Male Love And Islamic Law In Arab Spain, Louis Crompton Jan 1997

Male Love And Islamic Law In Arab Spain, Louis Crompton

Department of English: Faculty Publications

A unique flowering of homoerotic poetry took place in Iberia after the Arab conquest in 71 L The efflorescence there repeated a phenomenon of the Islamic world generally, paralleling the erotic lyrics of Iraq, Persia, Afghanistan, Mughal India, Turkey, and the North African states of Egypt, Tunis, and Morocco. The anthologies of medieval Islamic poetry, whether compiled in Baghdad, Damascus, Isfahan, Delhi, Kabul, Istanbul, Cairo, Kairouan, or Fez reveal, with astonishing consistency over a period of a millennium, the same strain of passionate homoeroticism we find in love poems from Cordoba, Seville, and Granada.

Defining And Classifying Pilgrimages, Robert Stoddard Jan 1997

Defining And Classifying Pilgrimages, Robert Stoddard

Geography Program: Faculty Publications

To make comparisons among the many forms of religious journeys, scholars need both an acceptable definition of the phenomenon called pilgrimages and a workable classification scheme that reveals significant differences. Following a discussion about the elements that should be incorporated into a definition of pilgrimages, a formal statement is presented. This provides a basis for separating those traveling activities that should be studied as pilgrimages from all other forms of human movement. Further differentiation among pilgrimages can be achieved by categorizing them into a few distinct classes. Several criteria that logically could be utilized for dividing pilgrimages into various types …

Sex Online: Is This Adultery, Christina Tavella Hall Jan 1997

Sex Online: Is This Adultery, Christina Tavella Hall

UC Law SF Communications and Entertainment Journal

Should online infidelity be included as grounds for divorce in modern adultery statutes? This Note explores the history of divorce law and evaluates the possibilities of alleging online adultery as a sustainable reason for divorce. The author concludes that, in light of the normative goals of divorce law, the courts are an improper venue for addressing online affairs. Thus, online affairs, though possibly detrimental to marriage, are not "adultery" for legal purposes and therefore should not constitute adequate grounds for divorce in fault-based divorce proceedings.

Reflections On A Gossamer Thread In The World Wide Web: Claims For Protection Of The Droit Moral Right Of Integrity In Digitally Distributed Works Of Authorship, Timothy E. Nielander Jan 1997

Reflections On A Gossamer Thread In The World Wide Web: Claims For Protection Of The Droit Moral Right Of Integrity In Digitally Distributed Works Of Authorship, Timothy E. Nielander

UC Law SF Communications and Entertainment Journal

The global distribution of digitized materials through the Internet creates new challenges for traditional copyright law. Protection for moral rights continues to be a subject of international contention because of the global and interactive nature of cyberspace. Moral rights contemplate highly personal control over creative expression even after the artist has obtained the economic benefit provided by copyright laws throughout the globe. This Article argues that policies predicated on the free flow of information and of creative works in international trade may diminish the capacity of artists to claim violations of a right of integrity in digitized reproductions of their …

The Law Of Arbitration, Theodore J. St. Antoine Jan 1997

The Law Of Arbitration, Theodore J. St. Antoine

Book Chapters

The law did not look kindly on arbitration in its infancy. As a process by which two or more parties could agree to have an impartial outsider resolve a dispute between them, arbitration was seen as a usurpation of the judiciary' sown functions, as an attempt to "oust the courts of jurisdiction." That was the English view, and American courts were similarly hostile. They would not order specific performance of an executory (unperformed) agreement to arbitrate, nor grant more than nominal damages for the usual breach. Only an arbitral award actually issued was enforceable at common law. All this began …

Hegel, Reason, And Idealism, Philip J. Kain Jan 1997

Hegel, Reason, And Idealism, Philip J. Kain

Philosophy

In this article I want to focus on the central role that scientific reason plays, for Hegel, in leading us toward idealism, yet its complete failure to adequately establish idealism, and, oddly enough, the way in which this failure turns into a most interesting success by anchoring idealism and thus preserving us from solipsism. To bring all of this into relief, I must attend to Hegel’s differences with Kant.
