Kenneth Jenks was born a hemophiliac, inheriting the condi- tion from his mother. He contracted the HIV virus from a blood transfusion in 1980 and unknowingly passed the virus to his wife, Barbara Jenks. Mrs. Jenks was the first to suffer the effects of the illness. Her weight dropped by nearly forty pounds in three weeks due to constant debilitating nausea, and she was repeatedly hospitalized for two- to three-week stretches. Mrs. Jenks tried a half-dozen different oral medications for nausea to no avail, and could not function after shots for nausea left her in a stupor. Mr. Jenks experienced …

The past year has been exceptionally important for children and young people caught up in the legal system, both nationally and in Virginia. Beginning with the decision of the Supreme Court of the United States in Vernonia School District v. Acton in June of 1995, the ensuing year has seen major shifts in the administration of juvenile justice, and in Virginia's approach to abused and neglected children. The passage of major juvenile justice reform legislation and child abuse legislation in Virginia at the 1996 General Assembly session exemplifies these changes occurring in both the society's and the legal system's approaches …

Definitive airway management is one of the most important aspects of the care of ill or injured patients with a decrease in the level of consciousness. The effect of poor airway management can lead to aspiration, hypoxia, suffocation and death. Definitive airway management is the gold standard of care in patients with a Glasgow Coma Scale (GCS) of less than or equal to eight. Since average flight times to arrive at the patients "bedside" (hospital or accident scene location) are thirty minutes to two hours, the care that the patient receives prior to arrival of the flight crew is vital …

On May 12, 1995, the Supreme Court of Ireland upheld an act making it legal to disseminate information concerning abortion services abroad, provided that the information does not advocate or promote the termination of the pregnancy. While the Abortion Information Act of 1995 is likely to make it easier for an Irish woman to obtain an abortion overseas, it does not change the circumstances under which a woman may obtain an abortion in Ireland. Under the Eighth Amendment to the Irish Constitution, as interpreted by the Irish Supreme Court, abortion is illegal except where the pregnancy poses a substantial risk …

The Presumption Of Innocence: Patching The Tattered Cloak After Maryland V. Craig., Ralph H. Kohlmann

St. Mary's Law Journal

Over one hundred years ago, the United States Supreme Court recognized the importance of the presumption of innocence in a criminal justice system which is based on due process. The Court declared the presumption of innocence is “the undoubted law, axiomatic, and elementary, and its enforcements lies at the foundation … of our criminal law.” The Court’s changing view of the Sixth Amendment’s Confrontation Clause is the most recent contribution to the reduction in the practical value of the presumption of innocence. In selecting a route for the shipment of hazardous materials, the primary public safety concern is that routing minimizes risk by avoiding populated areas while utilizing the shortest and safest possible routes to reduce time in-state shipments; This research presents a methodology for estimating population index which reflects density ranges for various population groupings. The population index is based on the number of tracts, tract density, and county density. The population index is initially defined for population {dollar}{dollar}8000. in the absence of more data to validate the results in the latter grouping, the index is redefined for population {dollar}<{dollar}2500 and population {dollar}\geq{dollar}2500. The index is used to determine the level of analysis required in evaluating population: county, tract, or block level; Routing analysis based on minimization of risk by minimizing affected population is performed for the state of Nevada. The analysis focuses on two alternative rail routes that are being considered by the Department of Energy (DOE) for the shipment of high level wastes and spent nuclear fuels. An important issue in public finance is concerned with finding an appropriate choice-theoretic model for explaining state and local government fiscal behavior. Economists have traditionally viewed state and local expenditure and tax decision-making processes "as if" they were the results of utility maximization subject to a budget constraint. This approach provides a convenient device for applying the neoclassical demand theory to state and local public sector fiscal behavior. The appropriateness of making such an assumption has, however, not been directly addressed in the literature. This study explores refuse collection as a municipal service using qualitative methods to examine how government makes decisions about residential refuse collection services in Portland, Gresham, and Beaverton, Oregon. The study explores the history of refuse collection in these three cities to identify factors that influence bureaucratic behavior and decision making when selecting a municipal service delivery option for refuse collection. Public choice and public policy analysis theory are used to discuss those non-monetary considerations present when government makes decisions about service arrangements. Mandatory drug testing in the workplace as a form of employee monitoring raises numerous questions. This paper will explore the extent to which employees can claim a right to privacy in employment situations. This will be followed by an exploration into the legal framework in which drug testing programs may be implemented. Finally, the paper will consider the competing interests of employers and employees with respect to drug testing. The claim for wrongful pregnancy admittedly involves a "sensitive and difficult field of the law,""' one to which an "answer is not easy nor completely satisfactory" to all. The term "wrongful pregnancy" may be provocative to some who believe that a pregnancy should never be characterized in a negative manner. Yet, the claim is meant to remedy the plaintiffs' conscious and affirmative choice to not have a child. The pregnancy is wrongful not because the child once conceived or born is unwanted, but because of the interference with the plaintiffs' right to choice and to plan their family. The needs …
