In the early 1970's, the Food and Drug Administration (FDA) launched an Over-the- Counter (OTC) Drug Review with the objective of creating a uniform market containing medicines that are scientifically proven to be safe and effective for use without supervision of a physician. This project laid the groundwork for the switch policies and generated a tremendous amount of interest for improving or enhancing the concept of patient self-medication and providing a cost-effective alternative routine medical problems.

Enhanced Punishment Under The Texas Hate Crimes Act: Politics, Panacea, Or Pathway To Hell., David Todd Smith

Nearly without exception, modern legislatures have responded to the reprehensible nature and detrimental social effects of hate crime by enacting laws specifically designed to punish the offender’s discriminatory animus. The term “hate crime” describes criminal conduct which is motivated by the offender’s bias or prejudice against another cognizable group. Although the reprehensible nature of a hate crime is often apparent from the facts of any given case, the repercussions of these offenses exceed the ignoble character of any one specific act. Legislative Violence Against Lesbians And Gay Men, Terry S. Kogan

This is an essay about legislatures and about the ubiquitous violence directed against lesbians and gay men in our society. It asserts that a legislature has the power, through debate and through enacting statutes, to portray the "truth" about homosexuality for the general public, who otherwise know little about the reality of gay and lesbian lives. In so doing, legislatures can and, on occasion, do transform homosexuals into social outlaws depicted as deserving of violent treatment. In the thirty-six states with capital punishment statutes, there are presently 2774 inmates on death row On average, these prisoners will spend eight years on death row awaiting execution while challenging their sentences. This extended delay is not surprising considering the multiple levels of appeal available. State prisoners may challenge their sentence on direct appeal, state, and federal habeas corpus petitions.

Balancing The Scales Of Justice: The Case For And The Effects Of Utah's Victims' Rights Amendment, Paul G. Cassell

Utah Law Review

For many years the Anglo-American criminal justice system has paid little attention to crime victims and their concerns. Under the prevailing approach, it has been enough for the system to respond to prosecutors and particularly defense attorneys and to hope that crime victims were not dissatisfied with the process. Victims, however, have not been satisfied. Increasingly they have come to believe that the criminal justice system is out of balance, that their voices are not heard, and that the system is preoccupied with defendants' interests and rights.
