Why, in comparison with other liberal capitalist democracies, is the social welfare state so poorly anchored in American law and public discourse? Surely American political and social history have contributed much to the weakness of our "social state." But law, too, has played a significant material, as well as ideological, role and has provided the terrain for much of our social development. This essay explores the particular contribution of the property-liberty nexus to the stunted development of positive liberty and social citizenship in the United States. The Persistent Nation State And The Foreign Sovereign Immunities Act, Mark L. Movsesian

One hears a great deal these days about the decline of the nation state. The concept of a sovereign country whose inhabitants share a common ancestry or culture is said to be obsolescent, if not already obsolete. Several factors, apparently, are responsible: the creation of supranational institutions like the European Union and the World Trade Organization; the growing influence of nongovernmental organizations; the emergence of a new global economy; and the formation of a worldwide consumer culture, to name just a few. The law, it is argued, must adapt.

This thesis explores the stories which revolve around folk legend Hugh Winder Nibley and what those stories mean to the people of Brigham Young University. Folklore reveals who we are and what is important to us. But, interestingly, folklore tends to reveal more about the person telling the story than about the subject of the story itself. People can't remember every story they hear. The ones they do remember are important to them. The stories are important because they fulfill basic needs of the teller. This thesis is a record of a journey into the pioneer past both literally and metaphorically. The physical journey retracing the Oregon and Mormon trails was made in September of 1993, the year I was a National Endowment for the Humanities/Reader's Digest Teacher-Scholar; however, my intellectual and emotional journey into the lives of pioneer women covers several years of study. I compare my life experiences with those of pioneer women whom I studied, using geographical settings on the trail trip as memory triggers. A literacy program that was implemented and introduced to the parents and students in the writer's third grade classroom is described. The goal of the literacy program was to nurture reading and writing in the home environment. The development of a literature-based integrated science unit for a multi-age classroom of 6- to 8-year-olds is based on a review of professional literature and a search of library materials for children. The integrated science unit on Iowa Owls and Bats allows children the opportunity to study animal life in their neighborhood, thus developing a better understanding of the real world around them.
