When Actual Innocence Is Irrelevant: Federal Habeas Relief For State Prisoners After Herrera V. Collins, Jill Hanson Reinmuth

Washington Law Review

In Herrera v. Collins, the United States Supreme Court held that federal habeas courts lack jurisdiction over claims of actual innocence based on newly discovered evidence because federal habeas courts ensure only that state prisoners are not held in violation of the United States Constitution. This Note argues that state prisoners are held in violation of the Constitution when state procedural rules constructively bar presentations of newly discovered evidence of innocence. This Note proposes that federal habeas courts should grant 1) an evidentiary hearing when a petitioner makes a substantial allegation of newly discovered evidence of innocence, and 2) relief …

The past year has been another significant year for children and the legal system with the completion of the Virginia Commission on Youth's Serious Juvenile Offender study and the enactment of comprehensive legislation intended to implement the recommendations of that study as the General Assembly continues to focus on juvenile delinquency and school behaviors. The Governor and General Assembly failed to agree on a funding scheme for the Family Court, created in 1993, which consequently postponed the date for the Family Court's implementation from January 1, 1995 until July 1, 1996. The Indiana Department of Transportation has sponsored the design and implementation of a decision support system for routing highway maintenance vehicles – the Computer Aided System for Planning Efficient Routes (CASPER). Designed for solving multiobjective route design problems, CASPER has been used by agency personnel to design routes for winter maintenance vehicles with significant results: cost savings of more than $9-million to the State of Indiana through more efficient use of materials, equipment, and personnel, while at the same time significant improvement in overall level of network and public service. The Mormons In Wilhelmie Germany, 1870-1914: Making A Place For An Unwanted American Religion In A Changing German Society, Michael Mitchell

Theses and Dissertations

Between 1853 and 1914 the kingdom of Prussia and the Church of Jesus Christ of Latter-day Saints, the Mormons, disagreed over the issue of Mormon missionaries proselyting in Prussia. In 1853 royal magistrates banished all Mormon missionaries from the kingdom for advocating emigration. A new church policy of preaching without seeking for official permission, in addition to an improved relationship between the Mormons in Utah and the United States government after the Manifesto of 1890, led to an increase in missionaries sent to Germany, including Prussia. By 1900 mormon success alarmed the Prussian Protestant clergy and a few Prussian governors …
