Is Tobacco A Drug? - Administrative Agencies As Common Law Courts Regulations, Cass R. Sunstein
Is Tobacco A Drug? - Administrative Agencies As Common Law Courts Regulations, Cass R. Sunstein
Articles
Professor Cass Sunstein argues that the FDA has the authority to regulate tobacco products. He considers the text of the Federal Food, Drug, and Cosmetic Act, which supports the FDA assertion, and the context of its enactment, which argues against the FDA. He resolves the tension between text and context in favor of FDA jurisdiction by turning to the emerging role of administrative agencies. In modem government, he contends, administrative agencies have become America's common law courts, with the power to adapt statutory regimes to new facts and new values when the underlying statute is ambiguous. Professor Sunstein's Article, like …

Crossing Boundaries: Land And Sea In Jane Austen's 'Persuasion', Laura Vorachek
Crossing Boundaries: Land And Sea In Jane Austen's 'Persuasion', Laura Vorachek
English Faculty Publications
Jane Austen suggests in Persuasion the pressures that the increased mobility of the middle class placed on the established aristocratic society in her time. Anne Elliot especially brings to light the inherited assumptions of her society. She can marry within her social rank (Mr. Elliot or Charles Musgrove) or marry below her (Wentworth at age 23), but either is a choice within the limits established by her society. One owns land or one does not. But when Wentworth returns a man of name and wealth, he is not a member of the landed gentry nor is he below Anne in …

Writing Science Through Critical Thinking, Marilyn F. Moriarty
Writing Science Through Critical Thinking, Marilyn F. Moriarty
Books by Hollins Faculty and Staff
Written and extensively class tested with NSF/NIH support, this timely and useful text addresses a crucial need which is acknowledged in most universities and colleges. It is the need for students to learn to write in the context of their field of study; in this case science. Although numerous "how to" writing books have been published, few, if any, address the central pedagogical issues underlying the process of learning to think and write scientifically. The direct connection between this writing skill and that of critical thinking is developed with engaging style by the author, an English professor. Moriarty's book is …

Limitations Of The Adversary Approach In Our Criminal Justice System, Harry Lee Anstead
Limitations Of The Adversary Approach In Our Criminal Justice System, Harry Lee Anstead
St. Thomas Law Review
If there is one thing that I would like for you to remember from my remarks today, it is the limitations of the adversary system. I would like you to keep that phrase in mind, and if you carry anything away at all to think about, let it be the limitations of the adversary system that we have in the United States.
Indigent Contemnors Beware: In Florida, You May Be Incarcerated Without Being Appointed Counsel, Neal G. Bourda
Indigent Contemnors Beware: In Florida, You May Be Incarcerated Without Being Appointed Counsel, Neal G. Bourda
St. Thomas Law Review
The proposition espoused in this comment is applicable to any civil contempt action where the contemnor is indigent. However, this comment principally focuses on Florida's laws regarding an indigent parent's right to court-appointed counsel for failure to pay child support. While Florida has a court procedure allowing the indigent parent to explain why he is in contempt, the proceeding does not include the right to counsel if he is indigent, although the possibility of incarceration is ever present. In this context, Florida should adopt a policy that abolishes the civil/criminal contempt distinction. Furthermore, Florida should adopt a bold policy of …

Grounds For Argument: Local Understandings, Science, And Global Processes In Special Forest Products Harvesting, Thomas Love, Eric Jones
Faculty Publications
In posing the question "Where are the pickers?", Love and Jones suggest that the shifting paradigm in forestry is real and that academia is not leading the shift. Love and Jones illustrate the emergence of special forest products' legitimacy in competing uses of forests with their experience and research in mushroom harvesting in the Pacific Northwest.
