later courts to harden the definition, eliminating the Fourth Amendment from most on-the-street police-citizen encounters. Second, the facts in Terry failed to meet the reasonableness standard Chief Justice Warren purported to apply and which subsequently has been further weakened in later cases. Finally, the decision in Terry failed to strike a meaningful Fourth Amendment balance between …

Robert Mcnamara And The Art And Law Of Confession: ‘A Simple Desultory Philippic (Or How I Was Robert Mcnamara’D Into Submission)’, Robert N. Strassfeld

Faculty Publications

This Article examines McNamara's "confession" and the public response to it within the context of an American tradition of confession in law and literature. Part I traces that tradition to the criminal conversion narratives and gallows speeches of colonial New England. Puritan society had clear expectations of what it took to make a good confession, and the Article identifies these rules for confession. It also examines the functions of confession in that society and argues that these confessions had several social consequences, including easing the consciences of those implicated in the criminal's punishment; bolstering civil and religious authority; warning the …

Laura Jensen, Dina Ben-Lev Jan 1997

Laura Jensen, Dina Ben-Lev

Western Writers Series Digital Editions

Poet and critic Tess Gallagher has described Laura Jensen as “the Einstein of the ordinary.” Just as Einstein's theories disrupted the then common-sense understanding of a universe governed by immutable laws, Jensen’s poems transform our view of the everyday things we take for granted, the ordinary birds and flowers we no longer notice. “Behind a poem is a bad intention / to make the reader worry deeply,” Jensen writes in “What Is Poetry?”, a poem from her first chapbook (After 16). Her poems “worry” us because they force us to confront our fear of the unpredictability of the world. …

Garrett Hongo, Laurie Filipelli Jan 1997

Garrett Hongo, Laurie Filipelli

Western Writers Series Digital Editions

Garrett Kongo’s poetic voice rises from cultural, historical, and personal memories. As a Yonsei (a fourth-generation Japanese American) born in Hawai i and raised largely in Los Angeles, his concerns span time and place, and his style links Asian and European traditions. He writes from the crowded trains and serene temples of his ancestral homeland, the lush jungles and active volcanoes of his birthplace, and the racial tension and dispossession of life in urban America, fitting the pieces together in a mosaic of self, family, and culture.

Justice George Sutherland And Economic Liberty: Constitutional Conservatism And The Problem Of Factions, 6 Wm. & Mary Bill Rts. J. 1 (1997), Samuel R. Olken

UIC Law Open Access Faculty Scholarship

Most scholars have viewed Justice George Sutherland as a conservative jurist who opposed government regulation because of his adherence to laissez-faire economics and Social Darwinism, or because of his devotion to natural rights. In this Article, Professor Olken analyzes these widely held misperceptions of Justice Sutherland's economic liberty jurisprudence, which was based not on socio-economic theory, but on historical experience and common law. Justice Sutherland, consistent with the judicial conservatism of the Lochner era, wanted to protect individual rights from the whims of political factions and changing democratic majorities. The Lochner era differentiation between government regulations enacted for the public …

Facing The Facts: An Empirical Study Of The Fairness And Efficiency Of Foreclosures And A Proposal For Reform, 30 U. Mich. J.L. Reform 639 (1997), Debra Pogrund Stark

UIC Law Open Access Faculty Scholarship

Lenders view real estate foreclosures as too expensive and time consuming a process which needlessly increases the costs of making loans. Others complain that the foreclosure process fails to adequately protect the borrower's equity (the value of the property in excess of the debt secured by the property) in the mortgaged property. This article tests these views by gathering new data on the fairness and efficiency of the foreclosure process. Based on the data collected (which confirms some assumptions but disproves others), the author proposes a reform of the foreclosure process to promote the interest of both lenders and borrowers. …
