Professor Rebecca Eisenberg has provided us with an exhaustive and useful account of the recent dispute over patent protection for large-scale complementary DNA ("cDNA") sequencing. Stripped to its essentials, the dispute arose as follows. Scientists at the National Institute of Neurological Diseases and Stroke developed the initial techniques for the discovery of cDNA sequences and the ability to isolate certain "expressed sequence tags" ("ESTs") within the cDNA sequences. These gene tags permit investigators to identify the larger active DNA strands of which they are a part and provide information that might be used to develop drugs and other end products …

The articles presented here portray several different conceptions of the relationship between the realm of formal state law and the realm of social norms-as well as various views on what economic analysis might contribute to our knowledge of that relationship. Robert Ellickson's pathbreaking work describes two parallel domains, largely segregated from and irrelevant to each other; the norms of Shasta County arise and are maintained not in the shadow of the law, but in ignorance of it. Robert Cooter offers a more normative and synthetic vision, but it is a synthesis in which state law should understand itself primarily as …

A fundamental question that emerges from this literature involves the relationship between norms and law. To put this question in its sharpest and most interesting form: Under what circumstances should courts enforce the norms of private parties? In Shasta County, where norms, not laws, apparently govern cattle trespass and fencing disputes among ranchers, should the courts enforce these norms? For Ellickson, the answer seems relatively clear: If one concludes that the norms of close-knit groups are generally efficient, then when a close-knit group acts in contexts in which it is unable to impose losses on members, a utilitarian judge should …

Effects Of Daphnia Availability On Growth And Food Consumption Of Rainbow Trout In Two Utah Reservoirs, R. Tabor, Chris Luecke, Wayne A. Wurtsbaugh

We monitored the diet and growth of stocked rainbow trout Oncorhynchus mykiss in two Utah reservoirs during 1986 and 1989–1990. For the first month after stocking, juvenile rainbow trout in both reservoirs fed extensively on large Daphnia spp. In East Canyon Reservoir where Daphnia were abundant, this pattern continued throughout the summer, fall, and winter. Growth of rainbow trout in East Canyon Reservoir was generally good throughout 1989–1990. In Causey Reservoir, where Daphnia were less abundant and smaller, rainbow trout fed progressively less on smaller Daphnia throughout the summer, fall, and winter, while other prey items (snails, aquatic insects, and …

Fumonisins And Alternaria Alternata Lycopersici Toxins: Sphinganine Analog Mycotoxins Induce Apoptosis In Monkey Kidney Cells, Hong Wang, Clinton Jones, Janice Caiacci-Zanella, Todd Holt, David G. Gilchrist, Martin B. Dickman

Fusarium moniliforme toxins (fumonisins) and Alternaria alternata lycopersici (AAL) toxins are members of a new class of sphinganine analog mycotoxins that occur widely in the food chain. These mycotoxins represent a serious threat to human and animal health, inducing both cell death and neoplastic events in mammals. The mechanisms by which this family of chemical congeners induce changes in cell homeostasis were investigated in African green monkey kidney cells (CV-1) by assessing the appearance of apoptosis, cell cycle regulation, and putative components of signal transduction pathways involved in apoptosis. Structurally, these mycotoxins resemble the sphingoid bases, sphingosine and sphinganine, that …

Post-Conflict Behavior In Japanese Macaques At The Indianapolis Zoo: Age Of Opponents Influences Reconciliation, Scott Kight

In many primate species, opponents may affiliate soon after an agonistic encounter. This study examined how the individual characteris- tics of opponents affected post-conflict interactions in a captive group of Japan- ese macaques (Macaca fuscata). Reconciliation and selective attraction of opponents was shown to occur following agonistic encounters. The factor most strongly influencing post-conflict interactions was age. Juveniles were significantly more likely than adults to initiate reconciliation. Sex, kinship, and dominance status were not associated with contact initiation. Because juveniles were the most likely victims of aggression, juvenile reconciliatory contact initiative may reduce the threat of further aggression.

Infiltration Of Fecal Bacteria Through Soils: Timing And Tillage Effects, Mark S. Coyne, C. S. Stoddard, John H. Grove, William O. Thom

Soil Science News and Views

Land-applying animal wastes potentially exposes humans and animals to fecal pathogens, either by direct contact with soil and produce, or via ground water contamination. Some of these organisms are Salmonella, certain pathogenic Escherichia coli strains, protozoa such as Cryptosporidium and Giardia, and enteric viruses. Whether soil adequately filters these pathogens before they reach ground water depends on the interaction of porosity, texture, depth, water content, rainfall intensity and duration, and soil management.

There is not general agreement among scholars on the degree or type of standardization, or better, normalization, exhibited by Slovak texts before the 18th-19th century codifying efforts of Anton Bernolák, Ľudovít Štúr and their followers. Indeed, disagreement on this issue is greater the earlier the time period under consideration. The present study focuses on the 16th century and the degree and type of standardization/normalization exhibited in a corpus of 152 administrative-legal texts (judicial and municipal records, official correspondence, account books, etc.) from all four major Slovak dialect regions – Moravian, West, Central and East Slovak.
