Service-Learning: A Balanced Approach To Experiential Education, Andrew Furco Jan 1996

Service-Learning: A Balanced Approach To Experiential Education, Andrew Furco

Service Learning, General

For over a quarter of a century, education researchers and practitioners have struggled to determine how to best characterize service-learning. In 1979, Robert Sigmon defined service-learning as an experiential education approach that is premised on "reciprocal learning" (Sigmon, 1979). He suggested that because learning flows from service activities, both those who provide service and those who receive it "learn" from the experience. In Sigmon's view, service-learning occurs only when both the providers and recipients of service benefit from the activities.

Assessing The Tax Administration Law Of The People's Republic Of China, Kara Phillips, Amy Sommers Jan 1996

Assessing The Tax Administration Law Of The People's Republic Of China, Kara Phillips, Amy Sommers

Faculty Articles

This article discusses the effort of the People's Republic of China (PRC or China) to obtain revenue through taxes rather than through receipt of profits from state enterprises. In order to strengthen the tax system, in 1992 the Standing Committee of the National People's Congress enacted the Law of the People's Republic of China to Administer the Levying and Collection of Taxes (Tax Administration Law). The authors evaluate the PRC’s Tax administration Law, and discuss the factors that influenced the enactment of the Tax Administration Law and the Implementing Regulations. The authors also examine the Tax Administration Law’s general principles, …

Domination In The Theory Of Justification And Excuse, George P. Fletcher Jan 1996

Domination In The Theory Of Justification And Excuse, George P. Fletcher

Faculty Scholarship

The major currents driving legal theory have largely bypassed the field of criminal law. Neither the economists nor the advocates of critical legal studies ("crits") have had much to say about the theory of criminal responsibility or the proper mode of trying suspects. The economists have fallen flat in applying their rationalist models to the problems of punishing wrongdoers. The "crits" have had little to add-beyond Mark Kelman's one original and provocative article.

Of all the schools on the march in the law schools today, the feminists have had the most to say about the failings of the criminal law. …

The Habeas Corpus Revolution: A New Role For State Courts., Charles F. Baird Jan 1996

The Habeas Corpus Revolution: A New Role For State Courts., Charles F. Baird

St. Mary's Law Journal

This Article’s purpose is to portray recent changes in the United States Supreme Court’s habeas corpus jurisprudence—limiting the scope of the federal writ while reducing the federal judiciary’s role overseeing the criminal justice systems. Seemingly, the Court gave little thought to whether this reduction in federal oversight should be accompanied by a greater measure of review on the part of state courts. The writ of habeas corpus, often referred to as the Great Writ, is the primary means of enforcing rights guaranteed under the United States Constitution and federal courts are the principal guardians of these rights. While commitment to …

The Mark Of Cain: No Second Chance For Teachers Convicted Of Sex Offenses Against Students, Eric J. Kuperman

Cardozo Journal of Equal Rights & Social Justice

The note argues that teachers convicted of sex offenses against students should be subject to a national registration and notification system, akin to Megan's Law, due to the inadequacy of current systems in preventing these individuals from continuing to teach and offending again. The author emphasizes the need to protect children from sexual predators in educational settings, highlighting the failure of schools and courts to effectively address the issue.

Dispute Resolution Under The Americans With Disabilities Act: A Report To The Administrative Conference Of The United States, Ann C. Hodges

Law Faculty Publications

Congress passed the Americans With Disabilities Act ("ADA") in 1990 and it became effective in 1992.The statute prohibits discrimination against individuals with disabilities by employers, state and local governments, and public accommodations. With more than two years experience under the statute, an assessment of the effectiveness of the dispute resolution procedures is appropriate. This Article begins with a brief overview of the statute, including an analysis of the dispute resolution procedure under each title. The report then discusses the effectiveness of existing dispute resolution procedures. Finally the report makes recommendations for improving the dispute resolution procedures, including a specific recommendation …

Reconstructing Reality: Interpreting The Aeroplane Disaster News Story, Ana C. Garner Jan 1996

Reconstructing Reality: Interpreting The Aeroplane Disaster News Story, Ana C. Garner

College of Communication Faculty Research and Publications

At 9 a.m. on 31 August 1988, Delta Flight 1141 crashed on take‐off, killing 13 people and leaving 94 survivors. Existing research has furthered our insight into media coverage of disasters but it has not broadened our understanding of disaster narrative interpretations and disaster behaviour education. In total, 24 in‐depth interviews explore reader interpretations of print‐mediated disaster reality and the Delta 1141 disaster. Disaster news stories provide the frames people use to interpret aeroplane disaster behaviour. Concludes the media need to recognize that their pedagogical role extends beyond disaster reporting and includes disaster behaviour information.

A Neural Network Approach For Implementing A High Dimension Reduction Feature Finder For Automatic Image Matching., Qiang Lin Jan 1996

A Neural Network Approach For Implementing A High Dimension Reduction Feature Finder For Automatic Image Matching., Qiang Lin

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation explores the Counter Propagation Network (CPN) to implement an image feature finder for automatic image matching systems. This research concludes that the CPN paradigm does not appear to be capable of extracting distinctive features for matching complex images such as fingerprints. There are three possible factors explored in the document that contribute to this inability to match. These are: (1) Image Enhancement - Most of fingerprint images have certain levels of localized blur or smear, locally low contrast, or other noise. Currently available image enhancement methods are shown to not suppress these noises effectively. (2) Image Invariance - …

Regulatory Takings: Lobbying, Coalitions, And Influence., Randolph Rutherford Moffett Jan 1996

Regulatory Takings: Lobbying, Coalitions, And Influence., Randolph Rutherford Moffett

Graduate Theses, Dissertations, and Problem Reports (ETD)

There is a substantial body of literature examining the role of interest groups and their influence in the policy process. What is less clear is the decision-making process of groups in selecting strategies to advance their goals and how the choice of tactics impacts the behavior of other groups within the policy area. This dissertation examines what influences the choice of lobbying strategies in an attempt to understand whether certain types of groups favor particular strategies, how they use the policy process to influence policy decisions, and how successful they are in their choice of strategy. This study examines the …
